BUTTE COUNTY AIRPORT LAND USE COMMISSION
MINUTES - December 13, 1989
.The meeting of the Airport Land Use Commission (ALUC) was called
to order at 9:05 a.m. on December 13, 1989, in the Board of
Supervisors' Room, County Administration Center, 25 County Center
Drive, Oroville, California.
I. PLEDGE OF ALLEGIANCE
II. ROLL CALL Present: Commissioners Rossas, Walter, Lambert,
Franklin, Crotts, Lando and Chairman
Stevens
Staff: Dave Hironimus, Jill Cervantes
II. CONSENT AGENDA
There were no items to be discussed.
IV. BUSINESS
1. Status Report - Chico Municipal Airport Environs Plan
Commissioner Lando said that Becker McClintock and Associates
have been selected to.,prepare the Airport Land Use Plan. He said
federal funds will be'used to fund the study and that at this
time the consultants are updating the scope of work. He said the
work will probably not get underway until March, but that the
Plan will be made more extensive. Commissioner Lando said that
he will have a status report in March.
2. Status Report - Code Amendments and Overlav zone
Staff said there was nothing new to report at this time, however,
they did receive correspondence from the City of Chico regarding
the proposed policies and that some of the -wording on the
proposed building height limits and approach zones may need to be
amended.

MINUTES - December 13, 1939
There was a brief discussion on the building height limit. Staff
said that the wording will be changed in order to clear up the
confusion regarding slopes, so that there will be no question as
to height limits being a part of the approach surface
regulations.
Chairman Stevens requested that this item be placed on the agenda
for January.
3. Status Report - Review of City of Oroville General Plan
Conformity - Oroville Municipal Airport Environs
Commissioner Rossas discussed the draft plan and said that it was
nearing completion and that it would then go before the Oroville
City Council.
Commissioner Rossas said that the draft plan was for a 10 million
dollar improvement project and that it would not be happening for
a long period of time, but that the City would be applying for
all of the phases at one time, hopefully by January 1, 1990.
Mr. Jones, member of the audience, had a question regarding his
hanger.
Commissioner Rossas said that the current intention was that
nothing would be removed until it had worn out.
Chairman Stevens requested that this item be placed on the agenda
for January.
4. Discussion of Letterhead Desian
Commissioner Walter brought some pictures of several airplanes
for the Commission to review and said that he would not object to
anything the Commission would want to do., but that he has no
particular interest or desire to getting the letterhead.
Commissioner Lando said that he agreed with Commissioner Walter
and also said that a lot of money should not be spent.
Commissioner Rossas said that he felt the County stationary was
just fine.
It was moved by Commissioner Walter, seconded by Commissioner
Franklin and unanimously carried to forward the project to staff
to see if they can come up with a new design based upon the
suggestions given.

MINUTES - December 13, 1989
5. Business
Staff said that they received correspondence from the Division of
Aeronautics asking if this Commission would be interested in
forming a committee to help review, revise and update the Airport
Land Use Planning Handbook. Staff said that they themselves do
not have the time, but thought maybe some of the Commissioners
would be interested.
Commissioners Walter, Crotts and Alternate Commissioner Gerst
agreed to form a Committee to work on the Planning Handbook.
Commissioner Lando said that he will make sure the three
Commissioners have a copy of the Handbook for their own review
and use.
Commissioner Lando said that at the last meeting there was a
discussion on Assembly Bill 1951. He said that he called the
consultant for the airports in Oroville and Chico. He said that
the Bill does not affect Chico, but that it affects Oroville, and
that is why the application should be submitted on or before
January 1, 1990, because of legislation changes.
Commissioner Walter briefly reviewed and made comments on the
letter from Senator Don Rogers that was enclosed in the packets
regarding Chapter 1149 of the Statutes of 1989 which discusses

V. BUSINESS
.1. Statins Report - Chico Municipal Airport Environs Plan Review
Commissioner Lando.handed out a cover, -sheet regarding the request
for proposal to update the Airport Environs Plan. Commissioner
Lando said that the proposals are due October 16, 1989 and that
he expects a -significant response based'on the telephone calls he
has already received. 'Commissioner. Lando said that if cost isa
reasonable figure, the plan will probably.procded right away.
Commissioner Lando said that they hoped to have a'Consultant

under contract by mid-November and have a revised plan ready for
review by February 1, 1990.
COMMISSIONER ROSSAS PRESENT AT THIS TIME
vice Chairman Walter said that at the ALUC Meeting held in May,
there was a Committee appointed to "assist" Commissioner Lando in
reviewing this plan and was questioning if the Committee ever got
together.
Commissioner Lando said that the Committee included himself and
Commissioner Lambert, and never did meet.
Commissioner Lando said that he would keep the Commission
informed on how the Plan was coming along.
2. Status Report - Airport Zone, Code Amendments, and Overlay
Zone
Staff said that they started to prepare the initial study and ran
into some Sections that the ALUC Commission may want to review or
revise. Staff said that they are holding off on preparing the
initial study until the Sections are reviewed.
Staff said that they were going to review the definitions of
personal use airports, agricultural use airports or duster strip
and agricultural phase airports. Staff said the Code Amendment
would add the definitions and require use permits for the base
type airports in all agricultural zones. Staff said that they
would allow agricultural airports and duster strips in the A-5
through A-160 zones. Staff said that a use permit would be
required for personal use airports which would be non -
commercially used by an individual owner on his own property in
the A-20 through A-160, FR -20 through FR -160 and TM -20 through.
TM -160 zones. Staff said they would require a use permit for
personal use airports in all zones allowing residential uses.
Staff said on Page 6, under Notice of Intent, Sub Paragraph A,
regarding height of a structure, would the Commission want it to
be within a given radius or for.it to be countywide.
Staff said that in Paragraph 2, the concern was 100 to 1, is half
the slope of their most restrictive slope in any of the Airport
Land Use Plans. Staff said the concern was why be more
restrictive, why not just match their own plans and the FAA
requirements, which already have the safety factor built in.
Commission and staff briefly discussed slope restrictions.

The Commission agreed on the wording of 50 to 1 for the strictive
slope area.
Staff asked the Commission if they wanted to look at the Overlay
Zone at a 100 feet above ground level in a _countywide situation
or within 2 or 4 miles within airports.
The Commission agreed on countywide and felt it would not hurt.
Vice Chairman Walter asked staff when this item would come back
before the Commission.
Staff said that he would report at the next meeting.
vice Chairman Walter requested a status report be placed on the
next meetings' agenda.
3. Status Report - Review of City of Oroville General Plan
Conformity - Oroville Municipal Airport Environs
Commissioner Rossas said that the City of Oroville's consultant
has not yet submitted the final plan. He said that the City does
have a preliminary plan and to execute the whole plan would be
approximately ten million dollars.
Commissioner Rossas said that the contracts were open and that
the bids came in. He gave a brief update and noted that Robinson
Construction would be doing the paving, they are lowest in cost
and highest on minority employment.
Commissioner Rossas said that the City Council had a meeting
regarding the property at the end of the Oroville Airport runway.
Commissioner Rossas said that he and the City Public Works
Director walked the airport area and said that there would be a
lot of earth moving to be done.
Vice Chairman Walter asked if the Commission could receive
informational briefing on the Master Plan.
Commissioner Rossas said yes.
Vice Chairman Walter asked if any paper work or General Plan
updating needed to be done.
Staff said not at this point.
Vice Chairman Walter requested that this item be carried forward
and placed on the next agenda.

4. Discussion of Letterhead Design
Staff said that ALUC has been using the Planning Department
letterhead when they send out correspondence, and suggested that
ALUC have their own letterhead.
Staff said that they have received a couple of ideas such as the
Frisbee Falcon, which was built in the Gridley area and flown in
1921, and. World War II Trainers.
The Commission and staff agreed to get some pictures together so
they could review them at the next meeting.

VI. CORRESPONDENCE
Staff said that James Hanna has resigned from the Commission.
VII. REFERRALS TO STAFF AND FORMATION OF COMMITTEES
Vice Chairman Walter said that back in May, ALUC was going to
send a letter to the Attorney General asking for an
interpretation. He said that he has not seen any indication that
a further action has taken place.
Staff said that nothing has been sent, and that they have talked
to County Counsel about the possibility of asking for the
Attorney General's opinion. Staff said that the Commission would
basically put together a brief report stating the position and
asking for an agreement with that position. He said that County
Counsel does not have the time to administer this.
Commissioner Lambert suggested when there is an opening for this
Commission, that the Commission suggest to the City Selection
Committee, to nominate an attorney. She said that it would help
to have their expertise.
Comissioner Rossas said that there are good and bad points to
that idea. He said that problems could occur if the attorney was
to disagree with County Counsel.
Commissioner Lando agreed with Commissioner Rossas.
Vice Chairman Walter asked what action has staff taken to put in
regulatory form.

V. BUSINESS
1. Status Report - Chico Municipal Airport Environs Plan Review
Commissioner Lando said that the Chico City Council received the

letter and were quite concerned and interested and felt that they
should hire a consultant to update all projections in the Plan.
Commissioner Lando said that the City is contacting their airport
consultants as well as the FAA and CalTrans to get names of
consultants so that they can start the process.
Staff said that if the Chico City Council feels that the environs
plan that is currently being used is inadequate or out of date,
at the next meeting the Commission could formerly make the
finding for the record and require a review by ALUC for any
projects that may be submitted.
Commissioner Lambert requested that an agenda item be placed on
the next agenda regarding making a comparison on the existing
environs plan and review on the City's current zoning and general
plan for the area.
Staff said that they would set up an item so that an action could
be taken or it could be continued for the next agenda.
2. Status Report - Airport Zone, Code Amendments, and Overlay
Zone
Commissioner Lambert said that this item was discussed at the
Planning Commission per her request. She said that the Planning
Commission requested that the Overlay issue be pulled and brought
before the Planning Commission. Commissioner Lambert asked for
clarification on what has been happening with the airport zones.
Staff said that the airport properties for Ranchaero and Paradise
have been zoned. He said that staff is still working on an
overlay zone or an environs zone that regulates structures, tree
heights, roof materials, concentrations of people.
Commissioner Rossas asked if this body could be informed of what
the thinking is on these projects before they become a full blown
issue.
Staff said yes.
3. Status Report - Review of City of Oroville General Plan
Conformity - Oroville Municipal Airport Environs
Commissioner Rossas said that the City only has the preliminary
report and has not yet received a final report from Mr. Bramley.
He said that Mr. Bramley is waiting for the aerial photos. He
also said that the sum total is the same and that the work was
certainly adequate.

in Butte County.
Commissioner Rossas suggested one of the World war II Trainers.
It was decided that the Commission would bring pictures and other
ideas to the next meeting..
Commissioner Rossas said that he like the idea of keeping the
county logo on the letter head.

regarding conformity with the Chico Municipal Airport Environs
Plan were distributed to the Commissioners for their information.
2. Status Report - Airport Zone, Code Amendments, and Overlay
Zone
Staff explained that they had not had much time to work on the
project but had planned on working on it before this fall.
Commissioner Lambert asked where the project stood.
Staff said that a draft had been put together and that the
environmental work still needed to be finished.
Commissioner Lambert asked for clarification on "code
amendments."
Staff said it would be an overlay zone and that the Board needs
to adopt the enabling legislation that allows the Commission to
process and overlay zone.
Commissioner Lambert asked if at the Planning Commission meeting
she could request two parts of the zoning code be pulled
separately for review.
Staff said yes.
Commissioner Lambert asked if she could initiate action by asking
the Board to review the enabling legislation separately from the
entire Code Revision.
Staff said that it could be done at any time and that the
Planning Commission needs to request it be done.
Commissioner Lambert asked if that would require publication.
Staff said not at the Planning Commission level, but at the Board
level.
Staff suggested having the overlay zone pertaining to airports
reviewed by ALUC and have it in its final form and then request
the Planning Commission to adopt the zoning.
Commissioner Lambert asked staff if having the enabling sections
for overlays first would help.

Staff said that a.Planned Unit Development zone is tied to a
specific development.plan and that an'overlay zone is able to
have height limitations, etc., over a large area, including
separate.zones,'uses and ownerships. He said PUD's are specific
projects.,
Chairman Stevens was also concerned about the amount of time it
was taking to complete this project.
Staff explained the time limits on public initiated projects.
Chairman Stevens''requested that this item be kept on the agenda.
3. Status Report - Review of City of,Oroville General Plan
Conformity - Oroville Municipal Airport Environs -
Commissioner Bones said. that the City's consultant is in the
process of recommending several solutions to the situation of,
respective runway locations and clear zones and has been through
the review process. He said that the consultant was going to
recommend that the clear.zones.stay on 'airport or,state property
and that they will extend Runway 1-19 to the'southwest. He said
that the long range plan was to locate'the terminal and all of
the new infrastructure in the open area.
Chairman Stevens requested that this item be kept on the agenda.

Staff said that there was a map included in the packets showing
the area and the location relative to the traffic corridors. He
said that the zoning is in place and that the roads are planned
and are in place. He said that most of the property is in the
flight corridor. He said that the northerly portion was zoned
for light commercial uses and the southerly portion is zoned for
duplex residential.
Commissioner Walter asked if the area was zoned C-2.
Staff said that this was city zoned.

Commissioner Lambert -asked if the;Commission was to decide if the
parcel could be split into two or if they were to decide on the
use that would be appropriate for the land.
Staff said that the zoning was in place.
Commissioner Walter asked why the Commission was reviewing this
project since this Commission is concerned with land uses and not
parcel sizes.
Staff said that this Commission does review densities to a
certain degree, but that this project is a land division and that
this one thing this Commission is charged with under the Public
Utilities Code.
Commissioner Rossas felt that this project should just be
confirmed.
Commissioner Walter felt it should be noted.
Commissioner Lambert asked what difference it made whether it was
one or two parcels.
Staff said that as far as land use of the property, it would not
make much difference.
There was a brief discussion.

Commissioner Lambert was in agreement with Commissioner Walter
that the Commission note the proposal.
Commissioner Walter reviewed and reworded what he thought should
be noted: "Since no land use proposal is involved at this time
and ALUC has no control over land divisions, it would be
inappropriate."
Commissioners Rossas and Franklin disagreed strongly.
There was a brief discussions on land use and land divisions.
It was moved by Commissioner Franklin, seconded by Commissioner
Rossas to find this project in conformity with the Plan. The
motion carried by the following vote:
AYES: 'Franklin, Rossas, Stevens
NOES: None
ABSENT: Lando
ABSTAINED: Lambert, Walter
Commissioner Rossas said that he felt the reason why the
Commission was disagreeing was because they are trying to assert
the authority of .this Commission and that they feel frustrated
from the fact that it has not been asserted before.
Commissioner Rossas said that each city should have 'a
representative that attends each meeting.
Commissioner Lambert said that this group needs to be pulled
together.
2. Status Report - Chico Municipal Airport Environs Review
Commissioner Walter said that he did not know of any action taken
yet.
Chairman Stevens requested that this item be kept on the agenda.
3. Status Report - Airport Zone, Code Amendments, and Overlay r�

Staff said that the environmental work had not yet been finished
for the Code Amendments. He said that not much would happen at
the Board level regarding the Overlay Zones.

initiated projects really have no time lines.
Commissioner Lambert asked staff if they could ask the Planning
Director if there could be a priority placed on this project.
4. Status Report - Review of City of Oroville General Plan
Conformity - Oroville Municipal Airport Environs
Commissioner Rossas said that the report had not came in yet. He
said that Mr. Bramley is working on the environmental impact
report. He said that there will be a.second hearing when it is
completed, hopefully before the next ALUC meeting.
Chairman Stevens asked what they were doing with the airport now.
Commissioner Rossas said that with the.million dollar grant, they
were doing some resurfacing and fencing around the airport.
Commissioner Walter clarified that this grant did not include any
purchasing of land.
Commissioner Rossas agreed.

It was reported that a meeting was held after the ALUC meeting of
February 8, 1989 by the Airport Managers to reappoint Pat Stevens
as an ALUC Commissioner.
Staff said that the Vice Chairman automatically moves up to
Chairman, and that the new Vice Chairman is selected from among
the members that have served a minimum of one year on the
Commission.

Carl Walter is the new First Vice Chairman.
Commissioner Franklin was nominated for Second Vice Chairman. It
was moved by Commissioner Lando, seconded by Commissioner Lambert
and unanimously carried to elect Commissioner Franklin as Second
Vice Chairman.
2. Discussion - Chico Municipal Airport Environs Plan
Enforcement and Implementation
Commissioner Lambert said that she requested that this item be
placed on the agenda because she felt it needed some discussion.
It was decided that Item 3 be discussed also at the same time.
3. Discussion - Chico Municipal Airport Environs Plan Review
Commissioner Lambert said that there was a project that was
approved in Chico that she felt should have come before ALUC and
did not. She said that she wanted to clear the air as to why the
project did not come before ALUC and what this Commission needs
to do for future projects. She said the project was a Church to
be located on the corner of Ceres and Lassen in Chico which is in
the approach zone, 6600 feet from the end of the runway.
Commissioner Walter reviewed a map, with the Commission,
depicting the area.
Commissioner Walter said that this project never came before ALUC
and felt it should have. Commissioner Walter went over a time
line of actions between the County, City of Chico, - and State.
Commissioner Lando gave more backup information.
Commissioner Lando said that it is time to get serious about the
Airport Environs Plan for Chico and find out who is correct, have
someone else look at projects and what the protected area ought
to be. He said that the City does have the clear zone, a mile at
the end of the runway.
Commissioner Lando handed out maps showing the area of the
existing zoning plan for Foothill Park, one showing details
regarding some specific projects, and one showing the compatible
land use zones relative to the airport to the Commission.
Commissioner Lambert asked if the process would have been
different if it would have came before ALUC.

Commissioner Lando said yes.
Staff said that the requirements for review by ALUC are for
General Plan Amendments, Rezones, changes in building standards,
etc. Staff said that normally Use Permits and Variances conform
to the zoning and General Plan and would not come before ALUC.
Staff said that if the zoning and general plan are in place and
are adequate that anything that happens underneath them would be
in conformance with the plan. Staff said that both the City and
County review periods are short. The timing was such that there
was no way they could get into an ALUC hearing and have time to
get it back to the City for their Planning Commission hearing.
Staff comments to the city recommended denial of the church use
permit.
Commissioner Walter said that since the State denied the Church
project, it should have triggered some kind of holding action
until it had been thoroughly reviewed.
Staff said that this Commission can only make recommendations on
use permits and variances. Staff also said that under the State
law, it is not mandatory for use permits and variances be
forwarded to ALUC.
Commissioner Franklin said that the Commission needs to impose
something that would tie down the general plans and zoning.
Staff said they analyze projects in terms of the adopted plan, if
the plan calls for Airport Land Use Commission input, then it is
taken to the Commission, if it is very clear that it is allowed
or not allowed, staff can respond.
Commissioner Lando suggested that if there is a doubt that a
project is not consistent, or that there may be a problem, the
particular corresponding agencies should request that the item be
denied or continued and be brought to ALUC. He said if the
project is consistent there should not be a problem.
Commissioner Walter said that it was his impression that whenever
the Airport Environs Plan was overridden by the City or a
municipality, they had the authority to do it, but that they had
to make an overriding finding, and then they were responsible
legally for any damages that might occur at any later time.
Staff said that if this Commission finds that the City does not
revise the general plan or specific plan or overrule the
Commission by a two-thirds vote of its government body after
making specific findings., etc., the Commission may require that
the City submit all subsequent actions, regulations and permits
to the Commission for review.

Commissioner Lando said that he thought it would be appropriate
for ALUC to send a letter to the City indicating that they are
quite concerned, based on the existing approved Environs Plan,
that there is an inconsistency.
Fred Stewart, Department of Transportation, asked if there was an
adopted Chico Land Use Plan adopted by ALUC.
Staff said the predecessor to this body was the County Planning
Commission acting as the Airport Land Use Commission.
Mr. Stewart told the Commission that they were not the only body
that was having these dilemmas. He said that the City has opted
not to take action to make it's General Plan consistent with the
Airport Land Use Plan.
Mr. Stewart asked if the City of Chico submitted their General
Plan to ALUC for determination of whether it is consistent with
the Chico Airport Land Use Plan.
Staff said the Specific Plan was adopted for this area shortly
after this plan was adopted, noting some inconsistencies.
Commissioner Lando asked if ALUC then found the plan compatible
and if the new ALUC body does not.
Mr. Stewart said that things change over time and would not
expect that a body acting in 1979 would bind any subsequent
thought later on. He said that if this body reviewed the Plan
and had sufficient rationale to support the decision, it could be
very easily said that the Commission does not find it consistent
with the CLUP. He said that there would be no reason why an
amendment to the CLUP could not be done.
Commissioner Franklin said that if the Commission does find that
there should be a change, unless the City or County amend their
zoning to match the Commissions' change, requests for comments
would still not come before ALUC, and the old zoning would still
be in effect.
Mr. Stewart said that they would have to do so within a time
frame, and if they fail to do so, they must send all zoning
actions to ALUC for their action before they can approve it. He
said that they can ignore you, but that it would probably end up
in court.
Staff said that if the Commission was to find that their plans
were not consistent, that 60 day and 180 day time limits could
not possibly be met and still conform to the provisions or the

Commissioner Lando said that he was skeptical about the ability
to withdraw the approval after it has 'been there. He'said that
the alternate approach would be .to adopt a new plan.
Commissioner Rossas said that a statement regarding this
discussion•be submitted'to the City in case of a plane going
through the church while it was being occupied. He felt that it:
should be in writing and transferred to the City of Chico with a
copy, so if something happens, and it goes into court, and there
is litigation, the City of Chico could not be blamed.
COMMISSIONER LANDO ABSENT AT THIS TIME
Staff said that the County did respond with a recommendation for
denial.
Commissioner Walter suggested that staff be directed to write a
strong letter to'the City of Chico stating that the Airport Land
Use Commission feels that they should have been consulted and
call attention to the fact that the State denied the project and
that ALUC concurs with the'State.

Commissioner Lambert suggested sending:a copy of this letter to
the Board of Supervisors.

Chairman Stevens'asked Mr. Stewart and Mr. Smith, both,
representatives from CalTrans, if they,had any suggestions or
input on the letter to be addressed to,the City of Chico.'
Mr. Stewart agreed that if.this body was'not on record, that they
certainly need to be., He said that writing to -the City of Chico'
and sending a copy to the Board of Supervisors seems to be,a good
idea. °
There was a brief discussion on the location of the church and it
was agreed that it was not in a good location.
Commissioner Walter asked if the proposed school was built in the
vicinity.of the project area.
Commissioner Franklin said it had not`been built yet.
Regaring the school,site that was approved, Carl'Smith,.
Department of Transportation, said that there had been initially
five sites considered in 1986 that the Department of
Transportation evaluated. He said that of the five sites that
were evaluated, two were acceptable with•:reservations. He said
that the one that was selected was the'one that was most unlikely'

to be a suitable place for a school.
There was a brief discussion on the noise contours. Mr. Smith
also said that there is a proposed high density housing tract
which will be a bad situation because of there being a high
concentration of people.
Commissioner Walter asked that in view of the fact that the State
recommendation has been overturned by the City, what action if
any does the State contemplate now?
Mr. Stewart said that there might be State action by the Attorney
General, because of the process being abused by both the city and
county not following the legislative prescribed procedure for
things, i.e., reviewing its general plan to make it consistent
with the CLUP.
Mr. Stewart said that if ALUC wishes to enforce its powers and
duties as prescribed by the legislature, they could do it in a
number of ways City and County and/or within the County,
sometimes the Attorney General will take a position on issues
broader than just a single County issue.
Staff said that maybe they need to ask their County Counsel as to
whether a zone conforms to the plan even if that zone allowed
uses through the use permit process that might not conform.
Chairman Stevens asked if this Commission had any tabling powers;
for example, when the request came, could staff have referred it
back and say that it will have to go before ALUC.
It was moved by Commissioner Franklin, seconded by Commissioner
Walter To contact County Counsel to ask for the Attorney
General's opinion on compatibility of zones that contain use
permit items that would not conform to the Airport Land Use Plans
and also to send copies of correspondence to California Aviation
and the Division of Aeronautics. The motion carried as follows:

Staff said that they could have done that, but was not sure if
the City would have paid any attention.
Staff asked what kind of authority does CalTrans have from a

Mr. Smith said that the State basically does not restrict an
airport use on the type of aircraft that -land and takeoff from
that airport.
Mr. Smith said that when the FAA has money involved in an
airport, they become more aggressive with respect on how they
comment.
4. Status Report - Airport Zone, Code Amendments, and Overlay
Zone
Staff said that the airport zones for both Paradise and Ranchaero
are adopted and in place. Staff'said the code amendments, a set
of requirements, and an overlay zoning regulating height still
have to be prepared. Staff said there was nothing else new to

Staff said that they have been working'with Wally Boness from the
City of Oroville.
Commissioner Rossas said that Mr. Bramley, City of Oroville's
consultant, is preparing the Oroville'Airport Master Plan.
Commissioner Rossas said that Mr. Bramley gave a verbal
preliminary report which looks extremely good. Mr. Bramley has
all of the data'and facts and all that has to be done is write
the final report. Commissioner Rossas said that hopefully when
ALUC meets again, he will be able to}have the final report.
Commissioner Rossas said that the thresholds have been moved and
that the expansion of the airport will be to the south.
Commissioner Rossas said that the City received a grant for one
million dollars which.will repaint the runways, buy taxi lights
and fence the airport.
Commissioner Walter said he did not see•any of the money for the
purchase of the strip of land toward the afterbay.
Commissioner Rossas said that was another project with other
funds.
Commissioner Rossas said that in Mr. Bramley's report, he.
gradually wants to move all of the airport facilities into the
triangle in between the runways and lengthen runway 01-19.-

d Chairman Stevens asked if the entrance would be on Larkin Road
since the new plan is to shift the airport facilities to the
south.
Commissioner Rossas was not sure.
Mr. Smith said that from a safety point of view, the entrance
should be moved because'it is now encroaching into the runway.
COMMISSIONER FRANKLIN ABSENT AT THIS TIME
Commissioner Walter said he reviewed the Aviation Element of the
Regional Transportation Plan 1988 and"'had noticed that the
Oroville Airport Administrative and Operative expenses were
$65,500.00. He said that Chico only spent $46,245.00 on
Administrative and Operatives expenses.
Commissioner Walter mentioned that the beacon out at the Oroville
Airport has been operating on a test basis for nearly"one year
and is going great. He said it is reliable, has good range and
is a good safety factor.
6. Business from the Floor
Commissioner Walter recommended that staff be directed to consult
the Chairman each time on whether a meeting should be held and
what the agenda of the meeting should be.
Chairman Stevens requested that the Oroville Environs Report, -
Chico Municipal Airport Environs Plan and the Overlay -Zones be
kept on the agenda.
The Commission appointed Commissioner's Lando, Franklin and.Walter
to work on a committee for the review?of the Chico Airport
Environs Plan.
Commissioner Walter wanted clarification on responsibilities and
roles of the Commission regarding people who are involved with
items that effect aviation and airports. He asked what
documents, policies, and ordinances is the Commission to
participate in and either review or initiate. He asked how the
documents are processed and in what sequence, by whom and when.
He said flow charts would show how these things get done and
where they sit, -'so -they don't get overlooked.
Mr. Stewart said that their letter dated April 4, 1989 only took
a position of a recommendation on the school site. He said that

Staff said that the airport zone would be presented to the
Planning Commission on February 9, 1989. Staff said that there

were some changes which shifted the use permit requirement for a
caretakers residence over to the allowed use section. Staff said
that scheduled air carriers and uses involving the storage of
fuel were moved to the use permits section. Staff said the
intent of the ordinance was not changed, the same types of
applications are included.
Chairman Lambert said one of the main concerns of the residents
were the traffic and speed of traffic.
Staff said that both the Code Amendment and Overlay zone have not
had any previous environmental work done. Staff said that they
were in the process of preparing the environmental documents.
Chairman Lambert asked for clarification on the Code Amendments.
Staff said that Code Amendments would add some definitions into
the overall zoning code that would define ag-airport, ag-base
airport, private airports and require use permits for the private
airports and the ag-base airport. The Overlay zone would be the
height limits, noise, light and glare standards around the
airport.
Chairman Lambert asked about BCAG's Transportation Element.
Staff said that the Element had been finished.
Commission and staff briefly discussed the requirements of
environmental documents.
Commissioner Walter asked who in staff was working on this
project.
Staff said that Dave Hironimus was the primary planner.
Staff said that they would bring this item back when there was
something new to report.
2. Status Report - Chico Municipal Airport Environs Plan
Review.
Staff said that there was nothing new to report.
Chairman Lambert asked if BCAG was going to do some studies.
Staff said that it was a possibility but that it was not a formal

Chairman Lambert said that a group of the airport managers need
to get together and reappoint Commissioner Stevens or a
replacement.
Since there was a quorum of airport managers present, a short
meeting was scheduled after this meeting of the Airport Land Use
Commission.
5. Business From The Floor
Commissioner Walter said that he had reviewed some information
from the California Aviation Council which is a private
organization of all California aviation activities. Commissioner
Walters said he noticed that they had airport representatives at
all major airports. He asked if Butte County knew that they were
not listed.
Commissioner Stevens said that you have to pay to get into the
organization. She*said that you can join as a group or
individually.
Chairman Lambert asked what these groups do.
Commissioner Walters said that they lobby.
There was a brief discussion.
Wendell Jones said he belonged to the E.A.A., a group which is
active and meets monthly. He said this organization sent letters
to the F.A.A. and Congressman regarding the zoning for some 246
airports. He said that the group is trying to get them to modify
this. Mr. Jones said that if this Commission contacts Jim
Culliton, President of the E.A.A., maybe they could do something
about this.

Staff said that the Planning Commission initiated the project to
adopt code amendments. Staff also explained the comment
procedure and environmental review process and said the project
was progressing.

Review.
Staff said a committee had not been formed and that there was
nothing new to report.
3. Discussion - 1988 Aviation Element Update, Supplement to the
1986 Butte County Regional Transportation Plan.
Mr. Moore explained briefly the Regional Transportation Plan for
Butte County which is prepared by the Butte County Association 'of
Governments. He said that the Butte County Association of
Governments was formed to carry out regional type projects and
projects that transcend jurisdictional boundaries.
Mr. Moore said that staff is in the process of revising the
document by showing the need for airports and addressing issues
such as funding, financing and inventory in our county airports.
Mr. Moore said he would be mailing out the draft to the
Commission, interested agencies and to people who are in the
tourism industry, airport and pilot operators, people who work in
major industries along flight lines and people who work for air
carriers, and air cargo transportation companies. He said a
committee meeting would be scheduled to prepare the final draft.
He also said when the final draft was completed, it would then be
ready to go before the Butte County Association of Governments.
There was a small.discussion on transportation in and around
airports in Butte County.
Mr. Moore suggested to the Commission that as the Airport Land
Use Commission they request the Butte County Association of
Governments conduct the necessary planning studies to develop an
Airport Master Plan for Chico Municipal due to its regional

significance and ask the Butte County Association of Governments
to look for other sources of funding for the Airport Master Plan.

1. AZ Code Amendment, including private, commercial
and ag (base) airports
Staff said that they are in the process implementing policies and
plans for the AZ code amendment.
Staff discussed the following zones:
1. Specific zone for airport property.
2. Overlay zone that governs height limits and other
airport/aircraft hazards around airports.
3. Code amendment that would define the requirements of use
permits, airports, ag-strips, agricultural base airports,
and private strips.
Staff reviewed the following code amendments:
1. :Personal use airport.
2. Agricultural airport.
3. Agricultural Base airport.
Chairman�Lambert had reservations about the occasional invited
guest using the personal use airport. She questioned how the
definition could be enforced.
Staff stated that.the language was listed from both State and
Federal definitions.
Chairman Lambert asked if the language should be in the code.
Staff said yes.
Commissioners Lando and Franklin said that they shared'the same
concern as Chairman Lambert.
Commissioner Lando and Chairman Lambert said that,for personal
use airports, use permits should be required in all zones.
Commissioner Lando asked what the definition was for the R -C
zone.
Staff said that it is a Resource Conservation zone, which is
normally applied to areas where there is a sensitive resource,
rare or endangered species or something that should not let the
area be developed.
Commissioner Lando suggested additional language stating

"Excepting the R -C zones where such an airport is not allowed."
Commissioner Lando asked what the purpose was distinguishing
between agricultural airports vs. agricultural base airport.
Staff stated that the agricultural airport would be for crop
duster use with no permanent facilities, etc. An agricultural
base airport would be a permanent on-site maintenance, fuel
storage, etc. on base airport. He said that the agricultural
airport would be permitted in ag zones.
Commissioner Lando questioned the County's Ordinance being clear
unless a use is specifically permitted, it is prohibited.
Staff stated yes.

Staff pointed out that other large acreage zonings such as F -R
and TM allow aircraft landing facilities in their language
already. He said that the TPZ zone allows uses compatible with
logging operations such as helicopter decks for logging purposes.
Chairman Lambert questioned why an A-20 through A-1'60 zone is
needed when applying for a personal use permit.
Chairman Lambert questioned if someone with a large acreage
parcel wanted to apply for an air strip/personal air strip and
was not in an A. TM or FR zone, would a use permit not be
required?
Staff stated that they would probably have to rezone to another
zone because the zones do not specifically permit that.
Staff discussed briefly the A -Z zones for specific properties for
commercial style of public access airports and overlay zones..
Chairman Lando said that the zoning on ground seems to be
straight forward. He asked if it would be appropriate to tie
into the adopted plans in terms of compatibility under the
Development Standards.
Mr. Moore, Planning Staff, asked if they should state that
development must be geared to adopted master plans for airport.
Mr. Moore said that there seems to be several plans for each
airport: Butte County General Plan, Airport Environs Plan and a
Chico Area Land Use Plan. He asked if this was to be referred to
the Airport Master Plans that have been developed for Airport
Land Use Plans for each airport._

Commissioner Lando agreed.
Mr. Moore stated that when a prezone is requested, adopted plans
should be consistent with the State Law and Airport Land Use
Plans be consistent to the County's General.Plans.
Commissioner Lando stated that it should be stated for a couple
reasons, it is typically not adopted as part of the General Plan
and not referenced unless the County has changed its General
Plan, and when someone is referencing to this document they
should know what the constraints are.
Mr. Moore suggested adding wording such as "Proposed sites for
airport zoning where no airport is in existence shall demonstrate
that it can meet all permitting requirements of the California
Department of Transportation, Division of Aeronautics, and is
compatible and consistent with the Butte County Airport Land Use
Plans in accordance to Government Code Section 65000" which
states that the general plan and zoning have to be consistent.
He said that they would reference this to the State Law.
Chairman Lambert asked about'fuel farms being underground storage
or big tanks.
Mr. Moore stated that it could be either. He said that a lot of
airports have large fuel farms so that they can make sure they
can service the aircrafts that are coming in and out. He said
that it was clarified under Item No. 1 under the first section.
Chairman Lambert questioned use permits being required because it
deals with groups of people and commercial uses.
Mr. Moore stated that it was not a direct application of the
airport. He said it may lend itself to an airport, but the
primary purpose of an airport is the aviation operation.
Commissioner Gerst questioned Item No. 1 under the Development
Standards.
Mr. Moore said that it was not discussing airport operations,
but that it was discussing the land uses around the airport.
Mr. Moore said that the definition of nuisance in the Ordinance
would help set parameters of how much noise and vibrations and
would help clarify overall.
Staff stated that the definition of nuisance is already in the
County Code.

Mr. Moore stated that the draft Ordinance is in regards to an
overlay zone which controls land uses surrounding airports.
Commissioner Lando asked where this Ordinance came from.

Mr. Moore said that it had been mailed for review to the Division
of Aeronautics, California Commission of Airports and Aviation,
and the Aircraft Owners and Pilots Association (AOPA).
Commissioner Lando asked how this compared to the existing
section that is in the Code.
Mr. Moore said that there is no overlay zone.
Chairman Lambert stated that there was not an overlay zone and
that it is proposed in the code amendment but has not yet been
adopted.
Staff stated that the County has a height limit zone which has
not been enforced.
Chairman Lambert asked if any comments on the Ordinance had came
back from the State.
Mr. Moore said that the State was pleased with it.
Commissioner Franklin said the rezone should be encouraged.
Chairman Lambert stated that this item could go forward to the
Planning Commission on October 20, 1988 to initiate the zoning
code amendment.
Mr. Moore said that the Commission needs to make a motion
authorizing the Chairman to send a letter to the Butte County
Planning Commission to initiate code amendment actions and
recommend that the following zones be proposed and following
amendments be adopted.
Commissioner Lando said that he had no problems with the intent
but that he did have problems with the content.
Commissioner Lando said that staff should be aware that the,
Ordinance itself seems to have a filing fee in it. He said that
this makes it very difficult to change filing fees if the need to
ever update them or produce them.

Commissioner Lando said that the Ordinance needed to be in proper
format. He said that he had another concern with the height
restriction of 100 feet which should be related to the transition
zone or some type of meaningful relationship to the airport.
Mr. Moore said that in the Ordinance now, if one was going to
build or grow something within the overlay zone that is 100 feet
or taller, one would have to file a notice of intent. He said
that when the notice of intent is filed, it would be reviewed.
He said that the process is similar to the general plan
conformance report process and is strictly a staff review
process.
It was moved by Commissioner Lando, seconded by Commissioner
Franklin and unanimously carried to move for approval of the
cover page of said proposed code amendments with 3a as proposed,
delete 3b, move for approval as'amended of the proposed airport
zone and move for conceptual approval of the third document which
is Airport Overlay zone.
Chairman Lambert asked if this item would be heard at the
Planning Commission on October 20, 1988.
Mr. Moore said that this item would be placed on the Agenda as a
miscellaneous item, and that the Planning Commission would need
to make a motion initiating the project.
Commissioner Gerst questioned if the terminology could be
clarified under the non -conforming uses under definitions.

Staff said that the City has been working on their plan.
Wally Boness, City of Oroville, said that the City Selection
Committee has selected a consultant and that FAA is in the
process of reviewing the proposed agreement. He said as soon as
agreement is reviewed and Public Works received the agreement, it
will then be taken to Council with the recommendation. He said
hopefully this will happen next month. He said after this, it
would be about a 13 -month work plan with the consultant to come
up with the new master plan. He also said he would keep the
Commission informed.
Chairman Lambert requested that this item be brought back for the
January 1989 agenda.
5. Review of Pre -Application for Federal Assistance for Chico
Municipal Airport
Staff said that this information only item and does not require
and action to take place.
Commissioner Lando explained that the Airport Improvement
Program, City of Chico's entitlement airport. He said that the
program has worked out in conjunction with FAA and that they
actually tell the City of Chico they want to fund and what is
fundable. He said that they go back and.forth with the project
lists in combination with the City requests and their requests
which have to be approved and eligible.
The Commission briefly discussed the funding between State and
City.

Chairman Lambert said she was in support of the project because
the general plan designation and zoning is in place and that this
project is one of the last to be developed.
Staff said that a Planning Director's Report has been prepared
for the Advisory Agency hearing of August 15, 1988, and that
Condition No. 4 read "Grant an avigation easement to the
operators of the Ranchaero Airport to provide notice for future
owners that they may be subject to noise, dust and vibration from
airport operations.."
Commissioner Boness asked about the project being subject to
Environmental Review and if it was necessary to put it in the
motion.
Staff said that the Environmental -Review has been- completed on
the project, and that the Commission needs to make a
recommendation as to approval or denial of the project for the.
Advisory Agency so that they.can consider it when they hear it at
their meeting of August 15, 1988.

Staff said that they needed to get the Airport Zone squared away

they are working on a rezone in the south Paradise area and that
without the A -Z. zone being ready, staff recommendations are to
take it the Planning Commission with two options:
1. Zone the airport the same zoning that is in the
surrounding area; or

is an allowed use with a Use Permit.

and review their drafts.
Staff said that they would like to go through and review -the

forwarded a finding that the project might have a significant
impact on the air transportation in the area. Staff also said
that a statement had been made that similar projects had been
successfully mitigated by granting an avigation easement'to the
airport owner and that this type of mitigation measure would be
adequate in this case.
Commissioner'Lando asked in the applicant was willing to put an
avigation easement on the property.
Jim Stevens, NorthStar Engineering, representing Ron Caporale,
said that Mr. Caporale has agreed to an avigation easement.
Commissioner Franklin said that as long as there is an avigation
easement, he sees no.problem.
Commissioner Lando agreed with Commissioner Franklin.

VI. REFERRALS TO STAFF AND FORMATION OF COMMITTEES
Staff said that they had received a referral from Yuba County -
stating that they were in the process of adopting a General Plan
Amendment and Ordinance for,implementation of the Beale Air Force
Base Airport.Land Use Plan. Staff said that this does affect
Butte County somewhat in that some of their noise contours comes
up over the south County boundary in the Honcut area.
Staff said that they would carry the information forward onto the
noise element and mapping.
VII. CORRESPONDENCES
Brent Moore, Associate Planner, said that he had recently talked
to Senator Don Rogers and.that he had asked if this Commission
could put a letter together and send it to Assemblyman John
Vacconcellos, Chair of Assembly Ways & Means supporting Senate
Bill 263.
Mr. Moore said that Senate.Bill 263 has been amended. Mr. Moore
reported Senate Bill 263 amendment has changed the existing law
for ALUC's. ALUC's will be the primary agency to deal with noise
problems at airports under Senate Bill 263. He said that another
way the Bill has changed is that the large sums of money will not
be appropriated this fiscal year. He said that this year they
would appropriate only enough money to start the procedural

mechanism rolling and in subsequent years, the funding for
airport capital improvements would.come.
Mr. Moore read the letter that staff had previously prepared and
recommended this Commission support Senate Bill 263 and sign the
letter.

Commissioner Lando said that he was after local control. He said
that he felt that funding should be for improvements and not for
planning. He said that he feels this Commission should not be in
a position to have to tell the County or Cities that they have to
make major expenditures of funds or effect the operation of their
airport because of noise problems.
Mr. Moore said that the Bill will fund ALUC's directly and that
ALUC's will then be solely responsible to abate noise problems at
airports.
It was moved by Commissioner Lando, seconded by Commissioner
Franklin and unanimously carried to be in support .of letter being
sent in support of the Rogers Bill, Senate Bill 263.
Commissioner Stevens asked why it was determined this year to not
fund all the money, but appropriate a portion of it, and where is
the rest going? l
Mr. Moore said the remainder of the money is put back into the
general fund. He said the money from jet fuel taxes are normally
put into this fund. He said that this year the jet fuel taxes
will add close to one hundred million to the State's general
fund. He said from that one hundred million, the bill would
appropriate a little over one million to begin the program. He
said that once the program begins, there will be a maximum of 2
percent of the funding that will go to Planning purposes and
preparing the Regional Aviation System Plan, California Aviation
System Plan and the Capitol Improvement Programs for all airports
in the state. He said that 98 percent of the funding has to go
directly to improvement of airports.
Commissioner Stevens asked if this would be a one-time project
where they are not going to allocate all funds.
Mr. Moore said yes.
Commissioner Franklin asked if they were going to allow funding
to public use - privately owned airports.
Mr. Moore said he was not sure. He said that another private
airport was going under and decided to contract with their
County, the'County then got funding to keep the airport in

business'.
Mr. Moore said that FAA is making,an agreement to fund certain
portions of Planning that will have to take place to implement
the Bill, if the Bill passes, there will be an opportunity to go
after FAA funding.

Chairman Lambert asked if each County had an Airport*Land Use
Commission.
Mr. Moore said that not every County had one, but that every
County that has a scheduled airline is required by law to have
one or a body that acts as one.

Staff said that James Hanna has been named by the City Selection
Committee to replace Commissioner Dave Stephens position. Staff
also said that Commissioner Dennis Harvey will be resigning as of
November, and in the mean time Commissioner Wally Boness will be

Chairman Lambert discussed making an amendment to the Ranchaero
Land Use Plan that would recognize the existing higher densities
to the north of the Ranchaero Airport.,
There was a brief discussion.
Chairman Lambert asked about an avigation easement.
Staff stated that basically the avigation easement covers noise,
safety and building heights.
Henry Roberson, Manager of.Ranchaero Airport, stated that he was
not in opposition to the development because there are other
developments.already in place that are closer to the end of the
runways. He said. that avigation easements should be considered
and that he hopes the Commission is aware that each development
does have an effect on the airport.
Chairman Lambert stated that the Commission needs to make a
strong statement in the Ranchaero Plan that the Commission's
intent is to not go beyond Glenwood and that they have made a
modification of the flight pattern to help mitigate developers

that are bound to be approved because of the zoning and general
plan that has been previously approved.
Commissioner Stevens said that . she opposes the project
development.
Commissioner Gerst asked if there was anything documented in
deeds that people are subject to noise, etc.
Staff said that the recordation of avigation easement serves as a
document in a title report.
Commissioner Gerst said that he agreed with Mr. Roberson!s
comments and that if this development is an impact to the
Airport, in which it is, it just compounds and that he could not
support the development at this time.
Chairman Lambert asked what the time line schedule was with the
Advisory Agency on this map.
Staff briefly discussed the time line schedule and said that a
months delay could create a problem and that the Commission ask
that this project not go forward until such time a decision is
made regarding the potential impact.
Staff said that the Commission would not be approving or denying
this project, but that they are recommending or suggesting.
Staff also said that if the Commission is going to delay this
project for further study, the.Environmental Branch should be
notified of direction to what is happening and -why.
It was moved by Commissioner Stevens, seconded by Commissioner
Boness and unanimously, carried to ,find that- there might be
potential impacts to the Airport that should be addressed in the
enviornmental documents and recommend that an avigation easement
be granted to the owner of the Ranchaero Airport and that a
decision on the recommendation as to whether the project should

Commissioner Walter mentioned that he and Commissioner Lambert have
not gotten together to review the draft, and asked if anyone on the
ALUC Commission had any comments.
Chairman Lando said that he did review the draft and that he would
like to see the wide range of industrial uses be allowed under Use
Permits, and make sure that "Special Provisions" be a standard.

1_ Public Hearinn - Ranchaero Airport Environs Plan
Mr. Hironimus summarized the draft plan review process. The hearing
was opened to the public. 'No one was present to speak to this item.
The hearing was closed to -the 'public.
Commissioner Walter asked, with regard to the statement on Page 14
relating to acquisition of clear zones, if any action is being -taken.
Mr.-Hironimus replied that this is a contingency for the 20 -year life'
expectancy of the plan, and that such actio_ns'aren't appropriate at
the present time.
Commissioner Lambert asked if avigation easements are acquired at
present; Mr. Hironimus said yes, in conjunction with current
developments. ,
Commissioner Walter asked if avigation easements are currently -in
place at the north end of the airport, where some people have
registered protests. Mr. Hironimus referred to the map posted on the
wall showing the present locations of subdivisions and orchards,
adding that Greenline policies indicate the retention of the orchards
as an agricultural use. Commissioner Walter expressed concern about
the urban areas. Mr. Hironimus said that avigation easements are
obtained at the time of development; however, with presently -developed

land, it's difficult to go back and pick them up. The new Zoning Code
currently under consideration would include overlay zones, and the
-Airport Environs overlay zone would address avigationjeasements.
Chairman Lando asked about the "C2" which appears in the third
paragraph on Page 14. Mr. Hironimus said he thought this might be a
typographical error and said he would take a look at it.
Commissioner Lambert suggested that the table which begins on Page 16
could be made more user-friendly, and Mr. Hironimus said he would
re -work it.
Mr. Hironimus introduced Brent Moore to the Commission. Mr. Moore
told the Commission about his background and experience in planning
and his emphasis in airport -related issues, including the drafting of
the Aviation Improvement Act (SB 263).
It was moved by Commissioner Lambert, seconded by Commissioner Walter
and unanimously carried, as follows:
A. Find that the requirements of CEOA have been completed and
considered in making this decision and adopt a Negative
Declaration; and
B. Find that the draft Ranchaero Airport Environs Land Use Plan meets
the requirements•of California Public Utilities Code Section
21675; and
C. Adopt the Ranchaero Airport Environs Land Use Plan pursuant to
Public Utilities Code Sections 21674 and 21675, and including the
revisions requested at this meeting.
2. Status Report - Paradise Airport Environs
Mr. Hironimus said there have'been no changes in the Town's prezoning
at this point, so there is nothing new to report.
3. Commercial Airport Zoning - Discussion
Mr. Hironimus said that with Airport Land Use Plans now adopted for
all four public -use airports, ALUC could ask the Planning Commission
to adopt a Commercial Airport zoning district, to facilitate these
airports' operations. Ranchaero, for instance, is an existing
nonconforming use under its present zoning.
Commissioner Lambert asked if this proposed zone is being discussed
today; Mr. Hironimus said the actual discussion should be conducted by
the Planning Commission and Board of Supervisors and that ALUC should
simply say such a zone is needed.
Commissioner Walter commented that at the present time the County's
zoning code is being simplified and many zones are being eliminated.
With a special zone for airports, should there also be a zone for
hospitals, schools, etc.? Mr. Hironimus suggested that perhaps the PO
Zone could be modified to include airport uses.

Chairman Lando said the zoning should allow airport -related uses such
as fixed -base operators,'related offices, restaurants and the like.
It was moved by Commissioner Lambert, seconded by Commissioner Stevens
and unanimously carried, to recommend that the Butte County Planning
Commission initiate zoning for the Paradise and Ranchaero Airports.
Henry Roberson stated he wants to expand Ranchaero's operations to
.include compatible businesses and wanted to know if he should make
application to ALUC. Chairman Lando suggested he write to the
Planning Commission in support of the motion just passed by ALUC.
4. SB 263 - Discussion

Brent Moore said the bill passed the Senate two weeks ago. Opposition
came from the larger metropolitan areas, so the bill was changed
somewhat; however, locals still do gain some autonomy. The bill calls
for a new process to plan for and establish the need for airports.
There is virtually no input at the local level, so one of the bill's
aims is to improve this.
Taking jet fuel taxes from the State's general fund would yield $110
million per year "in a good year" and this money would be earmarked
for airports. Every airport would receive $10,000 per year, plus
there would be funding for ALUCs statewide, a total of 1.5 million for
the entire state.
Metropolitan Planning Organizations or Councils of Governments would
be funded for the preparation of Regional Aviation System Plans and
would work with the ALUCs in developing these plans. Included would
be a ten-year capital improvement plan for all airports in the County.
Then, a statewide plan which coordinates these county plans would be
done, and hearings would be conducted before the California
Transportation Commission prior to allocations being made to the
airports. Another benefit of this bill is it should help the State
stay within its Gann spending limit.
Chairman Lando asked what the effect would be on the County's general
fund. Mr. Moore said only the State's share of jet fuel sales tax is
affected.
Commissioner Lambert asked, does the money go to the Counties? Mr.
Moore said it would go to the ALUCs. Then, each ALUC, through
participation in the Overall Work Program, would establish its own
goals.
Commissioner Lambert asked when the Overall Work Program is submitted,
Mr. Moore said sometime in March. This ALUC's first opportunity to
participate would be in Marchlof 1989.
Chairman Lando asked if Butte would receive much funding; Mr. Moore
said Butte should be competitive since he himself had written the bill
and feels we have "the inside edge."

Commissioner Walter asked if this only applies to jet fuel; Mr. Moore
said non -jet fuel taxes are already going into an aviation account.
Jet fuel is the least political vehicle; ad valorem taxes, for
example, meet with heavy opposition.
Mr. Moore said he anticipates that there should be good Assembly
support for this bill, and the Governor's office likes it.
Commissioner Lambert pointed out that $10,000 per year would be double
what the city airports presently receive. Mr. Moore added that with
the ten-year capital improvement plan,ia year is added each year (and
a year dropped) .
Commissioner Walter wondered how this would mesh With the Regional
Transportation Plan; Mr. Moore said the RTP is supposed to,have an
aviation section in it.
Mr. Hironimus asked about public vs. private airports; Mr. Moore said
the original bill would have funded private airports as well, but it's
hard to avoid making a gift of public funds so special stipulations
would have to be in place. In order to be funded, airports must be in
the plan and documented, and be included within the regional system
plan as well.
Commissioner Lambert asked if a letter of support would be helpful;
Mr. Moore said yes, to Senator Neilsen and Assemblymember Chandler.
It was the consensus of the Commission .to have Mr. Hironimus prepare
the 'letters.
5. Chico Municipal Airport Environs Plan - Discussion
Mr. Hironimus said the plan is ten years old now and needs updating;
he directed the Commission's attention to the review prepared by Mr.
Moore and included in the packets for today's meeting.
Chairman Lando asked how the process will work; Mr. Hironimus
suggested the formation of an ALUC committee, adding that if SB 263
passes all of our plans will need to be extensively revised but that
funding would then be available to staff these projects. Chairman
Lando expressed his interest in serving on the committee.
Mr. Moore suggested that the committee should develop a concise and
orderly public -participation program.
Chairman Lando asked for volunteers. Commissioner Stephens, not
present at today's meeting, was suggested as a possible member; also
Brent Moore as a staff member.
6. City Referrals of Airport -related Projects - Discussion
Mr. Hironimus said that PUC Section 21676 (a,b,c) requires that
cities' General Plan Amendments, zoning ordinances or building
regulations within airport planning boundaries must be referred to the
ALUC. At present, cities have requested ALUC's input because they
want it, but this is voluntary -on the part of the cities.

Chairman Lando asked if this includes building codes; Mr. Hironimus
said yes, insofar as they relate to height limits, coverage
requirements, etc.
Commissioner Lambert commented that the City of Oroville's General
Plan is not in conformance with the adopted Airport Land Use Plan.
Mr. Hironimus said it may be out of conformance, In light of the
City's recent action to change its runway thresholds.
Commissioner Lambert suggested that projects could be referred to ALUC
until all the cities' General Plans are in conformance, adding that
ALUC should still require the 4/5 vote by a city to override, along
with appropriate findings for overriding.
Chairman Lando said he'd like to see a modified process, so that ALUC
doesn't become another layer of government. He suggested that staff
could make the determination as to whether ALUC needs to review a
particular project. He asked if a motion would be in order. Mr.
Hironimus said a policy statement could.come out of the Commission,
giving staff the authority to review projects. Commissioner Stevens
asked if staff would prepare the proposed policy change. Chairman
Lando requested this be placed on the March meeting agenda.

Dave Hironimus said that the initial study has been completed and is
going through the Clearinghouse for review. He said that the review,
ends January 20, 1988 and that he anticipates the project clearing the
Clearinghouse without any ma,jor.comments to be addressed and -'plans to
publish the project so that it could be heard at the February meeting.
He said that if there were any items that would have to. be addressed,
the hearing could be continued if necessary. He said that he would
work on a mailing list and then publish accordingly. Dave said that
once the plan is adopted, the Commission could work at getting the
appropriate zoning on the'airport property.

Dave Hironimis said that once the Ranchaero Plan is adopted, he is
intending to set up the zoning for the airport property for both
Ranchaero and Paradise at the same time. He said he would like to

meeting to recommend such an'action to the Planning Commission and
that this Commission may,not want to take action pending the outcome
of Ranchaero Airport.
2_ Status Report - Paradise Airport Environs
Dave Hironimus said that he had been in contact with Steve,Smi.th from
the Town of Paradise, and that he said the prezone south of Paradise
is on hold. He said that they will wait for the code amendment to,go
through for the county zoning before applying height restriction in
the form.of an overlay.zone. Specific zoning for the airport property
will take place at the same time as Ranchaero Airport zoning.
3. Business from the Floor
The Commission requested that staff Put the following items on the
agenda for the February meeting.
1. Form a Committee for review of the Chico Municipal Airport

V. BUSINESS
1. Status Report - Ranchaero Airport Land Use Plan
Dave Hironimus stated he plans to have the initi•al,study for the
Ranchaero Airport Land Use Plan ready for typing possibly today.
2. Status Report - Paradise Airport•Environs
Dave Hironimus stated that there was nothing new,to'report on the
Paradise Airport Environs. He stated that staff'is still waiting for
any actions from'the Town of Paradise on their Prezone which is in the
same area.
3. Status Report - Oroville'Airport Environs
Dave Hironimus stated that the Orovil-le Airport General Plan does not
match the County's Airport Land Use Plan and that under the Public
Utilities Code, Section 21676.5, the Commission could require the City
to forward all development plans, permits, etc., to this Commission
for review until such time their General Plan is brought into
conformity with the Airport Land Use Plan. He stated that this.has
not been done in the past because they have been trying to get things

worked out. He stated that at this point the City has been referring
their projects to this Commission. He stated that basically as a
responsible agency under CEOA, this Commission has been commenting
accordingly, and that the findings that have been made really have no
effect other than comments from a responsible agency. He stated that
under Section 21676, if the Commission requires the City to forward
their plans, the Commission has a situation of the City choosing
whether override to the ALUC decision by a four-fifths vote.
Chairman Lando stated that he does not object and that he feels the
Commission should reinforce their concerns regarding the Oroville
Airport. He stated that he felt it was the Commission's job to push
all airport plans and that the Commission should again indicate their
concern and point out the sections of the Code.
Dave Hironimus confirmed that the Commission should then ask the City
to forward projects for comments but not take it to the next step for
overruling findings.
Commissioner Walter briefly discussed the relocation of the airport
runway thresholds.
4. Review of Use Permit for Aztec Development, AP#030-23-0-139,140
Dave Hironimus stated that most of the Commission's concerns were
related to the clear zones and really the Commission has to review
noise impacts, security considerations and avigation easement grants.
Gerry DeRoco stated that he would like to see applicants receive
notices of hearings. He stated that he understood that the approach
zones will basically have the same requirements.
Dave Hironimus stated that projects in an approach zone might run into
a building height problem, but there are not the same restrictions in
terms of development standards as there are in clear zones. He stated
that this project would be going into a Safety Area 1 instead of a
Safety Area 2.
Chairman Lando questioned what exactly was the Use Permit for.
Dave Hironimus stated that Aztec Development applied for a Use Permit
for a return to custody facility. He also stated that at the
September meeting, the finding was made that it had appeared the
project would be in conformity with the plan, but that no final
finding was going to be made until such time as the Commission had all
information from a Use Permit application, which had not been made at
that time. He stated that the Commission received the information
from the City in time for the November meeting and that it was heard
at that point. He stated that a motion of intent was adopted, but
that no findings were formally made, and that information was
submitted to the City. He stated that the item was continued to the
December meeting, and since that time, changes in the threshold
positioning had taken place, so the original motion of intent is no
longer appropriate. He stated that the Commission is looking at the
recommendation staff has prepared.

Chairman Lando stated he felt that staff reports.should be mailed to
all applicants. ,
It was moved by Commissioner Walter, seconded by Commissioner Franklin
and unanimously carried to find that the proposed Use Permit for Aztec
Development conforms to the policies of the Oroville Airport Land Use
Plan and recommend that any City approval be made conditional upon the
following:
1. Noi,se impacts should be addressed in the environmental documents
and a survey of the site performed to'determine what building
construction standards should be required.
2. Security'considerations should be'addressed in the event of
aircraft incident or accident on the property and the availability
and response capabilities of emergency services on the property.
3. Grant an avigation easement to the City of Oroville.
5. Review of Use Permit -for Paul-Farris.-AP#030-21-1-26
Commissioner Roberson asked how long a time is allowed for temporary
second dwellings.
Dave HM-ronimus stated that they were.open-ended and that the County's
procedure is that they allow a mobile home as a temporary second
dwelling`,for people who require close care. He stated that this kind
of project is put through the Use Permit process, and that there is a
requirement, when the second unit is no longer needed, that it be
removed from the property or converted into a non-residential use. He
stated that there is a requirement.for a bond or deposit to guarantee
the removal of,the second dwelling unit.

It was moved by Commissioner Walter, seconded by Commissioner Franklin 7
and unanimously carried to,find that,.although the project will result
in densities greater than those recommended by the Oroville Airport
Environs Land Use Plan, the -use will be temporary and will not be
overly exposed to aircraft hazards due to the existence of substantial
open space nearby, most notably the Oroville Wildlife Area
approximately 1/8 mile to the southeast.
6. Review of School Site in the Ranchaero Area
Dave Hironimus stated that the proposed school site is out of the
traffic patterns and is within one mile of the airport.
There was a brief discussion on school sites and how far they should
be away from airports. ,
Chairman Lando stated that he was sympathetic with a school at that
site.
It was moved by Commissioner Walter, seconded by Commissioner Franklin
and carried to -find the proposed school site -conforms to the policies
of the draft Ranchaero Airport Environs Land Use Plan as follows:

7. Review of Rezone for Drake/Jeffries. AP#048-02-0-049
Chairman Lando stated that this Rezone was a request to change the
designation of the property from Limited Manufacturing Industrial Park
to Limited Manufacturing with the same conditions. He stated that he
did not see any substantial change in the proposed use.
Dave Hironimus briefly discussed the location of the project. He
stated that the Commission would not like to see large concentrations
of people in the flight corridor area, but that he suspects that the
City will limit that problem because of setbacks from the creek and
other factors.
There was a brief discussion on the location and flight. corridor area.
It was moved by Commissioner Franklin, seconded by'Commissioner Walter
and unanimously•carried to find the proposed rezone compatible with
the Airport Env -irons Land Use Plan only if the project is conditioned
so that no storage of inflammables or .other dangerous materials, or
large concentrations of people are allowed under the flight corridor
as a result of subsequent development. '
8. Review of Prezone for Rick Coletti AP#048-03-3-010
Dave Hironimus stated that this project was just barely under the
edges of the pri.m'ary surface for review and that it was sent for
review by the City of Chico.
It was moved by Commissioner Walter, seconded by Franklin and
unanimously carried to find the proposed prezone in conformity with
the Airport Environs Plan only if development of the property is no
greater than six dwelling units per acre.
9. Election of Second Vice Chairman
Criteria for Second Vice Chairman were discussed, and since
Commissioner Stevens was the only Commissioner that met the criteria,
she was elected by acclamation.

Dave Hironimus handed out a copy of the.Public Utilities Code, and
stated that the new Legislation has been adopted. He stated that he
talked with the people of Division of Aeronautics and that they stated
there are no changes in the form, except that it does not have
-adopti,on dates or effective dates, and that'it will become effective
at the first of the year. He stated -that the biggest effect was that
the appointees by the Airport Managers' Association are now required
to have expertise in aviation. He stated that there was still -no,
requirement for the alternatives to have that same expertise.
