The ability to care for one's close relatives will not only result in better care for citizens, but will also negate in many situations the necessity for public assistance which many citizens find degrading and damaging to the pride of the persons concerned and their immediate relatives. Recently enacted legislation (AB 3158, Chapter 1706, Statutes of 1990, effective January 1, 1991) requires that the Department of Fish and Game impose and collect filing fees as specified to defray the cost of managing and protecting fish and wildlife trust resources. Stanley Use Permit Application At the present time a cooperative effort by CalTrans, Butte County and the City of Chico to prepare preliminary alternate route studies for a future bypass expressway between Hwy. 32 and Hwy. 99 are underway. The basic function of this facility will be to relieve.East Avenue from present and future traffic pressure. It is our current understanding that there is a possibility that at least one of the alternates being studied may impact the properties in the vicinity of Carmack. In the light of this possibility, it appears prudent for the County at this time to take steps at this time to protect taxpayers in the future from avoidable project costs. If property owners who develop their properties at this time do not receive constructive notice from the County that their properties may be affected by future public improvements, they may seek additional compensation over and above what they are normally entitled to in any taking for a public purpose. We think the Planning Commission should at this time, subject to approval of County Counsel, attach to its approval of this use permit the following condition: That the applicant waive any future claim for extraor- dinary compensation in the event the subject property is to any degree required for a future bypass express- way.". ANALYSIS: This project is a request to place a temporary mobile home as a second dwelling on property located at 292 Carmack Drive, Chico. The proposed mobile is to be located on the west end of the parcel, approximately 100 feet back from Jones Avenue. The proposed mobile will not be located near any neighboring homes. This placement should not cause any undue hardship on the neighboring homes. Installation of the mobile home at this location should not result in any land use conflicts or incompatibility of land uses. The temporary mobile home provisions under Section 24-304 of the Butte County Code were adopted to allow families to take care of one other and still maintain independent living quarters and privacy. The application clearly meets the intent of the Temporary Mobile Home ordinance. Temporary Mobile Homes also come under County Code Section 2447 concerning the issuance of the Use Permit. Butte County Code Section 24-304 provides for removal of the mobile home within 120 days of the time that it is no longer being occupied pursuant to the code section. The Code also makes provision for the County requiring a bond or deposit at the time of application of sufficient size to cover the removal expense of the mobile home. This is to insure that the taxpayers at large (via the General Fund) are not charged those expenses should the County be forced to remove the mobile home pursuant to the code. Of course, if the applicant removes this mobile home voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the mobile home, then only charges actually incurred would be reimbursed from the bond or deposit with the remainder being returned to the applicant. A survey of several mobile home dealerships in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course, would vary due to installation of landscaping, decks, awnings, and physical site characteristics. Taking the median figures and adding a small amount for administrative costs and storage costs, it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -wide mobile home. These amounts seem reasonable to ensure that the mobile home is removed at no cost to the county or the taxpayers. The applicant proposes to place a double -wide mobile home on the property. RECOMMENDATIONS: A. Find that this project is Categorically Exempt from environmental review; and B.
