The site is located on the northeast corner of the intersection of Elk Avenue and Pierce Road;. Access to the site is provided .from Elk Avenue, The site is surrounded for the most part by almond and walnut orchards. r'our residential parcels, similar in size to the project site, exist to the east of the site, between Pierce Road and Dayton Road. Parcels in other directions range from 10 to 40 acres in size. Currently, one residence, a stucco studio, storage shed and poultry shed occupy the site. The Butte County General Plan designates the site Orchard and Field Crops, under an A-10 zone. sur',nunding parcels are also class,,tied Orchard and Field Crops, under A-10, A-20 and A-40 zones. Pr,mary environmental concerns associated with this project are rei,ated to -potential land use conflicts; potential impacts from noise;, light glare, odors and hazardous substances are the most serious concerns. Summary Conclusions Although the type of activities proposed by the applicant are 'husual, though allowed under A-10 zoning, the proposed project is similar to common agricultural: activities permitteri in agricultural zones. The repair and fabrication of farm machinery, eg., is a permitted use in agricultural zones Such an operation would typically include welding and forging activities, producing many of the same ,impacts (noise, odors; use of hazardous fuel, etc.)as the proposed project. As noted, the project site and adjacent residential parcels are surrounded in three directions by orchards. Agricultural operations normaliy conducted to maintain these orchards include the use of equipment for spraying, cultivating and harvesting that generate a substantial amount of noise, and pose the threat of human con= t.amination from toxic- chemicals (herbiciO-.s and petiticides) ,Much of.the proposed project is currentlyin operation In violation, of Section 24-200 (Dome Ocqupations), his would make relocation of the studio operations, as art alternative to the extant project proposal, quite expensive for the applicant. He is an orchardist and was aware that in agricultural areas, there are noises that disturb him. They have to work together. 7. Lugenbeel's property many times and the noise does not seem to be anything exceptional. He did not receive anything,with contingencies* He was not trying.to defy anyone. The people who are using the facilities are not being paid to work there. There are probably two or three people during the day and sometimes there is a larger group of people. 12. Neil McCabe*. Mr. McCabe spoke regarding the fact that the definition' of home occupation speaks to employment and work. The fact that people ate not getting paid does not matter. 13. Gerald LUgenbeel. Mr. Lugenbeel stated there were two lists of mitigations and ona was complied with. Several days ago Supervisor Dolan camo to his houseand had another set of mitigations. He did not know about the ma onry wall. As far as ceasing and desistingj the newspaper can tell him to do so all they want but that will have no effect on him. He was not aware of a cease and desist order. He uses propane gas for the firing of the furnace. I Mr. Lugenbeel answered Supervisor Saracenits qtestion about hou difficult it would be to move the furnace. it would 'oe a rather complex operation and would cost about $"3jOOO to move the furnacea There would still be grinding and tapping noises in the building.
