WHEREAS, the Legislature has established the Sustainable Agricultural Lands Conservation . Program within the Department of Conservation, and through a grant program is providing assistance to conserve important agricultural land resources that are subject to conversion pressures; and WHEREAS, the NORTHERN CALIFORNIA LAND TRUST intends to Purchase an agricultural conservation easement for a price based on its fair market value as determined by a qualified appraiser. The property consists of approximately 2,480 acres of land located approximately 2.2 miles north-northeast of the City of Chico Sphere of Influence for the purpose of conserving priority agricultural rangelands and related resource values; and WHEREAS, the Butte County Board of Supervisors approves the easement proposal and certifies that the easement proposal meets the eligibility criteria set forth in Public Resources Code Section 10251, to wit: (a) The parcel proposed for conservation is expected to continue to be used for, and is large enough to sustain, commercial agricultural production. The land is also in an area that possesses the necessary market, infrastructure, and agricultural support services, and the surrounding parcel sizes and land uses will support long-term commercial agricultural production. An agricultural conservation ease- ment protects and limits the use of the land for agricultural purposes. The 5,545 acre easement wil insure that in perpetuity this land will be preserved for agricultural uses. FORM NO PLG -04 Sign permit applications provide Butte County officials with an opportunity to review and determine whether a proposed sign will meet County sign regulations found in Butte County Zoning Code. Sign regulations are intended to appropriately limit the type, size, height, placement and design of signs to ensure that the scenic qualities of the County are preserved, and to minimize potential hazards caused by distracting signs, while also promoting favorable economic and business conditions Signs include any device, structure or fixture designed or used to attract attention to an object, person, institution, business, product, service, event, or location by any means, including words, letters, figures, designs symbols, fixtures, colors, illumination, or projected images. There are a wide range of signs types that could be used display a message that may not require a permit, such as directional signs, garage sale signs and temporary signs, among others. To determine whether a sign may or may not require a permit, please contact the Butte County Development Services Department. Most signs that require a permit will typically require a building permit prior to installation to address structural issues. The applicant is responsible for obtaining a building permit from the Butte County Building Division. Please contact Building staff to discuss the building permit review process, and to determine what materials and fees will be required. APPLICATION SUBMITTAL REQUIREMENTS The following information is required for a complete application. The applicant should discuss the application submittal requirements with Planning Division staff prior to submittal. Include the following information: ❑ Name of property owner. ❑ Location of the subject property, including Assessor Parcel Numbers and site address (if assigned). ❑ Name of site plan preparer and date. ❑ General Plan and Zoning designations. ❑ Size of property including gross & net lot area (square feet and acres). ❑ Property Boundaries. Show existing and proposed property lines with dimensions; right -of. -ways and easements with the noted size, type and sufficient recording data to identify the conveyance (book and page of official records). ❑ Buildings and Setbacks. Location of the proposed and existing signs, as well as the locations, dimensions and use of all existing structures on the property, including decks, sheds, and carports. Plans shall be drawn to scale with dimensions, total sign area, colors, materials, sign copy, font styles, illumination method, and any other details for all proposed signs. REVIEW FOR COMPLETENESS Once an application for an administrative permit has been submitted and fees collected, staff will perform an initial application review for completeness within the first 10 days following submittal. Should the application be found incomplete, the applicant or designated agent will be contacted and advised on what additional items must be submitted before processing may continue. As part of the review, staff may refer the application to any public agency that may have an interest in the proposed project. Requests for additional information by these agencies will cause the application to be deemed incomplete. 2 of 4 ENVIRONMENTAL REVIEW Signs that require approval by the Zoning Administrator are considered a ministerial project which would, in most cases, be exempt from the California Environmental Quality Act (CEQA) review process. Freeway, freestanding, and off-site signs adjacent to residential zones require approval of a Conditional Use Permit by the Planning Commission and are considered a discretionary action, subject to CEQA. Staff will review your application to determine if the project is statutorily or categorically exempt from CEQA, or if further environmental review is required. If the project is not exempt from CEQA, then an initial study will be prepared. DECISION/DETERMINATION The Zoning Administrator will review and approve most permit applications, if it's found to be in compliance with the requirements of the County's Sign Ordinance. If the proposed sign is required to go before the Planning Commission for review, the decision will be discretionary and may be approved, approved with conditions, or denied. A decision by Zoning Administrator will generally be made within 30 days following the determination of a complete application. If the application is brought before the Planning Commission, a decision could be made in 90 days. APPEAL Any decision by the Zoning Administrator may be appealed to the Planning Commission, whereas, a decision by the Planning Commission may be appealed to the County Board of Supervisors. SUMMARY The Northern California Regional Land Trust (NCRLT) requests a resolution of support from the Board of Supervisors for its application to acquire agricultural conservation easements on approximately 2,480 acres of land located about 2.1 miles north-northeast of the City of Chico Sphere of Influence along the Butte -Tehama County line, off Cohasset Road; APNs 047-210-003, -004, -007, .-008, 70.10, & -01.1, 056- 020-002 & -019, and 047-230-085. Figures 1 and 2 depict affected Butte County parcels. The proposed resolution includes Board findings necessary for the NCRLT to submit a grant application to the California Department of Conservation's Sustainable Agricultural Lands Conservation Program (SALCP) to pursue acquisition of the Agricultural Conservation Easements (ACEs). Table A, shown below, provides summary information for the property on which ACEs are proposed in Butte_ and Tefi6 ia' - counties. With the ACEs, conserved lands would continue to be grazed while preventing agricultural uses and - development that would impair the ranch's agricultural, biological, and cultural resources. -Allowed uses - include: cattle grazing and associated standard practices (e.g., customary ..fencing,- maintenance_of associated infrastructure, etc); hunting, camping, and outdoor recreation; and limited non-residential- - development within two building envelopes of two -acres each. 1 f Disallowed uses in the ACEs include: residential development, large-scale solar development, and the clearing of native woody vegetation and intensification to non -grazing agricultural uses. The viability of" conversion to more intensive agricultural uses for the subject properties appears marginal due to cemented bedrock and lack of suitable soils. BACKGROUND / SETTING _ Garner and Rose Ranches ' - "'NCRLT seeks to acquire ACEs on two ranches within the Uppne Creek Watershed, located in northern Butte County and southern Tehama County. The Q"Wer Ranch is located mostly in Butte County, with about 2,480 acres of the 3, 58 -acre ranch in Butte County. The approximately 5,586 -acre Rose Ranch is adjacent to Gamier Ranch, and is located entirely within Tehama County. One of the roles of the LCA Committee is to make recommendations on the local policy for administering the Williamson Act program. Mostly, the discussion at the Committee has been in its role for recommendation if a new contract is proposed on lands within an existing conservation easement. In the future, the Land Conservation Act Committee may prepare a recommendation to the Board of Supervisors either as a single topic or as part of„an update to the Policy, Procedures and Rules document currently dated 2007. Development Services considers any potential recommendation of the LCA Committee to be separate from the recommendation of this request. Parcel acreages are from Tehama County GIS and subtotals are from NCRLT resulting in parcel acreages that do not total exactly. • 0 The project is being undertaken in partnership with seven funding entities: • California Department of Conservation and California Strategic Growth Council's Sustainable Agricultural Land Conservation Program (SALCP); • US Department of Agriculture Natural Resource Conservation Service's Agricultural Conservation Easement Program (ACEP) _ California.Wildlife Conservation Board; California Department of Fish and Wildlife; • California Wildlife Foundation; • Joseph & Vera Long Foundation; and • Arthur & Elaine V Johnson Foundation. The project is also supported by the Sierra Nevada Conservancy, Sierra Nevada Brewery, various private sector partners, and individual community members. Agriculture Land Use Designation and Zoning The Butte County General Plan designates the subject parcels, Agriculture. They are zoned AG - 160 (Agriculture —160 -acre minimum parcel size). The State Department of Conservation's Important Farmland Map shows the property as Grazing Land, and soils are classified as Class VII. Class VII soils have very severe limitations that make them unsuited.to cultivation and that restrict their use mainly to grazing, forestland, or wildlife. The subject properties are within a Williamson Act contract. Butte Regional Conservation Plan The public draft Butte Regional Conservation Plan, or ERCP, (Figure 3-12 Distribution of Land Cover Types in the Plan Area, and Figure 3-14 Distribution of the Grassland Natural Community in the Plan Area), shows the project site as being within the Cascade Foothills Conservation Acquisition Zone (CAZ) and as containing grassland with verna swa a comp ex. Therefore, the Garner Ranch conservation area is not within the urban landcover type used for impact analysis in preparing the BRCP, nor is it located in one of the BRCP's 11 Urban Permit Areas. The BRCP assumes use of the project site consistent with the Butte County General Plan, which designates the property for agricultural use. The proposed BRCP (Figure 4-16 Grassland: Direct Impacts of Covered Activities) shows the site as remaining in Grassland or Grassland with Vernal Swale Complex. The BRCP (Figures 4-21 to 4-52) also notes the potential for several special -status species at the project site, including: • tricolored blackbirds (breeding & foraging habitat), • western burrowing owls (nesting & foraging habitat), • American peregrine falcon (seasonal foraging habitat), • Swainson's hawk (foraging habitat), • white-tailed kite (year-round foraging habitat), • bald eagle (seasonal foraging habitat), • western pond turtle (nesting and moving habitat), western spadefoot toad (breeding & upland habitat), • vernal pool tadpole shrimp (recovery core area), 3 . vernal pool fairy shrimp, (recovery core area)-,— Hoover's rea); Hoover's spurge (recovery core area), �, ,~• , •' red bluff dwarf rush, • Butte County meadowfoam (primary habitat), • Hairy Orcutt grass (recovery core area), ; -. The BRCP,(Figure 5-2) shows existing protected lands in the vicinity of the project•site. Figure 5 • e 4• displays ecological corridors which will be protected under the ERCP, including the North Plan' Area Corridor in which the project is situated. ' ANALYSIS Findings Requested in Support of the Agricultural Easement `NCRLT requests that the Board adopt findings consistent with Public Resources Code section ' 10251 in support of the Agricultural Easement, which states: ' 10251. Applicants for an agricultural easement or fee acquisition grant shall meet all of the following eligibility criteria: (a) The parcel proposed for conservation is expected to continue to be used for, and is large enough to sustain, commercial agricultural production. The land is also in an area that possesses the necessary market, infrastructure, and agricultural, support services, and the surrounding parcel sizes and land uses will support s ' long-term commercial agricultural production. - ' (b) The applicable city or county has a general plan that demonstrates a long-term commitment to agricultural land conservation. This commitment shall be reflected in the goals, objectives, policies, and implementation measures of the • plan, as they relate to the area of the county or city where the easement acquisition ' is proposed. - (c) Without conservation, the land proposed for protection is likely to be converted to nonagricultural uses (emphasis added). t ' . Summary of Proposed Findings Proposed Resolution The proposed resolution includes the following facts in support of the agricultural easement: ; 1. The project site supports long-term commercial agricultural production. The parcel proposed for conservation is expected to continue to be used for, and'is -large - enough to sustain, commercial grazing. The land is also in an area that possesses the necessary market, infrastructure, and agricultural support services, and the surrounding parcel sizes and land uses support long-term commercial grazing. .. .. _ • ' _ The subject -property is located outside of -the City of Chico's Sphere of Influence, within an unincorporated portion of northern Butte County characterized by grazing land. The property has been a working ranch for well over 80 years; cattle have been grazed onsite for the majority of this time. The landowners desire to maintain the property as a working ranch. The 2,480 -acre property is enrolled in the Williamson Act program and is large enough to support continued commercial grazing. Water supply at the ranch is comprised qfriparian water rights, springs (improved & unimproved), agricultural wells with associated distribution lines, and stockponds. The subject property and properties to the east and west are designated Agriculture and zoned AG -160 (Agriculture 160 -acre minimum parcel size) for agricultural use. Land to the south, south of Cohasset Road, is designated Foothill Residential and zoned FR -40 (Foothill Residential, 40 -acre minimum). Land to the north is within Tehama County; it is designated Upland Agriculture by the Tehama General Plan and zoned A-1 (160 -acre minimum). Therefore, surrounding parcel sizes and uses are consistent with commercial agriculture. 2. The County supports long-term commercial agricultural production at the subject site. Butte County has adopted a General Plan that demonstrates a long-term commitment to agricultural land conservation. This commitment is reflected in the goals, objectives, policies, and implementation measures of the plan, as they relate to northern Butte County in general and the project area in particular. The Butte County General Plan 2030 Agricultural Element includes numerous goals and policies in support of agriculture in Butte County, including Goal AG4 to "Protect, maintain, promote and enhance Butte County's agriculture uses and resources, a major source of food, employment and income in Butte County, " Goal AG -2 to "Protect Butte County's agricultural lands from conversion to non-agricultural uses, " and Policy AG - P2.2 which states, "The County supports private conservation organizations that utilize voluntary agricultural easements as a tool for agricultural conservation, continued agricultural use, agricultural supportive uses, tax breaks, and similar goals." The property is designated as Agriculture by the County's General Plan Land Use Map and the property is zoned AG -160 by the County's official zoning map, adopted November 6, 2012. The previous General Plan and zoning designations for this property also refected agricultural land uses. 3. Without conservation, the land proposed for protection is likely to be converted to nonagricultural uses. If the project were removed from the California Land Conservation Act (CLCA, or "Williamson Act'), the subject property could be divided and developed at a densityof two dwelling units per legal parcel (a total of 18 dwelling units plus accessory structures),_ or 5 more intensive agriculture involving deep ripping of vernal wetlands. The parcels current enrollment in the Williamson Act is voluntary. Land owners under Williamson Act contract can choose to non -renew their parcels, in which case the land will no longer be covered by the provisions of the Williamson Act in nine (9) years. Alternatively, a land owner can choose to withdraw from the Williamson Act, in which case tax -related penalties typically apply and land is released from the Williamson Act contract in the short-term. Residential uses and relatively small agriculturally -zoned parcels are located in proximity to the subject site. Rural residential homes, on parcels approximately 1 + acre in size, are located along Cohasset and Sycamore Valley Roads, near the southern boundary of the subject property. Foothill residential homes, on parcels approximately twenty -acre parcels in size are located approximately 1.5 miles to the east of the subject parcel. These small parcels in the immediate vicinity of the subject parcel, both rural and foothill residential homes, have resulted in loss of grazing land and increased development pressure on lands in the vicinity to be re -designated and subdivided in the future. The . existing General Plan designation of Agriculture and AG -160 zoning encourages continued agricultural operations, the adjacency of this land to the existing rural and foothill residential development is acknowledged. The agricultural easement supports economic viability of agricultural operations on the property by conserving agricultural land at an economically viable scale. An agricultural easement on the subject parcel -could substantially influence whether the subject property converts to rural or foothill residential uses, like the land use pattern to the south and east, or whether it remains in commercial agriculture, like parcels to the north and west. The proposed agricultural easement would preserve historic grazing uses on the subject parcel and preclude development outside of two homesite areas, two -acres each. Consistent with vernal resources on site, deep ripping of soils is also precluded by the agricultural easement. Figure 1. The property is designated as Agriculture by the County's General Plan Land Use Map and the property is zoned AG -160 by the County's official zoning map, adopted November 6, 2012. The previous General Plan and zoning "designations for this property also reflected agricultural land uses. 3. Without conservation, the land proposed for protection . is likely to be converted to. non-. agricultural uses: If the project were removed from the California Land Conservation Act (CLCA, or "Williamson Act"), the subject property could be divided and developed at a densityy of two dwelling units per legal parcel (a total of 18 dwelling units plus accessory structures), or more intensive agriculture involving deep ripping of vernal wetlands. The parcels current enrollment in the Williamson Act is 0 0 voluntary. Land owners -under Williamson Act contract can choose to non -renew their parcels, in which case the land will no longer be covered by the provisions of the Williamson Act in nine (9) years. Alternatively, a land owner can choose to withdraw from the Williamson Act, in which case tax -related penalties typically apply and land is released from the Williamson Act contract in the short-term. Residential uses and relatively small agriculturally -zoned parcels are located in proximity to the subject site. Rural residential homes, on parcels approximately 1+ acre in size, are located along Cohasset and Sycamore Valley Roads, near the southern boundary of the subject property. Foothill residential homes, on parcels approximately twenty -acre parcels in size are located approximately 1.5 miles to the east of the subject parcel. These small parcels in the immediate vicinity of the subject parcel, both rural and foothill residential homes, have resulted in loss of grazing land and increased development pressure on . lands in the vicinity to be re -designated and subdivided in the future. The existing General Plan designation of Agriculture and AG -160 zoning encourages continued agricultural operations, the adjacency of this land to the existing rural and foothill residential development is acknowledged. The agricultural easement supports economic viability of agricultural operations on the property by conserving agricultural land at an economically viable scale. An agricultural easement on the subject parcel could substantially influence whether the subject property converts to rural or foothill residential uses, like the land use pattern to the south and east, or whether it remains in commercial agriculture, like parcels to the north and west. The proposed agricultural easement would preserve historic grazing uses on the subject parcel and preclude development outside of two homesite areas, two -acres each.. Consistent with vernal resources on site, deep ripping of soils is also precluded by the agricultural easement..,.
