Site Plan approximately 50 feet southeast of the intersection of STAFF COMMENT: Staff recommends approval of the Use Permit with conditions and findings. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit to allow a used car sales lot for no more than six (6) vehicles. The vehicles will be kept within a 1,000 square foot triangular-shaped area located on the north end of the site. The applicant states that he will normally have two vehicles for sale, but would like to be able to have up to six vehicles for sale at any one time. No vehicle servicing is proposed. The hours of operation will be in conjunction with the cabinet manufacturing business on the site (Monday through Friday, 8:00 a.m. to 5:00 p.m.). The person selling the vehicles is the co-owner of the cabinet manufacturing business on the site. No structures will be built as a result of this project. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT 0 PAGE 1 ■ 0 0 The project site is zoned M-1 (Light Industrial) and has a General Plan Land Use designation of Industrial. Surrounding parcels range in size from .7 to 19 acres. Land use on nearby parcels is mainly industrial, with a cemetery located across Midway from the site. No other new or used car lots are located near the site, but there are several small used car lots located on Fair Street and East Park Avenue, which are located approximately .5 miles to the north of the site in the City of Chico. Residential uses are located to the east of the project site, across the abandoned railroad right-of-way. The Durham Bike Path lies between the site and Midway. The project site is located with the City of Chico's Sphere of Influence and is within the Chico Urban Area. The project parcel is 2.47 acres in size and is developed with a cabinet manufacturing business that operates out of two structures totaling 10,632 square feet. The site is level and does not contain any drainages. A six-foot tall chain link fence surrounds the property. Access to the site is via a driveway from Midway. A secondary access to Midway is located on the south side of the site. ANALYSIS: The project site is designated as Industrial by the Land Use Element Map of the General Plan, which allows commercial uses as secondary uses. The project site is zoned M-1, which requires a Use Permit for commercial uses and conditional uses listed in the C-1 and C-2 zones (Butte County Code Section 24-175.C.7). The C-2 zone allows used car sales by right (Butte County Code Section 24- 145.A.2). The proposed used car sales lot is consistent with the General Plan and with the M-1 zone. The project may result in a very minor increase in vehicle traffic on Midway. No trip generation estimates as available for a used car lot, and an increase in vehicle traffic generated by the project cannot be estimated. Based upon the fact that only six vehicles will be for sale at any one time, the project will not draw many customers, and no significant vehicle circulation impacts are anticipated. There is no left turn lane for vehicles turning left into the site from Midway and this may result in short term traffic delays for south bound traffic on Midway. The Public Works Department did not indicate that the project would have an impact to vehicle circulation. The project site is within the City of Chico's Sphere of Influence. The City does not object to the proposed used car sales lot, but requests that outdoor advertising signs associated with the project meet the City of Chico's sign standards for uses located in manufacturing and industrial zoning districts. The specific sign standard that the City recommends is found in Table 5-8.I of the City of Chico's Zoning Ordinance (Title 19) for single -tenant sites. This standard allows only one ground - mounted sign per parcel and no restrictions on the number of any other types of signs. The ground - mounted sign is limited to no more than 170 square feet, and- the total square footage of all signs cannot exceed 350 square feet. Signs are required to be at least three feet from property lines and maybe lighted. These sign standards are suggested as a condition. of project approval. The County does not have sign standards in the M-1 zone. A copy of the City of Chico's sign ordinance will be given to the applicant. The Butte County Fire Department/CDF requests that an all weather access, at least 10 feet wide and able to accommodate a 40,000 pound fire apparatus, be provided to all structures. The Butte County Air Quality Management District requests that measures be taken during project development ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 2 ■ activities to control fugitive dust emissions. These requests are added as conditions of project approval. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Adopt a Mitigated Negative Declaration with the following findings: A. Find that an Initial Study was completed in compliance with the, California Environmental Quality Act, that said study did not identify any potential significant environmental effects, and that a Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Negative Declaration, together with comments received during the public review process. C. Find, on the basis of the whole record before the Planning Commission, including the .Initial Study and any comments received, that there is no substantial evidence that the Oak Ridge Cabinets' Use Permit project will not have a significant effect on the environment. D. Find that the proposed Negative Declaration reflects the independent judgement and analysis of the County, which is the lead agency. E. Adopt the Negative Declaration regarding environmental impacts, with no mitigation measures, and authorize the Chair to sign. II. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a "de minimus" exemption regarding impact to fish and wildlife or their habitat is recommended. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not recommended. III. Approve Use Permit 00-13 for Oak Ridge Cabinets, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: The project will only create a very minor amount of vehicle traffic. 2. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Oak Ridge Cabinets is hereby granted a Use Permit in accordance with application filed: Use Permit to allow a used car sales lot for no more'than six (6) vehicles to be kept within a 1,000 square foot area. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. No more than six (6) vehicles shall be for sale at any one time. 2. All vehicles shall be kept within the 1,000 square foot area as depicted on the site plan, dated March 14, 2000. 3. No servicing of the vehicles for sale shall be allowed on the site. All lighting associated with the used car lot shall be directed downward and be contained within the property boundaries. Lighting shall not cause a nuisance on surrounding parcels and/or present a hazard to traffic using Midway. 5. All on-site advertising signs for the used car lot shall meet the City of Chico signage standards. The specific sign standards are found in Table 5-8.I of the City of Chico's Zoning Ordinance (Title 19) for single -tenant sites. Only one ground -mounted sign shall be allowed, with no restrictions on the number of any other types o�fogns. The lot is proposed to be 1,000 square feet in size. No vehicle servicing is proposed. The hours of operation will be Monday through Friday, 8:00 a.m. to 5:00 p.m., on property zoned M-1 (Light Industrial). (SB) (File UP 00-13) Mr. Betts stated that a correction needed to be made to Condition No. 5 on Page 6 of the Staff Report. He said that the word "not" should be added to the third sentence. The sentence should read "The ground - mounted sign shall not exceed 25 feet above ground level and shall not exceed 170 square feet. Commissioner Mooney asked if Condition No. 3 on Page 6 of the Staff Report included cleaning. Mr. Betts said no, that the washing of vehicles is permitted. Commissioner Mooney asked about storage. Mr. Betts said that up to six vehicles within the 1,000 square foot area is allowed. He then gave brief summary of the proposed application. Mr. Betts said staff is proposing that no servicing of the vehicles be allowed, which would prevent any adverse impacts, such as storage of fuels, oils or chemicals. Mr. Betts noted that the City of Chico has requested that any signs in reference to the used car lot conform to their sign standards. He stated that the project site is within the City of Chico's Sphere of Influence, and it is anticipated that someday, it will be annexed into the City. Commissioner Cage said that she had a concern with the safety of making a left turn coming from downtown Chico. Mr. Betts.said staff nor the Department of Public Works anticipate any problems. Commissioner Nelson asked if the city zoning was the same. Mr. Betts said yes, that it is "Industrial". The hearing was opened to the public. George Santos said that the referenced turn lane has existed for a number of years and that it is a small problem, but that if the Commission was going to address the issue, it should have been addressed when the original business was permitted. Mr. Santos said he felt that there was not a significant problem. The hearing was closed to the public. Commissioner Lambert said that at some point the Commission needs to address the left turn situation if development in the area continues. . Mr. Betts said that the new Circulation Study includes proposed improvements for the intersection. Commissioner Nelson said he had a concern with the signs. He also made reference to Condition No. 5, adding the word "not" in the third sentence. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: No more than six (6) vehicles shall be for sale at any one time. 4 • 2. All vehicles shall be kept within the 1,000 square foot area as depicted on the site plan, dated March 14, 2000. 3. No servicing of the vehicles for sale shall be allowed on the site. Vehicle servicing includes, but is not limited to, oil changes, tune ups, engine and power train repairs, body work, and painting. Washing and cleaning of vehicles is allowed. 4. . All lighting associated with the used car lot shall be directed downward and be contained within the property boundaries. Lighting shall not cause a nuisance on surrounding parcels and/or present a hazard to traffic using Midway. 5. All on-site advertising signs for the used car lot shall meet the City of Chico signage standards. The specific sign standards are found in Table 5-8.I of the City of Chico's Zoning Ordinance (Title 19) for single -tenant sites. Only one ground -mounted sign shall be allowed, with no restrictions on the number of any other types of signs. The ground -mounted sign shall not exceed 25 feet above ground level and shall not exceed 170 square feet. The total square footage of all signs shall not exceed 350 square feet. Signs shall be at least three feet from property lines and may be lighted. 6. Applicant must also comply with all other applicable State and local statutes, ordinances and regulations. 7. Provide an all weather access to all structures. The access shall have a minimum 10 -foot widtb and 15 -foot vertical clearance, and be able to accommodate a 40,000 pound fire apparatus. 8. Applicant shall incorporate measures to control fugitive dust emissions during project development activities. Measures may include site and driveway watering and/or use of other acceptable soil palliatives. PROJECT DESCRIPTION/SITE CHARACTERISTICS: This is an application for a Use Permit to allow a used car sales lot for no more than six (6) vehicles. The vehicles will be kept within a 1,000 square foot triangular-shaped area located on the north end of the site. The applicant states that he will normally have two vehicles for sale, but would like to be able to have up to six vehicles for sale at any one time. No vehicle servicing is proposed. The hours of operation will be in conjunction with the cabinet manufacturing business on the site (Monday through Friday, 8:00 a.m. to 5:00 p.m.). The person selling the vehicles is the co-owner of the cabinet manufacturing business on the site. No structures will be built as a result of this project. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 1 ■ The project site is zoned M-1 (Light Industrial) and has a General Plan Land Use designation of Industrial. Surrounding parcels range in size from .7 to 19 acres. Land use on nearby parcels is mainly industrial, with a cemetery located across Midway from the site. No other new or used car lots are located near the site, but there are several small used car lots located on Fair Street and East Park Avenue, which are located approximately .5 miles to the north of the site in the City of Chico. Residential uses are located to the east of the project site, across the abandoned railroad right-of-way. The Durham Bike Path lies between the site and Midway. The project site is located with the City of Chico's Sphere of Influence and is within the Chico Urban Area. The project parcel is 2.47 acres in size and is developed with a cabinet manufacturing business that operates out of two structures totaling 10,632 square feet. The site is level and does not contain any drainages. A six-foot tall chain link fence surrounds the property. Access to the site is via a driveway from Midway. A secondary access to Midway is located on the south side of the site. ANALYSIS: The project site is designated as Industrial by the Land. Use Element Map of the General Plan, which allows commercial uses as secondary uses. The project site is zoned M-1, which requires a Use Permit for commercial uses and conditional uses listed in the C-1 and C-2 zones (Butte County Code Section 24-175.C.7). The C-2 zone allows used car sales by right (Butte County Code Section 24- 145.A.2). The proposed used car sales lot is consistent with the General Plan and with the M-1 zone. The project may result in a very minor increase in vehicle traffic on Midway. No trip generation estimates as available for a used car lot, and an increase in vehicle traffic generated by the project cannot be estimated. Based upon the fact that only six vehicles will be for sale at any one time, the project will not draw many customers, and no significant vehicle circulation impacts are anticipated. There is no left turn lane for vehicles turning left into the site from Midway and this may result in short term traffic delays for south bound traffic on Midway. The Public Works Department did not indicate that the project would have an impact to vehicle circulation. The project site is within the City of Chico's Sphere of Influence. The City does not object to the proposed used car sales lot, but requests that outdoor advertising signs associated with the project meet the City of Chico's sign standards for uses located in manufacturing and industrial zoning districts. The specific sign standard that the City recommends is found in Table 5-8.I of the City of Chico's Zoning Ordinance (Title 19) for single -tenant sites. This standard allows only one ground - mounted sign per parcel and no restrictions on the number of any other types of signs. The ground - mounted sign is limited to no more than 170 square feet, and the total square footage of all signs cannot exceed 350 square feet. Signs are required to be at least three feet from property lines and may be lighted. These sign standards are suggested as a condition of project approval. The County does not have sign standards in the M-1 zone. A copy of the City of Chico's sign ordinance will be given to the applicant. The Butte County Fire Department/CDF requests that an all weather access, at least 10 feet wide and able to accommodate a 40,000 pound fire apparatus, be provided to all structures. These requests are added as conditions of project approval. ACTIONS FOR CONSIDERATION: Staff recommends that the Planning Commission take the following actions: I. Adopt a Mitigated Negative Declaration with the following findings: A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study did not identify any potential significant environmental effects, and that a Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Negative Declaration, together with comments received during the public review process. C. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence that the Oak Ridge Cabinets' Use Permit project will not have a significant effect on the environment. D. Find that the proposed Negative Declaration reflects the independent judgement and analysis of the County, which is the lead agency. E. Adopt the Negative Declaration regarding environmental impacts, with no mitigation measures, and authorize the Chair to sign. II. The design of the proposed project improvements will not cause environmental damage to fish and wildlife or their habitat, and a "de minimus" exemption regarding impact to fish and wildlife or their habitat is recommended. The collection of fees pursuant to Fish and Game Code Section 711.4(d)(3) and 14 CCR 753.5. is not recommended. III. Approve Use Permit 00-13 for Oak Ridge Cabinets, subject to the conditions found in Exhibit A and subject to the following findings: A. The proposed use of the property will not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding property, or detrimental to the health, safety and general welfare of the persons residing or working in the neighborhood, or to the general health, welfare and safety of the County because: .1. The project will only create a very minor amount of vehicle traffic. 2. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. Vehicle servicing includes, but is not limited to, oil changes, tune ups, engine and power train repairs, body work, and painting. 4. All lighting associated with the used car lot shall be directed downward and be contained within the property boundaries. Lighting shall not cause a nuisance on surrounding parcels and/or present a hazard to traffic using Midway. 5. All on-site advertising signs for the used car lot shall meet the City of Chico signage standards. The specific sign standards are found in Table 5-8.I of the City of Chico's Zoning Ordinance (Title 19) for single -tenant sites. The M-1 zone allows for outside storage of all types of materials and equipment. The City of Chico requests that advertising signs be consistent with the City of Chico standards, and the project will be condition to require this. A condition of the project requires that all outside lighting associated with the used care lot be fully shielded and contained on-site to prevent light from causing an impact on adjacent properties. This project will not affect a scenic vista nor will it have a demonstrable negative aesthetic effect. Mitigation: None required. 2. AGRICULTURE RESOURCES: In determining whether impacts to agricultural resources are significant environmental effects, lead agencies may refer to the California Agricultural Land Evaluation and Site Assessment Model (1997) prepared by the California Department of Conservation as an optional model to use in assessing impacts on agriculture and farmland. Where available, the significance criteria established by the applicable air quality management or air pollution control district may be relied upon to make the following determinations. The project may result in a very minor increase in vehicle emissions in the project area due to low number of vehicle trips that the proposed used car lot will generate. No vehicle servicing, which has the potential to generate exhaust emissions during vehicle testing, is proposed. A very minor amount of fugitive dust emissions may be generated by vehicles driving over the gravel surface of the project site, but this is not expected to be significant. The area where the vehicles will be kept has already been cleared and rough graded. A very minor amount of grading will be necessary to prepare the site for the used car lot, which is not expected to generate a significant amount of fugitive dust emissions. BCAQMD recommends that fugitive dust emissions generated during site development activities be controlled through the use of site and driveway watering and/or use of other acceptable soil palliatives. A condition of the project requires that fugitive dust emissions be controlled during site development activities. d. The project will not create any substantial pollutants. Land uses on surrounding parcels is mostly industrial, and includes manufacturing business, fuel storage and distribution business, and the Glen Oaks Memorial Park Cemetery. Residential uses are located to the east of the site, on the east side of the abandoned railroad right-of-way. The project site is located in the City of Chico's Sphere of Influence and is within the Chico Urban Area. The City of Chico does not object to the project but requests that signage be consistent with City of Chico standards. C. The property is not within a habitat conservation plan or natural community conservation plan. No impact will be incurred. 10. MINERAL RESOURCES. Would the project: a) Result in the loss of availability of a known mineral resource that would be of value to the region and the residents of the state? 1t b) Result in the loss of availability of a' locally -important mineral resource recovery site delineated on a local general plan, specific plan or other land use plan? x Response: a. - b. The noise from vehicles arriving and departing the site is not anticipated to create significant noise levels. e. - f. The Institute of Transportation Engineers Trip Generation Handbook (6th Edition) does not contain trip generation estimates for used car lots. The increase in vehicle trips is not expected to be significant because no more than six vehicles will be for sale at any one time. Midway currently has a Level of Service of C (Final Report State Route 99/Southgate Avenue Interchange and Circulation Study, October 28, 1999). There is no left turn lane on Midway for vehicles turning into the project site. Additionally, vehicles turning left into the site must cross the left turn lane for Hegan Lane. The project may result in short-term delays to south bound traffic due to vehicles turning left into the site. However, the lack of a left turn lane is not expected to be significant because it is anticipated that the project will only generate a few vehicle trips per day. Vehicles turning onto Midway from the site can do so safely due to good site vision of Midway in both directions. A request for comments regarding this project was sent to the Public Works Department. The Public Works Department requested additional details with regards to the estimated number of vehicle trips the project may generate. The Public Works Department was informed that trip generation estimates for a used car lot were not ■ Butte County Department of Development Services ■ Planning Division ■ 22 Project: Oak Ridge Cabinets, UP 00-13 available, but was told that the number of vehicles in the used car lot would be restricted to no more than six. The Public Works Departments did not respond with any additional comments. The site access road crosses the Durham Bike Path, which lies between the site and Midway. The bike path has stop signs at the site access road and bicyclists can clearly see cross traffic. No impact is anticipated to bicyclists on the bike path. f. There is adequate area on the parcel to handle the parking needs of the used car lot customers. g. The project will not conflict with accepted policies, plans or programs supporting alternative transportation. Mitigation: None required. 16. UTILITIES AND SERVICE SYSTEMS. LANDSCAPING A detailed landscape and irrigation plan consistent with the project site plan shall be submitted to and approved by the Planning Division prior to the issuance of building permits. A plan of the existing on-site mature trees, located in any area proposed for buildings and vehicular access, shall be provided to and approved by the Planning Division prior to the issuance of building permits and/or prior to grading or vegetation removal. The applicant shall minimize the removal of mature trees, where possible. A mature tree shall be defined as a tree with a trunk measuring 4 inches in diameter, 4 feet from ground level. Mature trees removed shall be replaced by planting replacement trees of equal number and not less than _ gallon size. 3. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris, during the term of this permit. • 0 4. All graded slopes, over 5 feet in height, or on slopes greater than _%, shall be seeded, planted, mulched or hydroseeded or otherwise protected to prevent erosion. A permanent irrigation system shall be installed for non-native vegetation. A one year Faithful Performance bond shall be posted to guarantee installation and established growth. 5. In parking lots of commercial and industrial development, trees of not less than 15 gallon size shall be provided to reduce heat gain from the paved surface and to soften the visual impact of the paved area. Such trees shall be planted at a minimum density of one tree every three parking spaces. Tree species shall be approved by the Planning Division prior to planting. 6. Prior to the commencement of grading and/or construction activity, all individual or groups of oak trees which are to be retained as part of the project, shall be fully protected through the use of root protection zones (RPZ). During construction, RPZs shall be established using protective fencing enclosing an area with a radius 1.5 times the distance from the trunk to the dripline. Within this protective buffer, no grading, trenching, fill, or vegetation alteration of any kind shall be allowed. The RPZs shall be maintained after the completion of construction in order to continue to protect the oak trees, but the fencing shall be removed. L. GRADING 1. During construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her fmdings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. Archaeological artifacts are defined as follows: 2. Prior to any clearing, grading and/or construction in a Federal or State identified 100 year floodplain and/or streambed the following entitlements must be obtained: a California Fish and Game 1604 Streambed Alteration permit and an Army Corps 404 permit or exemption certificate. M. ADDITIONAL APPROVALS Prior to the issuance of building permits payment of the North Oroville/Thermalito Traffic Impact Fees shall be made. Prior to the issuance of a building permit for each new or additional living unit the applicant shall execute the Oroville Area Traffic Mitigation Fee Agreement and pay the established fee. _1 Prior to the issuance of the Use Permit, to insure the maintenance and continuance of the orchard or other agricultural use of the property, the property owner shall enter into the County approved Orchard Management Agreement. The agreement shall terminate in 10 years or upon a rezoning of the parcel/lot to a zone other than A-5 through A-160. The agreement shall be recorded and recording fees paid by the applicant. Approval of this request shall not waive compliance with all sections of the Zoning Ordinance and all other applicable State and County laws and regulations in effect at the time of building permit application. 5. This Conditional Use Permit is granted for a period of month(s) at the end of which time it shall expire (unless the approving authority has held a hearing thereon and granted an extension. In connection with such an extension the approving authority may add, change, or delete conditions. 6. Approval of this Conditional Use Permit shall become null and void if the use for which it has been granted is not established within two calendar year from the date of approval. No formal cancellation or revocation action by the County will be necessary. 7. The applicant states that he will normally have two vehicles for sale, but would like to be able to have up to six vehicles for sale at any one time. No vehicle servicing is proposed. The hours of operation will be in conjunction with the cabinet manufacturing business on the site (Monday through Friday, 8:00 a.m. to 5:00 p.m.). The person selling the vehicles is the co-owner of the cabinet manufacturing business on the site. No structures will be built as a result of this project. ■ BUTTE COUNTY PLANNING COMMISSION AGENDA REPORT ■ PAGE 1 ■ The project site is zoned M-1 (Light Industrial) and has a General Plan Land Use designation of Industrial. Surrounding parcels range in size from .7 to 19 acres. Land use on nearby parcels is mainly industrial, with a cemetery located across Midway from the site. No other new or used car lots are located near the site, but there are several small used car lots located on Fair Street and East Park Avenue, which are located approximately .5 miles to the north of the site in the City of Chico. Residential uses are located to the east of the project site, across the abandoned railroad right-of-way. The Durham Bike Path lies between the site and Midway. The project site is located with the City of Chico's Sphere of Influence and is within the Chico Urban Area. S r The project parcel is 2.47 acres in size and is developed with a cabinet manufacturing busine srh'ch operates out of two structures totaling 10,632 square feet. The site is level and does not co any drainages. A six-foot tall chain link fence surrounds the property. Access to the site is via a driveway from Midway. A secondary access to Midway is located on the south side of the site. ANALYSIS: L t� The project site is designated as Industrial by the Land Use Element Map of the General Plan, which allows commercial uses as secondary uses. The project site is zoned M-1, which requires a Use Permit for commercial uses and conditional uses listed in the C-1 and C-2 zones (Butte County Code Section 24-175.C.7). The C-2 zone allows used car sales by right (Butte County Code Section 24- 145.A.2). The proposed used car sales lot is consistent with the General Plan and with the M-1 zone. No trip generation estimates as available for a used car lotsft increase in vehicle traffic generated by the project cannot be estimated. Based upon the fact that only six vehicles will be for sale at any one time, the project will not draw many customers, and no significant vehicle circulation impacts are anticipated. There is no left turn lane for vehicles turning left into the site from Midway and this may result in short term traffic delays for south bound traffic on Midway. The Butte County Fire Department/CDF requests that an all weather access, at least 10 feet wide and able to accommodate a 40,000 pound fire apparatus, be provided to all structures. The Butte County Air Quality Management District requests that measures be taken during project development activities to control fugitive dust emissions. Adopt a Mitigated Negative Declaration with the following findings: A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study did not identify any potential significant environmental effects, and that a Negative Declaration is proposed. B. Find that the Planning Commission has considered the proposed Negative Declaration, together with comments received during the public review process. C. Find, on the basis of the whole record before the Planning Commission, including the Initial Study and any comments received, that there is no substantial evidence that the Oak Ridge Cabinets' Use Permit project will not have a significant effect on the environment. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. The purpose of this chapter is to provide minimum standards to safeguard life, health, property, and public welfare, and to preserve the character of the City by regulating the size, height, design, quality of materials, construction, location, lighting, and maintenance of all signs and sign structures not enclosed within a building, to accomplish the following: A. To protect and enhance the character of residential neighborhoods and business areas, open views and vistas, and property values by prohibiting obtrusive and incompatible signs; B. To provide a reasonable and comprehensive system of sign controls; C. To encourage signs which are well-designed, balanced, and pleasing in appearance, and to provide incentive and latitude for variety, good design relationship, spacing, and location; D. To encourage a desirable urban character with a minimum of clutter, while recognizing the need for signs as a major form of communication; E. To provide for fair and equal treatment of sign users; F. To provide for a reasonable period of time for the elimination of nonconforming signs; and G. To promote public safety by providing that official traffic regulation devices be easily visible and free from any nearby visual obstructions, including blinking signs, excessive number of signs, or signs that in any way resemble official signs. 19.74.020 Applicability. A. The sign standards provided in this chapter are intended to apply to signs in every zoning district in the City. Only signs authorized by this chapter shall be allowed in that zoning district unless otherwise expressly provided in this chapter. B. If a new zoning district is created after the enactment of this chapter, the Director shall have the authority to make determinations as to the applicability of appropriate sign regulations in compliance with Chapter 19.02 (Interpretation of Regulations) until this chapter is amended to govern the new zoning district. Signs shall be considered during the City's site design and architectural review process (Chapter 19.18) to ensure that all signs are well-designed, compatible with their surroundings, and do not detract from the overall visual quality of the City. 19.74.030 Definitions. The following are definitions of specialized terms and phrases used in this chapter. The definitions are organized in alphabetical order. Abandoned Sign. Any sign that no longer advertises a business, lessee, owner, product, service, or activity on the premises where the sign is displayed. Alteration. Any change of copy, sign face, color, size, shape, illumination, position, location, construction, or supporting structure of any sign. Animated or Moving Sign. Any sign which uses movement, lighting, or special materials to depict action or create a special effect to imitate movement. Area of a Sign. See "Sign Area." Awning Sign. Any sign copy or logo attached to or painted on an awning. Banner, Flag, or Pennant. Any cloth, bunting, plastic, paper, or similar non -rigid material used for advertising purposes attached to any structure, staff, pole, line, framing, or vehicle, not including official flags of the United States, the State of California, and other states of the nation,' counties, municipalities, official flags of foreign nations and nationally or internationally recognized organizations. Bench Sign. Copy painted on any portion of a bench. Building/Structure Frontage. That building elevation which fronts on a public street, public parking lot, private parking lot available to the general public, or pedestrian walk where customer access to a structure is available. Business Frontage. That portion of a building frontage occupied by a single business tenant having a public entrance within the building frontage. Business Identification Sign. A sign which serves to identify only the name, address, and use of the premises upon which it is located and provides no other advertisements or product identification. Cabinet Sign (Can Sign). A sign which contains all the text and/or logo symbols within a single enclosed cabinet and may or may not be internally illuminated. Changeable Copy Sign. A sign designed to allow the changing of copy through manual, mechanical, or electrical means, including time and temperature. SATitle 19 Update\division5b (9/15/99) Page V-58 Channel Letters. Three-dimensional, individually cut letters or figures, illuminated or unilluminated, affixed to a structure. ��. Civic Event Sign. A temporary sign, other than a commercial sign, posted to advertise a civic event sponsored by a public agency, school, church, civic -fraternal organization, or similar noncommercial organization. Contractor or Construction Sign. A sign which states the name of the developer and contractors working on a site and any related engineering, architectural, or financial firms involved with the project. Directional Sign. An on-site sign which is designed and erected solely for the purposes of directing vehicular and/or pedestrian traffic within a project. Directory Sign. A sign for listing the tenants and their suite numbers of a multiple tenant structure or center. Double -Faced Sign. A sign constructed to display its message on the outer surfaces of two identical and/or opposite parallel planes. ; Edge of Roof. On a pitched roof, the lowest portion of the fascia board covering the roof rafters or, if no fascia board exists, the lowest point of the roof rafters. On a flat roof, the top of the parapet wall. Electronic Reader Board Sign. A sign with a fixed or changing display composed of a series of lights, but not including time and temperature displays. Flashing Sign. A sign that contains an intermittent or sequential flashing light source. Future Tenant Identification Sign. A temporary sign that identifies the names of future businesses that will occupy a site or structure. Garage Sale Sign. A sign with a message advertising the resale of personal property that has been used by the resident. Grand Opening. A promotional activity not exceeding 30 calendar days used by newly established businesses, within two months after initial occupancy, to inform the public of their location and services available to the community. "Grand opening" does not mean an annual or occasional promotion of retail sales by a business. Ground -Mounted Sign. A sign fixed in an upright position on the ground, not attached to any.structure other than a framework, pole, or device erected primarily to support the sign. Includes monument signs and pole signs. Height of Sign. The vertical distance from the uppermost point used in measuring the area of a sign to the average grade immediately below the sign, including its base or the top of the nearest curb of the street on which the sign fronts, whichever measurement is the greatest. Temporary seasonal signs, in the nature of decorations, clearly incidental to and customarily associated with nationally recognized holidays and which contain no advertising message. Illegal Sign. Any sign which does not comply with these regulations. Indirectly Illuminated Sign. A sign whose light source is external to the sign and which casts its light onto the sign from some distance. Internally Illuminated Sign. A sign whose light source is located in the interior of the sign so the rays go through the face of the sign, or a light source which is attached to the face of the sign and is perceived as a design element of the sign. Marquee (Canopy) Sign. Any sign which is attached to or otherwise made a part of a permanent roof -like structure which projects beyond the building wall in the form of a large canopy to provide protection from the weather. Monument Sign. An independent, freestanding structure supported on the ground, having a solid base as opposed to being supported by poles or open braces. Multiple Tenant Site/Center. A commercial or industrial development consisting of two or more separate businesses that share either the same parcel or structure and use common access and parking facilities. Nonconforming Sign. Any advertising structure or sign which was lawfully erected and maintained prior to the adoption of these Regulations, and is subject to these Regulations but does not completely comply. Off -Site Directional Sign. Off -premise directional signs are intended to provide identification for access to property that does not abut a public or private street and relies on an easement over adjacent property for access. Off -Site Sign. Any sign identifying a use, facility, service, or product which is not located, sold, or manufactured on the same premise as the sign. Permanent Sign. A sign constructed of durable materials and intended to exist for the duration of time that the use or occupant is located on the premises. Political Sign. A sign designed for the purpose of advertising support of or opposition to a candidate or proposition for a public election. Portable Sign. Any sign that is designed to be transported, including but not limited to signs with wheels removed; with chassis or support constructed without wheels; designed to be transported by trailer or wheels; converted to an A- or T -frame signs; attached temporarily or permanently to the ground, structure, or other signs; and menu and sandwich boards. SATitle 19 Update\division5b (9/15/99) Page V-60 Projecting Sign. A sign other than a wall sign suspended from, or supported by, a structure and projecting outward. Promotional Sign. A sign erected on a temporary basis to promote the sale of new products, new management, new hours of operation, a new service, or to promote a special sale. Property Frontage. The front or frontage is that side of a parcel or development site abutting a public or private street. Reader Board. A sign designed to allow the changing of copy through manual, mechanical, or electrical means including time and temperature. Real Estate Sign. A sign indicating that a property or any portion thereof is available for inspection, sale, lease, rent, or directing people td a property, but not including temporary subdivision signs. Roof Sign. A sign constructed upon or over a roof, or placed so as to extend above the edge of the:roof. Sign. All signs as defined in the Uniform Sign Code, not including retail merchandise displays, murals, paintings, and other works of art that are not intended to advertise or identify any business or product. Sign Area. The entire area within a perimeter defined by a continuous line composed of right angles using no more than eight lines which enclose the extreme limits of lettering, logo, trademark, or other graphic representation. Special Event Sign/Banner. A temporary sign or banner that is intended to inform the public of a unique happening, action, purpose, or occasion (i.e., grand opening or community event). Temporary Sign. Any sign fabricated of paper, plywood, fabric, window whitewash, or other light, impermanent material and intended to be displayed unchanged for a temporary period of time. Translucent. Surface that allows light to shine through, but is diffused to the extent that distinct images cannot be perceived. Vehicle Sign. A sign which is attached to or painted on a vehicle which is parked on or adjacent to any property, the principal purpose of which is to attract attention to a product sold or business located on the property. Wall Sign. A sign which is attached to or painted on the exterior wall of a structure with the display surface of the sign approximately parallel to the building wall. Any interior sign which faces any window exposed to public view and is located within 3 feet of the window. A. Review Required. To ensure compliance with the regulations of this chapter, sign review and approval by the Planning Division shall be required to erect, move, alter, or reconstruct any sign except for signs that are exempt from permits in compliance with Section 19.74.050. Sign approvals are subject to the administrative review provisions of Chapter 19.18 (Site Design and Architectural Review). In most instances, a building permit will be required to erect a sign. In these instances, the permit will be issued by the Building Division after review and approval by the Director. B. Approval of Sign. A sign application shall be approved by the Director, provided that the proposed sign is consistent with the provisions of this chapter. SATitle 19 Update\division5b (9/15/99) Page V-62 Review of the sign shall include consideration of size, color, material, illumination, location, and other elements of design in compliance with this chapter, including applicable sign design guidelines and any conditions of approval adopted by the Architectural Review Board, Commission, or City Council as part of any approval process. 19.74.050 Exemptions from sign approval. Sign permits shall not be required for the signs listed in this section. Exempt signs shall not be included in the determination of the total allowable number of signs or total allowable sign area for a site; however, such signs may require compliance with building permit regulations., A. Permanent Signs With No Size Limitation. 1. Signs located within shopping malls or similar areas, where the signs are not visible from any point on the boundary of the premises, shall not be regulated as to size or location or similar provisions contained in this chapter; however, such signs require compliance with building permit requirements; 2. Official and legal notices required by a court or governmental agency; 3. Any sign erected and maintained in compliance with and in discharge of any governmental function or required by any law, ordinance, or governmental regulation, including signs erected by a public utility; 4. Signs on licensed commercial vehicles, including trailers; provided, however, such vehicles and/or trailers shall not be used as parked or stationary outdoor S:\Title 19 Update\division5b (9/15/99) Page V-63 display signs; 5. Bench and other signs located at designated public transit locations; and l 6. Change of copy within an approved comprehensive sign program that conform to the provisions of the Comprehensive Sign Program (Section 19.74.060). B. Permanent Signs Limited by Maximum Areas. The following signs are exempt from the requirements of sign permits, subject to the following limitations: 1. Occupant name, street number, and street name signs not exceeding 2 square feet in area per single-family or multi -family unit; 2. Signs for commercial, office and industrial uses not exceeding 2 square feet and limited to business identification, hours of operation, address, and emergency information; - 3. Vehicle and pedestrian -oriented safety and directional signs solely for the purpose of guiding traffic, parking, and loading on private property, and not bearing advertising materials. Maximum sign area shall be 4 square feet in residential and office residential zoning districts and'6 square feet in other zoning districts. Maximum height for freestanding signs shall be 4 feet. Taller signs may be approved by the Director, if visibility will not be impaired; 4. Affiliation signs for auto -related uses, motels, and hotels that show notices of service provided or required by law, trade affiliations, credit cards accepted, and the like, provided the signs are attached to an otherwise approved freestanding sign or structure. Signs or notices shall not exceed 1/2 square foot in area per sign, and no more than six signs are allowed per business; 5. Gasoline pump signs identifying the brand, types, and octane rating, provided the signs do not exceed 2 square feet per pump face; S:\Title 19 Update\division5b (9/15/99) Page V-63 6. Names of structures, commemorative plaques, tables, dates of construction, and the like when carved in stone, concrete, or similar materials or made of bronze, aluminum, or other similar permanent material and mounted permanently on a structure. These signs shall not exceed 4 square feet in area and 6 feet in height; 7. Official flags of any nation, the State of California, and other states, municipalities, and fraternal or religious organizations, provided that the pole height shall not exceed 25 feet and the length of the flag shall be not more than 1/4 of the height of the pole; and 8. The display of air-filled, rubber latex balloons with an inflated diameter of 12 inches or less by a balloon, florist, or other retail establishment regularly offering balloons for sale to the general public. Such balloons shall contain no commercial message and be securely attached to the structure, iricluding an awning if any, from which sales are offered. C. Temporary Signs Limited by Size and Period of Display. 1. Temporary Advertising/Promotional Signs. Temporary advertising or promotional signs painted on a window or constructed of paper, cloth, or similar disposable materials and affixed on a window, wall, building surface, or structure subject to the following limitations: a. Signs may be displayed for a maximum of 30 days within a 90 -day period to promote a particular event, sale, or product; b. The total area of all temporary signs and banners shall not exceed 25 square feet per business; C. The area of temporary signs attached to or painted on windows shall not exceed 33 percent of the window area, except in the CD zoning district where signs shall not exceed 10 percent of the window area; d. Signs shall not be attached to the exterior of windows or doors except painted -on signs; and e. Signs shall not be located above the edge of the roof or above the sill of the second -story windows on a multi -story structure. 2. Temporary Business Identification Signs. A maximum of two temporary signs for the identification of a new business until permanent signs can be erected are allowed for a period not to exceed 90 days. Maximum sign area is limited to 50 square feet. 3. Real Estate Signs. Real estate signs offering property for sale, lease, or rent are allowed on private property in any zoning district subject to the owner's permission and the following limitations: a. For single-family dwellings, one sign per street frontage not to exceed 4 square feet in area and 7 feet in height. In addition, "open house" signs are allowed when a sales agent or owner is present at the site; b. For multi -family dwellings, one sign per street frontage not to exceed 24 square feet in area and 8 feet in height; C. Individual commercial, office, and industrial properties not located in a commercial center or industrial/business park, one sign per street frontage not to exceed 16 square feet in area and 8 feet in height; and d. Individual tenant spaces within multi -tenant commercial centers, office structures, and industrial subdivisions offered for sale, rent, or lease, one sign per street frontage not to exceed 16 square feet in area and 8 feet in SATitle 19 Update\division5b (9/15/99) Page V-64 height. In addition, one sign for each tenant space available not to exceed 6 square feet in area to be located at the individual tenant space for rent or lease. 4. Future Tenant Signs. Future tenant identification signs which advertise the future use of a property subject to compliance with the following limitations: a. One sign per street frontage except where a project has in excess of 600 lineal feet of street frontage, one additional sign may be allowed; b. Signs shall be limited to a maximum of 30 square feet in area and 10 feet in height, or a maximum of 50 square feet in area if combined with a construction sign; and C. Signs shall be removed upon occupancy of the site. 5. Subdivision Signs. The placement of on-site subdivision identification or directional signs shall comply with the following standards: a. Signs may contain only the name of the subdivision, name of the developer and/or agent, ari identification emblem, sales price, and directional message; b. A maximum of two on-site signs may be located within the project; C. The total area of each sign shall not exceed 32 square feet; d. The height of each sign shall,not exceed 10 feet; e. Signs shall not be illuminated; and f: Signs may be displayed during the two years following date of recordation the final map, or until 100 percent of the units have been sold, whichever occurs first. 6. Construction Signs. Construction signs providing the names of the architects, engineers, and contractors working on the site, subject to compliance with the following limitations: a. One sign per street frontage not to exceed 20 square feet in area with a maximum height of 10 feet. Maximum size of 50 square feet in area if combined with a future tenant sign; and b. Signs shall be removed upon occupancy of the site. 7. Political Signs. Political signs may not be placed on any public property, within any public right-of-way, or within any sight distance area. Such signs are authorized 90 days before elections and shall be removed within 7 days after an election. Political signs on residentially zoned property are limited to no more than four signs not exceeding 4 square feet of surface area per sign. 8. Temporary Business Notification Signs During Road Construction. Signs allowed on private property informing the public that a business is in operation despite significant road construction, subject to the following limitations: a. ' Signs shall be subject to approval by the Director. • b. Signs shall not exceed 32 square feet in size and shall be allowed only in areas of significant road construction as determined by the Director of Public Works. Y •. 19.74.060 Comprehensive sign program. A. Purpose. The purpose of a comprehensive sign program (CSP) is to integrate a project's signs with the structure's design into a unified architectural statement. Additionally, the i CSP is intended to provide a means for flexible application of the sign regulations for SATitle 19 Update\division5b (9/15/99) Page V-65 multi -tenant projects in order to encourage maximum incentive and latitude in the design and display of signs and to achieve, not circumvent, the intent of this chapter. B. Applicability. Notwithstanding any other provisions of this chapter, a comprehensive sign program may be approved by the Director for a multi -tenant commercial/office project as a unit which may deviate from the development standards for signs for the zoning district in which the project is located, except that the total maximum sign area allowed by this chapter shall not otherwise be exceeded. Standards for signs provided in this chapter shall serve as a reference along with any design guidelines adopted by the City. C. Application Requirements. The following information is required for submittal of a use permit application for a comprehensive sign program: 1. Plans, to scale, to include the following: a. Sign details indicating sign area, dimensions, colors, materials, letter style, proposed copy, letter height, and method of illumination for all signs; b. Site plan indicating the location of all existing and proposed signs with sign area dimensions; C. Building elevations with sign location depicted and dimensioned; and d. A summary table showing the complete sign program and total square foot area of all signs. 2. A statement explaining how revisions, modifications, or replacement of tenant signs will be carried out to limit the possibility of holes being left in the structure's exterior by mounting brackets, electrical connections, or similar items; and 3. Any supplemental information required by the Director. D. Lessees to be Made Aware of the Comprehensive Sign Program. Lessees within developments governed by an approved comprehensive sign program shall be made aware of the program in their lease and their responsibility to follow the approved comprehensive sign program. E. Findings. In approving an application for a use permit authorizing a comprehensive sign program, the following standards shall apply: 1. The comprehensive sign program is consistent with the purpose and intent of this chapter; 2. The signs are visually related to other signs included in the comprehensive sign program and to the structure and/or developments they identify and to surrounding development; 3. The comprehensive sign program accommodates future revisions which may be required due to changes in use or tenants; and 4. The comprehensive sign program complies with all of the standards of this chapter, including the maximum overall sign area allowable, except that flexibility is allowed with regard to individual sign area, number, location, and/or height to the extent that the comprehensive sign program will enhance the overall development and will more fully accomplish the purposes of this chapter. F. Revisions to Comprehensive Sign Programs. Revisions to a comprehensive sign program may be approved by the Director if it is determined that the revision is minor and that the intent of the original approval, and any conditions attached thereto, are not affected. For revisions that would substantially deviate from the original approval, an application to modify the use permit shall be required. SATitle 19 Update\division5b (9/15/99) Page V-66 19.74.070 Prohibited signs. The following signs are inconsistent with the purposes and standards of this chapter and are, therefore, prohibited in all zoning districts: A. Any sign not in compliance with the provisions of this chapter; B. Abandoned and/or dilapidated signs and sign structures; C. Animated, moving, flashing, blinking, reflecting, revolving, or any other similar signs, except time/temperature devices and barber poles; D. Banners, streamers, and pennants, except as specifically allowed by the provisions of' Section 19.74.050 (Exemptions from sign permits); E. Bench signs, except at approved bus passenger loading areas; " F. Changeable copy signs, including reader boards, except as approved fora religious facility, movie theater, or gasoline pricing sign; G. Electronic reader board signs, except time/temperature devices; H. Inflated signs, balloons, and figures, except as provided in Section 19.74.050; I. Obscene signs; J. Off-site signs not specifically allowed by the provisions of this chapter, including billboards and outdoor advertising; K: Painted signs on fences or roofs; L. Political signs pursuant to Section 19.74.050-C-8; M. Roof signs extending above the edge of the roof of a structure; N. Signs erected in a manner that any portion of their surface or supports will interfere in any way with the free use of any fire escape, exit, or standpipe or obstruct any required ventilator, door, stairway, or window above the first story; O. Signs emitting audible sounds, odors, or visible matter; and P. Vehicle signs attached to or'painted on motor vehicles that are parked on or adjacent to property for more than 48 consecutive hours, the principal purpose of which is to attract attention to a product sold or business located on the property. 19.74.080 Nonconforming signs. A nonconforming sign is any permanent or temporary sign which was legally established and maintained in compliance with the provisions of all applicable laws in effect at the time of original installation but which does not now comply with the provisions of these Regulations. Nonconforming signs shall comply with Chapter 19.08 (Nonconforming Structures, Uses, and Parcels) and Section 19.74.090 (Abandoned signs). A. Annexed areas. Except as otherwise provided in this section, all signs in areas annexed to the City after the date of adoption of this chapter which do not conform to the provisions of this chapter shall be regarded as nonconforming signs which may remain under the provisions of Chapter 19.08 (Nonconforming Structures, Uses and Parcels) and Section 19.74.090 (Abandoned signs). B. Exception: If a sign has historical significance apart from its main purpose of advertising, the sign may be granted a use permit for continued use in compliance with Chapter 19.24 (Use Permits). C. Maintenance and Repair. Nonconforming signs and sign structures may be maintained and repaired in compliance with Section 19.08.030 (Restrictions on nonconforming structures and uses). A sign, including the structural support, shall be removed by the owner or lessee of the premises upon which the sign is located when the business which it advertises is no longer conducted on the premises. If the owner or lessee fails to remove the sign, the Building Official shall give the owner 30 days' written notice to remove it. 19.74.100 General provisions for all signs. A. Maintenance of Signs. All signs and supporting hardware, including temporary signs, shall be maintained in good repair and function properly at all times. Signs which are not properly maintained and are dilapidated shall be deemed to be a public nuisance. When existing signs are removed or replaced, all brackets, poles, and other supports that are no longer required shall be removed: Any unpainted meas shall be painted to match the adjacent portion of the building or sign support structure. B. Measurement of Sign Area. 1. The surface area of a sign shall be calculated by enclosing the extreme limits of any writing, logo, representation, emblem, or other display within a single continuous perimeter composed of squares or rectangles with no more than eight lines. 2. Supporting framework or bracing that is clearly incidental to the display itself shall not be computed as sign area. 3. If the sign consists of more than one section or module, all of the area, including the area between the sections or modules, shall be included in the computation of sign area. 4. Double-faced (back-to-back) freestanding signs shall be regarded as a single sign only if the distance between each sign face does not exceed 2 feet. However, each sign face shall be considered a separate sign for the purpose of calculating sign area. 5. Where a sign consists of one or more three-dimensional objects (i.e., balls, cubes, clusters of objects, sculptures, or statue -like trademarks), the sign area shall be measured as their maximum projection upon a vertical plane. 6. For signs that incorporate time and temperature devices, the area of these devices shall not be included in the total area of the sign. Illumination of Signs. The artificial illumination of signs, either from an internal or external source, shall be designed to eliminate any negative impacts on surrounding rights-of-way and properties. The following standards apply to all illuminated signs: 1. External light sources shall be directed and shielded to limit direct illumination of any object other than the sign; 2. The light from any illuminated sign shall not be of an intensity or brightness which will interfere with the reasonable enjoyment of residential properties in direct visual proximity to the sign; 3. No sign shall have blinking, flashing, or fluttering lights or any other illuminating device which has a changing light intensity, brightness, or color; 4. No colored lights shall be used at any location or in any manner so as to be confused or construed as traffic control devices; 5. Neither the direct nor reflected light from primary light sources shall create a hazard to operators of motor vehicles; 6. No reflective -type bulb or incandescent lamp which exceeds 15 watts shall be used on the exterior surface of any sign so as to expose the face of the bulb or lamp to any public rights-of-way or adjacent property; and 7. Light sources shall utilize energy-efficient fixtures to the greatest extent possible. SATitle 19 Update\division5b (9/15/99) Page V-69 D, Sign Copy. The sign copy (text) of permanent signs shall relate only to the name and/or nature of the use. Permanent signs that advertise continuous sales, special prices, slogans, etc. shall not be allowed. 19.74.110 Standards for specific types of signs. A. Temporary Special Event Signs. A special event sign or banner is intended to inform the public of a unique happening, action, purpose, or occasion, such as a grand opening or community event. Special promotional signage consisting of balloons, buntings, portable or mobile signs, banners, flags, posters, pennants, ribbons, streamers, and similar articles, are subject to the following conditions: 1. Such signage shall only be permitted on commercial properties; 2. Such signage shall only be used in conjunction with a special promotional event such as a grand opening; 3. Such signage shall only be permitted for a maximum of four events in any calendar year with such signage permitted for no more than 10 consecutive days per event. Provided, however, that each event shall be separated by a minimum of 30 days and that such signage may be permitted for no more than a total of 20 days in any calendar year; 4. Such signage shall be installed totally on the property at which the event is being conducted; 5. Such signage shall not be installed so as to occupy any part of the clear sight distance area or otherwise create a safety hazard; 6. Balloons and other inflatable devices authorized by this section shall not exceed 3 feet in diameter; 7. No part of the promotional signage shall exceed the maximum height of buildings on the site; and 8. 'Prior to use of such signage, a permit shall be obtained from the Planning Office. Up to four promotional events may be included in a single permit. B. Awning signs. Awning signs may be placed on the face of an awning in a flat position, in a plane approximately parallel to the plane of the building wall to which the awning is attached. Awning signs may project over the public right-of-way to the same extent that the awning projects over the public right-of-way. 1. Signs on awnings shall only be located on building frontages, including those fronting a parking lot or pedestrian way. 2. Signs on awnings are limited to ground -level occupancies only. 3. All internal illumination for awnings shall only be directed downward. C. Freestanding Signs. 1. Signs are allowed only for frontages adjoining a public or private street. 2. There shall be a minimum of 75 feet between any two freestanding signs on adjoining sites to ensure adequate visibility for all signs. The Director may waive this requirement in situations where its enactment would be impractical due to the locations of existing signs on adjacent properties. 3. Signs shall not project over public property, vehicular easements, or rights-of-way. Signs shall not obstruct traffic safety sight areas. 4. Landscaping shall be provided at the base of the supporting structure equal to twice the area of one face of the sign; for example, 30 square feet of sign area = 60 square feet. of landscaped area. Freeway -oriented commercial services located in CC Community Commercial, CS Service Commercial, ML Light Manufacturing/Industrial, and MG General Manufacturing/Industrial zoning districts shall be permitted a _ pole -mounted identification sign of a height not to exceed the greater of 40 feet or the maximum height of a free-standing sign otherwise allowed in the zoning district, plus the centerline elevation of the adjacent freeway at its nearest point to the sign location, with an area not to exceed 100 square feet of surface area for one face, or 200 square feet for two or more faces. This sign shall be allowed in addition to any other signs allowed for such site or use, provided that: 1. The business provides a service primarily for the freeway -motoring public, including or similar to businesses providing gas, food, or lodging for the traveler; 2. The parcel of land on which the business is located is a maximum distance of 800 feet from the centerline of State Highway Route 99 freeway at its closest point; 3. Additional sign height is necessary to allow motorists sufficient advance notice for safe freeway exit. Unobstructed vision from a distance of 1,320 feet from a freeway exit ramp shall be considered the standard for providing sufficient advance notice; and 4. The sign is for visibility from the freeway. E. Marquee Signs. 1'. Signs shall be mounted only on the front and sides of a marquee, or suspended below. 2. Signs shall not project more than 6 inches from the face of the marquee. 3. Signs shall not extend above the top of the marquee. 4. A clear, distance of 8 feet shall be maintained from the lowest part of a suspended sign to the ground below. F. Off -Site Directional Signs. Off -premise directional signs are intended to provide identification for access to property that does not abut a public or private street and relies on an easement over adjacent property for access. In these cases, one off -premise directional sign may be allowed subject to the approval of a sign permit and the following limitations: 1. Signs shall not exceed 4 square feet per face and not more than two sign faces where the access serves a single parcel or occupant; 2. Signs shall not exceed 6 square feet per face and not more than two sign faces where the access serves two or more parcels or occupants; 3. Signs shall not exceed 3 feet in height; 4. Signs shall be placed within the limits of the access easement serving the property and only if authorized by the easement or underlying property owners; 5. Any illumination of off -premises directional signs shall be indirect; 6. Signs shall contain only the property address, project name (if any) or name of occupants, and directional symbols; and 7. Signs shall be located so as to not interfere with clear sight distances required for safe access. G. Off -Premise Business Directory Signs. Off -premise business directory signs are intended to be a convenience for the traveling public by providing a directory of available services. For this purpose, informational billboards containing small individual off -premise signs shall be allowed at entrances to the City subject to the approval of a use permit in S:\Title 19 Update\division5b (9/15/99) Page V-71 compliance with Chapter 19.24. The size, location, design and maintenance provisions for the signs shall be determined through the use permit process. H. Projecting Signs. 1. Signs shall only be located on building frontages with customer access. 2. Signs shall be double-faced. 3. Consideration shall be given to existing signs on adjoining businesses so that visibility is not blocked. 4. No sign shall project abode the edge of the roof of a structure, or a sill of a second -story window. 5. All signs shall have a minimum vertical clearance of 8 feet from the ground to the bottom of the sign or sign structure. 6. No sign shall project within 2 feet of a curb line. 7. The maximum thickness of a projecting sign shall not exceed that required for construction purposes. 8. Signs may be illuminated by indirect light sources only which shall be shielded to limit the spread of light only to the sign surface. I. Theater Signs. 1. Theater Identification Signs. Theaters may be provided with identification signs of the same type, design, height, and size as the identification signs authorized by this chapter for the particular zoning district in which the theater is located except that: a. The total surface area of theater identification signs shall not exceed 2 square feet for each lineal foot of building frontage or a total of 200 square feet, whichever is less; b. No part of a theater identification sign shall be used as a readerboard; and C. Where a theater identification sign is located on an architectural structure which is incorporated into a theater building and which extends more than 3 feet above the building's roof line or parapet wall, the sign and the structure on which it is located shall comply with the following additional criteria: (1) The sign and the architectural structure on which it is located shall be integral parts of the architectural style or design of the theater building; and (2) Not more than 25 percent of the architectural structure shall be devoted to the sign. 2. Theater Marquee Signs. Theaters may be provided with marquee or wall signs used for the purpose of displaying the titles of current or forthcoming movies or performances. The area of theater marquee or wall signs shall not exceed 40 square feet for each movie screen and shall be in addition to any other signage allowed by this section. 3. Theater Poster Cases. Theaters may be provided with glass -enclosed cases used for the purpose of displaying posters which advertise current or forthcoming movies. One poster case, not exceeding 19 square feet in size, may be provided for each movie screen. Additional poster cases, each not exceeding 19 square feet in size, shall also be allowed, provided that the area of all additional poster cases and the area of any identification signs does not exceed a total of 2 square feet for SATitle 19 Update\division5b (9/15/99) Page V-72 each lineal foot of building frontage or a total of 200 square feet, whichever is less. J. Wall Signs. I . Signs shall be located only on building frontages unless specifically approved by the Director. 2. Signs shall not project from the surface upon which they are attached more than required for construction purposes and in no case more than 12 inches. 3. Signs shall not project above the edge of the roof of a structure. K. Window Signs, 1. Signs shall be allowed only on windows located on the ground level and second story of a building frontage. 2. Signs shall be permanently painted or mounted on the inside of windows and doors. 3. Signs shall not occupy more than 25 percent of the window area of any one window including permanent and temporary signs. In the CD zoning district, signs may not occupy more than 10 percent of the area of any one window. 19.74.115 Portable signs. A. Portable freestanding signs are permitted in all commercial and industrial zoning districts, except CD Downtown Commercial, under the following conditions: 1. One portable sign per parcel frontage is allowed. Portable signs may be placed offsite on an adjacent parcel or within 300 feet of the business being advertised, with the consent of the property owner; however, no more than one sign per parcel frontage is allowed at any one time. 2. Portable signs shall not be placed in the public right-of-way, attached or secured J to private property, or placed in landscape planters, over any utility box, or within 36 inches of a fire hydrant: 3. Portable signs shall be constructed of wood (or other sturdy material) and metal hardware, with all surfaces painted. Portable signs shall have no electric, mechanical, or fixed attachments, including objects that move with the wind. 4. A portable sign may be displayed only during the hours that the business is open to the public, and shall be removed from public view at all other times. 5. The maximum height of a.portable sign shall be 4 feet. The total sign face area shall not exceed 16 square feet. Two-sided signs shall not exceed 32 square feet in size. A portable sign which meets the standards of this section shall not be calculated in the total allowable sign area for the business. 6. All portable signs shall be properly maintained pursuant to Section 19.74.100. B. This section of Chapter 19.74, Signs, shall expire one year from the effective date of these Regulations.
