Re:Sandy Beach Recreation Improvements at Poe Dam
Dear Mr. Cruzen:
This is in response to a letter dated May 7, 2026,from Mr. Matthew Joseph,that
submitted a revised Quality Control Inspection Plan and conditional approval from US
Forest Service in response to our comment on the Sandy Beach Recreation Improvements
at Poe Dam, which is part of the Poe Hydroelectric Project, FERC No. 2107.We have
reviewed the submittal and have the following comments:
1.We acknowledge the conditional approval from the U.S. Forest Service
regarding the 100% design package for the improvements at Sandy Beach
recreation site. The Forest Service states it supports and approves the 100-
percent design for all areas outside of the Caltrans right-of-way (ROW). You
are reminded that you are responsible for obtaining all necessary permits and
approvals before beginning work, including approval from Caltrans.
On July 2, 2024, you filed a findings of effect report related to consultation
under Section 106 of the National Historic Preservation Act, which included a
letter from the California State Historic Preservation Officer (California
SHPO), dated May 24, 2024, which concurred with the finding that the
recreation improvements at Sandy Beach would have no effect on historic
properties. The California SHPO noted that you had consulted with the Estom
Yumeka Tribe of Enterprise Rancheria, Tasmam Koyom, and the Know Valley
Band of Maidu (Konkow)regarding the planned recreation improvements. The
Konkow requested that a tribal monitor be present for any ground disturbance
and the other Tribes expressed no concern but would like to continue
consultation on the project.

You are reminded that adherence to the terms and conditions of the Biological
Opinion submitted by the U.S. Fish and Wildlife Service under section 7 of the
Endangered Species Act is required for work associated with the recreation
improvements at Sandy Beach.See the Order Amending License to
Incorporate Biological Opinion Terms and Conditions (188 FERC ¶ 62,138),
issued September 16, 2024.
You are also reminded as required by ordering paragraph (D) of the Order
Modifying and Approving Recreation Plan Under Article 404 (178 FERC ¶
62,116), issued February 28, 2022, to file a construction status report and
updated schedule for completion of the recreation improvements required at
the Sandy Beach recreation site.
2.All field inspectors’resumes are missing headers with names. You must ensure
that resumes are formatted in the submittal for our review.
No response is required. You are authorized to proceed with the proposed
improvements immediately upon receipt of this letter.
During construction, we typically require monthly construction reports. However,
due to the short duration of this project, we will not require monthly construction reports.
Within 90 days of completion of construction of the facilities authorized by this
letter, or no later than January 14, 2027, submit a brief report summarizing the work and
any unusual conditions or items that are important to document for future reference. .
