If applicant is not the owner, written authorization by the owner or other proof of agency must be submitted in order for the applicant to legally sign the application. Section 24-304, as amended, of the Butte County Code provides that your permit shall be for a term of one year for Niel & Rosa Nielsen, and must be renewed annually if the use is to continue. Effective July 12, 1993, the Butte County Board of Supervisors adopted an annual renewal fee of $50.00 for temporary second dwellings. Effective January 20, 2007, the fee for annual renewal increased to $55.00 for temporary second dwellings per the Butte County Board of Supervisors, Butte County Code 3-43. Inasmuch as your renewal expired on May 17, 2003, you are hereby advised to apply for a renewal. The permit to allow a mobile home as a second dwelling on this parcel creates ANN C. SHANNON an impact on the school district. This impact will need to be fully mitigated. Member PAT STEVENS Member The property lies within the Oroville Elementary School District. Students generated from the development would attend Oakdale Heights School for grades K-6, and Central Middle School for grades 7.8. Unfortunately, both schools have insufficient permanent facilities to house the current student populations at the schools. Because the $1.58 per square foot of developer fees are not sufficient to provide adequate permanent school facilities for students, the District is currently conducting a study of needed revenues to mitigate the impact that further development in Oroville will cause on our schools. Until the District is able to complete the study, l am requesting that all development, including parcel splits be delayed from final approval unless the property owner is willing to sign the attached agreement. At the conclusion of the study, the District will be able to tell the County what will be required of each development to mitigate the impact. The undersigned owners consent to the establishment of additional educational impact fees or any other funding mechanism established by the Butte County Board of Supervisors and the District Board of Education to supply the District with any additional educational facilities and equipment, and that the owners agree to support and to not in any manner protest against the establishment of any funding mechanism for additional educational facilities and equipment, and agree to pay their pro rata share thereof. 2. The undersigned owners agree to cooperate with the District in its efforts in creating the additional fees or other funding mechanisms as described above by supporting the District before the County of Butte, and with the other property owners within the jurisdiction of the District. 3. The undersigned owners agree, prior to the issuance of any building permit for projects developed on the land commonly known as AP No. , to pay such additional educational impact fees or any other fees that may be imposed by an ordinance adopted by the Board of Supervisors of the County of Butte and action of the District Board of Education. It is understood that such fees shall be paid directly to the District whereupon the District will deposit the fees into a separate designated District fund limited to the use of the intended purposes as set forth by the Butte County ordinance and action of the District Board of Education. 4. The undersigned owners agree that payment of any educational impact fee established by the District or the County of Butte as described in this agreement is an obligation in addition to the fees authorized by Government Code Sections 53080, 65970, et seq., and does not in any manner relieve the undersigned owners from the obligation to pay such statutory fees prior to the issuance of any building permit for projects approved for AP No. 5. This agreement and obligation of the undersigned developers to pay the herein described fees shall run with the land which is the subject of this agreement and such agreement shall be binding upon the heirs, successors, grantees, and assigns of the parties hereto. ANALYSIS: Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -wide mobile home. -These amounts seem reasonable to ensure that the mobile home is removed at no cost to the County or the taxpayers. The applicant proposes to place a single -wide mobile home on the property. RECOMMENDATIONS: A. Find that this project is Categorically Exempt from environmental review; and B.
