SC15420 "OROVILLE DAM" 135 RIVERVIEW DRIVE, OROVILLE, CALIFORNIA By: Diamond Services Date 06/13/2006 1 T -Mobile Site No. SC 15420 Page 1 of 7 sCOUNBUTTE Ty JUL 0 61006 DEVELOPMENT SERVICES Diamond Services Report Summary Based upon information provided by T -Mobile and the design engineer, and using the calculated method for determining RF field strength, it is the engineer's opinion that the telecommunication facility which will be located at 135 Riverview Drive, Oroville, California will comply with the FCC's current prevailing standard for limiting human exposure to RF energy. Due to the mounting method utilized, the general public would not normally be able to approach the antennas. Therefore, no significant impact on the general population is expected. The calculated electromagnetic field strength level in publicly accessible areas is less than the existing standard allows for exposure of unlimited duration. Additionally, due to the mounting method used, no significant impact on the environment is expected. General Recommendations For personnel who maintain or work near the antennas, a training program in exposure to RF fields is recommended, since any access closer than ten feet to the face of a T -Mobile antenna at this site could expose personnel to RF field levels greater than the occupational limits, and such access should be prohibited. At this site, public access to the face of an antenna is not expected. Maintenance personnel should be instructed to contact T -Mobile prior to working in front of an antenna RF warning signs should be placed at the base of the monotree. Background Diamond Services' has been retained by T -Mobile to conduct a Radio Frequency (RF) electromagnetic analysis for a proposed telecommunication facility to be located at 135 Riverview Drive, Oroville, California. This analysis consists of a review of the proposed site conditions, calculation of the estimated RF field strength of the telecommunication facility, and the provision of a comparison of the estimated field strength with the Federal Communication Commission (FCC) recommended guidelines for human exposure to RF electromagnetic fields. Site Description Based upon the drawings provided by the design engineer, six antennas will be mounted on a new monotree. The antennas will be mounted approximately 97'- 9" (to bottom of lowest antennas) above ground level. The antennas will be oriented such that the main lobes are oriented toward the horizon. Normal public access to the front of the antenna is not expected due to the mounting location and method utilized. Occupational access to the front of the antennas is not normally expected. I PGI Group db.a. Diamond services T -Mobile Site No. SC 15420 Page 2 of 7 • Diamond Services • RF Field Strength Calculation Methodology A generally accepted method is used to calculate the expected RF field strength. The method uses the FCC's recommended equation which predicts field strength on a worst case basis by doubling the predicted field strength. The following equation is used to predict maximum RF field strength: Equation 1 S = (?) 2 PG — PG — EIRP =E7r R' Ir R' 7r R2 Where: S = power density P = power input to the antenna G = power gain of the antenna in the direction of interest relative to an isotropic radiator R = distance to the center of radiation of the antenna The ground level effect of the T -Mobile emissions was calculated using a maximum downtilt of 5'. and a maximum ERP of 131 watts. Results were calculated for a height of 6'-6" above ground level. Using these factors, the maximum calculated T -Mobile fields at ground level are 0.11% of the existing standard for general population uncontrolled exposure. Calculations were performed for the main antenna lobe, the -3dB point, and the first and second lower lobes. See Table 1 for the FCC's guidelines on Maximum Permissible Exposure (MPE). Note that the RF range referenced for this analysis is the range of 1500 —100,000 Mhz shown in Table 1, which is included in Appendix A. 2 Reference Federal CovmwScation Commission Office of Engineering Technology BuUcfm 65 T -Mobile Site No. SC 15420 Page 3 of 7 0 • Diamond Services Exposure Environments The FCC guidelines incorporate two separate tiers of exposure limits that are dependent on the situation in which the exposure takes place and/or the status of the individuals who are subject to exposure. The decision as to which tier applies in a given situation should be based on the application of the following definitions. Occupational/controlled exposure limits apply to situations in which persons are exposed as a consequence of their employment and in which those persons who are exposed have been made fully aware of the potential for exposure and can exercise control over their exposure. Occupational/controlled exposure limits also apply where exposure is of a transient nature as a result of incidental passage through a location where exposure levels may be above general population/uncontrolled limits (see below), as long as the exposed person has been made fully aware of the potential for exposure and can exercise control over his or her exposure by leaving the area or by some other appropriate means. General population/uncontrolled exposure limits apply to situations in which the general public may be exposed or in which persons who are exposed as a consequence of their employment may not be made fully aware of the potential for exposure or cannot exercise control over their exposure. Therefore, members of the general public always fall under this category when exposure is not employment-related. For purposes of applying these definitions, awareness of the potential for RF exposure in a workplace or similar environment can be provided through specific training as part of a RF safety program. Warning signs and labels can also be used to establish such awareness as long as they provide information, in a prominent manner, on risk of potential exposure and instructions on methods to minimize such exposure risk. For example, a sign warning of RF exposure risk and indicating that individuals should not remain in the area for more than a certain period of time could be acceptable. Another important point to remember concerning the FCC's exposure guidelines is that they constitute exposure limits (not emission limits), and they are relevant only to locations that are accessible to workers or members of the public. Such access can be restricted or controlled by appropriate means such as the use of fences, warning signs, etc., as noted above. For the case of occupational/controlled exposure, procedures can be instituted for working in the vicinity of RF sources that will prevent exposures in excess of the guidelines. An example of such procedures would be restricting the time an individual could be near an RF source or requiring that work on or near such sources be performed while the transmitter is turned off or while power is appropriately reduced. (T -Mobile) respectfully submits the enclosed application to develop a wireless facility in the Oroville area. The subject property is located at 135 Riverview Drive along Kelly Ridge in Oroville, Assessor's Parcel Number 069-360-008. The property is owned by James and Ruth Rackerby and is currently zoned AR -1. The parcel is 12.73 acres and presently contains a 1950 square foot residence along with a barn and a lean-to for recreational boat storage. On this property, T -Mobile proposes to develop and operate a 120' stealth monopine communications tower. The structure will be designed to resemble a typical pine tree. At the base of the structure, T -Mobile proposes to locate three equipment cabinets within a 30' X 30' leased area. The entire compound will be enclosed with a chain-link fence. The purpose of this project is. to develop a facility that will provide enhanced wireless servicesthroughout the eastern portion of the Oroville area and Lake Oroville. T - Mobile currently has extremely limited service in this area. The overall height of the facility was necessitated by the fact that the location is .approximately fifty feet downhill from the crest of the ridge. This decrease in ground elevation has necessitated the slight increase in overall height in order to achieve the required coverage objective. The facility is proposed to be located east of the barn on this property. At its planned Location, the facility will be completely outside of the view of any residences. The parcel directly north is vacant and undeveloped. Prior to selecting this location, T -mobile conducted an exhaustive research of any co - 'location possibilities in this general, area and found no existing towers or vertical T -Mobile - 1755 Creekside Oaks Drive, Suite 190, Sacramento, CA 95833 - (916) 743-8775 Get m,o r. from lift? elements that could be used for this project. The only existing communications facility is a wooden pole tower located at APN 069-360-010 on property owned by Jeffrey Holland. The residence on this property is currently rented. The wood pole appears to be owned by Ubiquitel (Sprint). The equipment is located in the back of the home on this parcel. The tower is relatively unattractive and there are panel antennas and a microwave dish on the wood pole. A co -location at this location would add to the considerable visual impact of the existing facility. T -Mobile made several attempts to contact this landowner to gauge any interest in leasing additional ground space for a possible co -location. All attempts at communication remained unanswered. We assumed that the landowner is not interested in another wireless carriers placement at this location. We also contacted the landowners of APN 069-360-009, Mr. Jack Burns and Ms. Jackie Burns. Mr. 6t Ms. Burns are presently divorced and living separately. Mr. Burns lives in Butte County and Ms. Burns lives in Orange County. While Ms. Burns was supportive of this project, Mr. Burns felt that this project would impede the total development of this parcel and could not support this effort. Based on these two prior attempts, we subsequently contacted Mr. Rackerby, the owner of the parcel that is the subject of this application. Mr. Rackerby was supportive of our effort under the caveat that the entire facility could not be visible to any of his neighbors. It was on this basis that we developed this project. T -Mobile feels that this is an outstanding project that will bring valued wireless services to this portion of the County and to the nomadic users in the recreational areas. We appreciate your review and consideration of our application and the supporting documents. If you require any additional information, please contact me at 916.743.8775 or by email at jazmadarian@sbcglobal.net. They may initially only install 6 antennas but would like to permit the facility for the maximum possible number of twelve. This is indicated in Key Note #11 on the A-1 sheet. T -Mobile makes their sites available for future co -locations and the landowner has agreed to lease additional ground space, if required, for any future co -locators. The only company I know that is currently interested in this site is Cingular but that development may not be completed until next year or possibly 2008. G.P.: Agricultural Residential Zoning: AR -1 Zone Date: February 28, 1984 APN: 069-360-008 Parcel Size: 12.87 acres Location: 135 Riverview Drive (east side of Riverview Drive, 0.2 - mile north of the Gleness Drive and Riverview Drive intersection:, east of the City of Oroville Supervisor District: Planner: Attachments: 1 Stacey Jolliffe A: Resolution for Denial B: General Plan/Zoning Map and Vicinity Map C: Correspondence with applicant and owner D: Photo Simulations E: Site Plan RECOMMENDATION: Staff recommends the Planning Commission deny this application without prejudice, allowing the filing of a new application if applicable code requirements can be met. BACKGROUND/ANALYSIS: This request for a Use Permit UP06-0017 was submitted on July 6, 2006 and has not been deemed complete for processing, due to non-compliance with setback requirements with BCC Section 24- 262 (g) (2) b. which states in part that "all new facilities shall be located on a lot so that the distance from the base of the facility to the parcel or lot boundary is equal to or greater than the height of the facility." The proposed tower does not meet setback requirements for wireless communications facilities, provisions in the County Code to allow setback requirements for wireless facilities are not applicable to this property, as it is zoned AR -1. . The applicant of record, Jerry Jazmadarian (Omnipoint Communications), has indicated that he is no longer the representative for the project. He referred staff to two representatives from T -Mobile, who have not returned email messages requesting to discuss the project. See Attachment C for e- mail correspondence with the property owner and wireless representatives, for whom staff was not able to locate office mailing addresses. ■ Butte County Department of Development Services ■ 0 Planning Commission 0 "Omnipoint Communications UP06-0017 0 November 12, 2009 ■ Page 1 ■ The property owner indicates the tower is not being pursued, and that he is not interested in relocating the tower to meet setback requirements. The tower was located as shown in the application packet because an existing barn shields it from the direct view of his neighbors. He said moving the tower +60 feet was not acceptable because it places the equipment, fence and tower base within his neighbors' view of Lake Oroville. The Department of Development Services has an expectation that project applicants will respond in a reasonable amount of time to requests for materials necessary for completion of project processing. The County is unable to approve this application without a tower meeting either the setback requirements of the BCC, or the criteria for modifying setback requirements. It is important to the Department's operations that applications not persist in processing without reasonably timely action to provide information required for continued processing. Persistent, incomplete applications result in significant ongoing costs to the County due to the duplication of effort needed to update, recreate, and restart project processing, and from changes in development standards. The significant costs to the County of"holding" applications indefinitely are not covered by the "flat -rate" nature of the County's application fee structure. To allow for continued processing of such an application would result in the need to subsidize the processing of this application from the County's General Revenues Fund. Staff no longer has an active applicant of record, and the property owner is not in support of locating the tower in a location consistent with the requirements of Butte County Code. For these reasons, it is recommended that this application be "denied without prejudice", thereby allowing the applicant to reapply if applicable code requirements can be met without having to wait the normal period of one year before submitting the same or substantially the same application. ENVIRONMENTAL REVIEW/CEQA ISSUES: The recommended denial of this project is Statutorily Exempt from environmental review under the California Environmental Quality Act (CEQA) Guidelines Section 15270(a). This section states that "CEQA does not apply to projects which a public agency rejects or disapproves." If the Planning Commission chooses not to deny this project, appropriate analysis under CEQA would be required prior to consideration of approval. ■ Butte County Department of Development Services ■ 0 Planning Commission 0 "Omnipoint Communications UP06-0017 0 November 12, 2009 0 Page 2 ■ RESOLUTION - A RESOLUTION OF THE BUTTE COUNTY PLANNING COMMISSION DENYING WITHOUT PREJUDICE USE PERMIT UP06-0017 Omnipoint Communications WHEREAS, Use Permit UP06-0017 application for Omnipoint Communications on Assessor's Parcel Number 069-360-008 was submitted to Butte County on July 6, 2006; and WHEREAS, the application has remained incomplete for processing; and WHEREAS, the applicant of record Omnipoint Communications has informed staff via phone on September 3, 2009 that he was no longer representing the project; and WHEREAS, successors to the original applicant T -Mobile USA, Inc. have neither made contact with staff nor responded to requests for discussion about the project; and WHEREAS, on September 21, 2009 the- property owner informed staff that he was not interested in placing the tower on his property at a modified location, as required to meet County setback requirements,; and WHEREAS, this application was considered by the Planning Commission at duly noticed public meeting held on November 12, 2009; and WHEREAS, the Planning Commission has considered public comments and a report from the Planning Division. As you may be aware, project Planner Chris Tolley was, laid off, so; forgive me, I need to ask a couple clarifying questions. 1: I see from the site plan dated 06-10-06, that the location of the.site is approximately 45' from the northern property .line. Please confirm I am working .off the most 'recenUcorrect site plan. The. recent'codefix' for modifying setbacks for communications towers is not applicable in the AR -1 zone in which the, property; is located. So I need •to confirm my understanding that the property owner has not agreed to move the cell tower to the south; because he wants it to.be shielded'from view. In notes to file, it was noted that Mr. Rackerby understood that he could'move the tower over 66 or so feet. He said that this would not be acceptable because it places the equipment, fence and tower base in full view of the neighbors to the lake. As ,proposed, the ,equipment, fence and tower, base is'blocked by the existing barn. Please let me know within the next -week, or so, if the proposed location of the cell tower has changed. 2. The Zoning code does: not provide authority to approve the tower as currently proposed, so as things stand there are'three choices: take it forward for denial, withdraw the application, or move the tower location. Please let me know your thoughts in a week or so. I'd be pleased to speak with you, and help out however I am able. My direct number, for your convenience is 530-538-6573. Visibility.of the tower would be objectionable, especially if the transmission panels are anywhere on the lower part of the tower . Guy wires would be necessary for a tower of that height and would extend well over and onto adjacent properties. The service buildings necessary for the tower function would themselves be inappropriate for an already -poorly -zoned residential area. Smith Date 0 `-J I El El T 0 VMW I r July 7, 2006 BUTTE Butte County COUNTY Department of Development Services JUL 0 6 2006 7 County Center Drive DEVELOPMENT Oroville, California 95965 SERVICES . Dear Development Services: Omnipoint Communications Inc. The purpose of this project is to develop a facility that will provide enhanced wireless services throughout the eastern portion of the Oroville area and Lake Oroville. T - Mobile currently has extremely limited service in this area. The overall height of the facility was necessitated by the fact that the location is approximately fifty feet downhill from the crest of the ridge. This decrease in ground elevation has necessitated the slight increase in overall height in order to achieve the required coverage objective. The facility is proposed to be located east of the barn on this property. At its planned location, the facility will be completely outside of the view of any residences. The parcel directly north is vacant and undeveloped. Prior to selecting this location, T -mobile conducted an exhaustive research of any co - location possibilities in this general area and found no existing towers or vertical T -Mobile - 1755 Creekside Oaks Drive, Suite 190, Sacramento, CA 95833 - (916) 743-8775 elements that could be used for this project. Mr. Ft Ms. Let me please respond to the concerns you have detailed in your letter. Pursuant to Zoning Code Section 24-262(e)(5) Prior to selecting this location, T -mobile conducted an exhaustive research of any co -location. possibilities in this general area and found no existing towers or vertical elements that could be used for this project. Pursuant to Zoning Code Section 24-2621e)t9 The proposed facility has been designed to resemble the various `digger pines' that are prevalent in this general area. The digger pine is a typical conifer with branches that begin at about fifty feet above ground and the foliage is of medium density. Several other designs were considered for the project including a brown -painted monopole and•a' lattice -type tower. In reviewing these alternate designs, it was the general consensus that the treepole was most appropriate for this location. Please know, however, that T -mobile would be please to construct a facility of .any design that is specified by the County. The application will be considered complete once technical information verifying the need for the tower height and location are submitted and reviewed by staff. The .intent is that the information will establish: 1. WHY the tower is placed in the proposed location, versus other locations that may pose less of an impact (including other types of zones... commercial or industrial); and 2. WHY the tower is proposed at a certain height; and 3. WHY a new tower is being proposed instead of a collocation, or WHY it is infeasible. Please review the excerpt from Zoning Code section 24-262, below, that identify the County's goals: (1) Encourage the location of new monopoles, towers and/or antennas in non-residential areas and minimize the total number of antennas throughout the county; (2) Encourage collocation of facilities at appropriate new and existing new monopoles, towers and/or antenna sites; (3) Encourage wireless communication providers to locate new monopoles, towers and/or antennas in areas where the adverse impact on residential neighborhoods, agriculture, and air navigation is minimal; (4) Require wireless communication providers to design and configure wireless communication facilities in a way that minimizes adverse visual impacts; (5) Protect the public's interest in the safe operation of emergency services which include, but are not limited to, air ambulance, medical and emergency evacuation, firefighting, law enforcement, search and rescue, vector control, and resource management; and (6) Allow reasonable opportunities for providers of wireless communication services to provide such services to the community in a safe, effective, and efficient manner. Essentially, this information is verified in the by providing: (5) A discussion of and supporting information regarding the alternative site selection of at least a minimum of three (3) to four (4) other sites, if available, including collocation opportunities, and a statement as to why these alternative sites and/or collocation opportunities were rejected. First, thank you very much for your support of MUP 06-09. I did spend some time meeting with the landowner after the meeting and I hope that he will address his financial concerns about this project to the tower owner, American Tower. Regarding UP 07-01 (Rackerby), I am working on providing the required documentation/justification for that project. From your list below, Item 2 indicates that T -Mobile is required to justify the proposed height of the monopine as the minimal acceptable height. Attached please find three (3) propagation maps. These maps were created to demonstrate the signal propagation of the proposed tower at 80 feet, 100 feet and the requested 120 feet height. Please note that green is in -building coverage, yellow is in -vehicle coverage, and the gray is coverage out in the open like standing on the street. We have also indicated the existence of the nearest hand-off site. -It is critical that the yellow signals of the neighboring sites coincide or the sites will not handoff. Essentially, as a nomadic user is traveling from one destination to another, the call will drop if. the signals are not sufficient to allow the user to handoff to the next site. You will note that, at 80 feet and 100 feet, the yellow signals do not overlap. If the network was designed in that fashion, the caller would not have continuous coverage. It is only with the proposed site at 120 feet do we accomplish a handoff between sites. I hope this explanation helps the County's understanding of our need to develop this tower at the proposed height. I will continue my efforts on the remaining two issues which you have mentioned below in your email. Thank you very much. Jerry 11/2/2006 0 0 Jerry, Page 2 of 3 Good morning! The first issue was relating to the requested height on the monopine. In a previous email, I have sent to you an explanation and supporting documentation that details the expected propagation -of the proposed facility at various lower heights. I explained why the 120' height is the minimum height that will accommodate the needs of the T -Mobile network. I hope you have found that information sufficient. Let me now please address the County's second concern, that which relates to the proposed location of this project. I T -Mobile evaluated various locations around the County before selecting the property at the Rackerby residence. Our underlying criteria is that we were to select a location which could provide coverage to the Lake and to the eastern portions of. the City of Oroville and surrounding County areas. In order to accomplish that goal, we felt it important to locate somewhere along Kelly Ridge, a geographic occurrence that provides a "view" of the Lake and portions of the County. During the selection process, we did evaluate a few other locations that we felt might offer the potential. to provide the required service. Those locations were are follows: Canyon Drive Self -Storage, 16 Canyon Drive, Oroville, APN 068-130-137 This location is zoned commercial and offers an excellent view of the eastern portion of the City of Oroville and County areas. It is, however, blocked from a view of the Lake by Kelly Ridge and was consequently eliminated from consideration. Please see the propagation map attached which indicates the possible coverage of this location. Lakeside Market, 5250 Olive Highway, Oroville, APN 069-520-025 This location. is zoned commercial and offers a good view of the Lake. It is, however, blocked from a view of the eastern portion of the City and County areas and was consequently eliminated from consideration. Please see the propagation map attached which indicates the possible coverage of this location. Jackie Burns, 6342 Woodman, Oroville, APN 069-280-070 Ms. Burns contacted me about possibly developing a wireless facility on this property. This parcel has an excellent view of the Lake and could provide the required coverage for the Lake Oroville objective. However, thi parcel is zoned `residential' and was subsequently removed from consideration. Jeffrey Holland, 107 Riverview, Oroville, APN 069-360-010 11/2/2006 Page 2 of`2 As discussed in some earlier correspondence, this location was considered because there is an existing wireless communications facility on this property. All attempts to contact the landowner to discuss a co -location were not successful I hope this discussion will, adequately address the County's requirements and that the application can now be considered complete. If you need any additional information, I hope you might please contact me. Thank you very much, Jerry Jerry, The Use Permit is considered incomplete, because the information regarding the towers height and location is insufficient.
