The Board of Supervisors welcomes the public to its meetings and encourages and
appreciates public engagement. The Board of Supervisors expects members of the public
to act in a courteous, civil, and respectful manner, and not make personal, impertinent,
slanderous, or profane remarks to any member of the Board, staff, or the general public.
The Board of Supervisors will not tolerate loud, threatening, personal, or abusive
language, or disorderly conduct, which disrupts, disturbs, or otherwise impedes the orderly
conduct of Board meetings. Violation of these rules of decorum will result in the meeting
being recessed.

3.1. Clerk-Recorder's Office
3.1.a Budget Amendment and Capital Asset Purchase - Two Ballot Tabulators
In 2019, the Clerk-Recorder's Office purchased four election ballot tabulators used to
conduct 12 elections and are now nearing the end of their service life. The Department is
planning for their replacement to ensure continued reliable election operations. The
Department recommends the Board of Supervisors approve a budget amendment and
capital asset purchase of $56,000 for two ballot tabulators to meet the needs for future
elections. The purchase is 75% grant funded with the remaining cost paid for by the

3.3. County Counsel's Office
3.3.a Accept the Conflict of Interest Code of the Butte Schools Self-Funded Programs
On July 16, 2026 the Board of Directors of the Butte Schools Self-Funded Programs
approved a Resolution adopting a Conflict of Interest Code to ensure that officials and
designated employees disclose potential conflicts of interest and to promote transparency
in decision-making. The resolution is being submitted for approval by the Board of
Supervisors as the code reviewing body. County Counsel has reviewed the resolution to
adopt the Conflict of Interest Code and deems it to be proper. (COUNTY COUNSEL)

3.4. Department of Behavioral Health
3.4.a Resolution Recognizing Scott Kennelly Upon Retirement from Butte County Behavioral
Health Department
The Department of Behavioral Health recommends the Board of Supervisors adopt a
resolution recognizing the retirement of Scott Kennelly on the occasion of his retirement
as the Director of Behavioral Health after 26 years of dedicated service. (DEPARTMENT

Action Requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN.
3.5. Department of Child Support Services
3.5.a Resolution Proclaiming August 2026 as Child Support Awareness Month
Children who are supported by their parents are more likely to perform better in school,
have improved emotional development, and a stable home life. Child Support Awareness
Month, recognized nationwide, is an opportunity to increase public awareness of the
services available to families through the local child support office. In recognition of this
observance, the Department of Child Support Services recommends the Board of
Supervisors adopt a resolution proclaiming August 2026 as Child Support Awareness
Month. This resolution encourages parents to explore the services provided by the
program and find out what child support can do for them. (DEPARTMENT OF CHILD

3.6. Department of Human Resources
3.6.a Resolution to Amend the Salary Ordinance
The Department of Human Resources recommends the Board of Supervisors adopt a
resolution amending the Salary Ordinance for the following departments:
Assessor's Office: Add 1 flexibly staffed Administrative Analyst position and delete 1
vacant Assessment Office Supervisor. This change better suits the operational needs of
the Department. Total allocations to remain the same.
County Administration: Extend 1 flexibly staffed Administrative Analyst Sunset position
from 6/30/2027 to 9/30/2028; extend 1 flexibly staffed Administrative Analyst Term
position from 6/30/2027 to 9/30/2028; and extend 1 Program Development Manager Term
position from 6/30/2027 to 9/30/2028 to support the increased funding and extended time
period for CDBG Disaster Recovery grants. Additionally, increase 1 Communications and
Public Information Officer from a 0.75 FTE to a 1.0 FTE to meet the current needs of the
County. Funding is available in the Department's budget. Total allocations to increase by
0.25.
Clerk-Recorder's Office: Add 1 flexibly staffed County Clerk-Recorder Specialist position.
This change better suits the current and future needs of the department. Upon completion
of an internal recruitment, the Department will return to delete the vacant position. Total
allocations to temporarily increase by one. The estimated cost is projected to be $3,840.
Funding is available in the Department's budget.
Employment and Social Services: Delete 1 Deputy Director of Employment and Social
Services position and 1 flexibly staffed Employment Case Manager position, which is a
special assignment position. These changes better suit the operational needs of the
Department and will result in an annual cost savings of $364,000. Total allocations
decrease by 2.
Probation: Reclassify 1 Senior Administrative Assistant position to a flexibly staffed
Administrative Analyst position. This reclassification better reflects the duties currently
being performed by the incumbent and was determined through the reclassification
process with Human Resources and the applicable employee association. Funding is
available in the Department's budget. Total allocations to remain the same.
Public Health: Reclassify 1 flexibly staffed Health Services Assistant position to a flexibly
staffed Inventory/Warehouse Worker position. This reclassification better reflects the
duties currently being performed by the incumbent and was determined through the
reclassification process with Human Resources and the applicable employee association.
Total allocations to remain the same.
Public Works: Add 2 flexibly staffed Information Technology Analyst positions and delete 1
flexibly staffed Information Technology Specialist position and 1 Information Technology
Supervisor position. These changes will better suit the operational needs of the

department and will result in an approximate salary savings of $25,500. Total allocations

3.7. District Attorney's Office
3.7.a Resolution Authorizing Cal OES Victim Witness Assistance Grant
The Cal OES Victim Witness Assistance Program provides grant funding for the provision
of assistance and advocacy to victims of crime. The District Attorney's Office has applied
for and has received these funds for many years. The funds are used to support the
majority of the Department's Victim Assistance Program.
Cal OES requires authorization by the Board of Supervisors for each jurisdiction,
approving the submission of a grant application and execution of the grant. The
Department recommends that the Board adopt a resolution approving submission of the
grant application and authorizing the District Attorney to sign the application, any
amendments, extensions, and other supporting documents for the grant performance
periods October 1, 2026 through September 30, 2027; October 1, 2027 through
September 30, 2028; and October 1, 2028 through September 30, 2029. (DISTRICT

3.8. Fire Department
3.8.a Capital Asset Surplus - Equipment
The Board of Supervisors has authority to declare capital assets as surplus that are no
longer serviceable or no longer needed by the County. In August 2024, Water Tender 45
was severely damaged in an accident and declared a total loss by insurance. The Butte
County Fire Department recommends the Board declare the water tender as surplus and
approve a salvage sale to be coordinated through General Services to comply with all
procedural requirements. (FIRE DEPARTMENT)
Action Requested - 1) DECLARE CAPITAL ASSET SURPLUS TO THE NEEDS OF THE
COUNTY; AND 2) APPROVE THE SALVAGE SALE OF THE WATER TENDER.
3.9. Department of Public Works
3.9.a Contract with VSS International, Inc. for the Construction of the Rosewood Drive Repair
Project
The Rosewood Drive Repair project is located within the unincorporated community of
Magalia on Rosewood Drive, between Skyway and Northwood Drive, and consists of
roadway improvements to enhance public safety and extend pavement service life. The
work includes clearing and grubbing, traffic control, cape seal, striping, and signage, all in
conformance with the Plans, Specifications, and Special Provisions.
On October 28, 2025, the Board of Supervisors authorized the Department of Public
Works to advertise and solicit bids for projects included in the Public Works Infrastructure
Master Plan (IMP). This project was advertised on June 18, 2026, and one bid was

received on July 9, 2026. The lowest responsive and responsible bidder was VSS
International, Inc. of Sacramento, with a bid of $231,211.
The bid exceeded the engineer's estimate $140,000 and was determined to be
reasonable based on current market conditions, rising cost of asphalt work, construction
occurring late in the season, and tight completion deadline of December 2026. The
project must be completed by December 2026 to meet CDBG-DR funding requirements.
The Department recommends that the Board approve the project plans and specifications,
award the contract to VSS International, Inc., and authorize the Director of Public Works
or their designee to sign the contract and order changes or additions in work performed
per Public Contract Code Section 20142. (DEPARTMENT OF PUBLIC WORKS)

AWARD THE CONTRACT TO VSS INTERNATIONAL, INC.; AND 3) AUTHORIZE THE
DIRECTOR OF PUBLIC WORKS OR THEIR DESIGNEE TO SIGN THE CONTRACT
AND ORDER CHANGES PER PUBLIC CONTRACT CODE SECTION 20142.
3.9.b Resolution Authorizing the Director of Public Works to Execute a Quitclaim Deed to the
California Department of Transportation (Caltrans) for the State Route 191/Durham-Pentz
Road Roundabout Improvement Project
Caltrans is advancing the State Route 191 (Clark Road) and Durham-Pentz Road
Roundabout Improvement Project to improve traffic operations, enhance public safety,
and reduce vehicle conflict points at the intersection.
To construct the project, Caltrans requires acquisition of a portion of County-owned right-
of-way adjacent to the intersection. Department of Public Works staff have reviewed the
requested conveyance and determined that the County's interest in the affected right-of-
way is no longer required for County transportation purposes. Conveying this interest will
not adversely affect County road operations, maintenance responsibilities, or future
transportation needs.
Caltrans has requested that the County convey its interest in the property by Quitclaim
Deed. The Department recommends approval of the attached Resolution, authorizing the
Director of Public Works, or designee, to execute the Quitclaim Deed and any ancillary
documents necessary to complete the conveyance on behalf of the County.
Adoption of the Resolution will allow Caltrans to acquire the necessary right-of-way,
consolidate ownership interests within the project limits, and proceed with construction of
the State Route 191/Durham-Pentz Road Roundabout Improvement

4.1 Board Member/Committee Reports and Board Member Comment
4.2 Public Comment
Comments to the Board on issues and items not listed on the agenda. Pursuant to

California State law, the Board of Supervisors is prohibited from taking action on any item
not listed on the agenda. Please note that Public Comment is in two separate sections.
One, at the beginning of the regular agenda, which will last a maximum of 15 minutes, with
another to follow as the last item on the regular agenda with no time limits.
4.3 Resolution Adopting Butte County's Job Order Contracting (JOC) Policy and Adopting the
General and Special Provisions for JOC Projects for Public Works
On April 27, 2021, the Board of Supervisors approved contracts with The Gordian Group,
Inc. (Gordian) to provide JOC services for the Departments of General Services and
Public Works, consistent with Public Contract Code section 20128.5. The Board
authorized JOC services up to $250,000 for General Services and $500,000 for Public
Works.
JOC is a common alternative delivery method that uses pre-established, competitively bid
unit prices to complete multiple construction and maintenance projects within the annual
contract term. Compared to the transitional design-bid-build process, JOC streamlines
project delivery, reduces administrative burden, and can significantly shorten the time
between project identification and construction compared to the traditional design-bid-build
procurement method. Gordian assists the County in soliciting competitively bid umbrella
contracts and verifying that Job Order work is completed at the established contract price.
Contractors competitively bid on the umbrella contract, with unit prices fixed for the
contract term. Funding for each Job Order is included within the related project budget
and payment to Gordian occurs only when work is completed.
Job Order Contracting (JOC) Policy
The proposed JOC Policy establishes the County's procedures for developing, reviewing,
approving, and executing JOC contracts, Job Orders, and Supplementals. The policy
defines approval authorities and ensures compliance with applicable laws and County
requirements. Under the policy, staff may approve Job Orders and Supplementals within
established thresholds, while those exceeding the delegated authority will be presented to
the Board for approval, providing an appropriate balance of efficiency, transparency, and
oversight.
The Department of General Services and the Department of Public Works recommend
that the Board adopt a resolution approving the JOC Policy and authorizing the
administration of JOC contracts, Job Orders, and Supplementals in accordance with the
approval thresholds established in the policy.
Public Works JOC General and Special Provisions
Since implementation of the JOC program in 2021, the Department of Public Works has
successfully completed numerous minor repair and maintenance projects more efficiently
than would have been possible through traditional procurement methods.
Each JOC umbrella construction contract incorporates standard General and Special
Provisions, including the Construction Task Catalog and Technical Specifications, which
establish the scope of work, unit-price tasks, and technical requirements for future Job
Orders. These documents are updated periodically to reflect current construction practices
and County requirements and are available online:

The Department of Public Works recommends that the Board approve the JOC
Construction Task Catalog and Technical Specifications and authorize the Department to
solicit construction bids and incorporate any final, non-substantive revisions into the bid
documents. Following bid solicitation, all JOC Umbrella Construction Contracts will return
to the Board for award. Individual Job Orders exceeding $500,000 will also return to the
Board for approval in accordance with the new JOC Policy. (DEPARTMENT OF

CATALOG.
4.4 Palermo Master Drainage Plan
On January 23, 2024, the Board of Supervisors approved a contract with West Yost &
Associates for the implementation of the District No. 6 Palermo Master Drainage Plan
project. The project is funded through the Cal OES Hazard Mitigation Grant Program with
the local match requirement provided by the Subdivision Drainage Fund.
The Palermo area has a long history of localized flooding and has been the subject of
various studies over the past several decades addressing flooding, drinking water supply,
and water quality impacts. Previous efforts to develop comprehensive drainage and
infrastructure solutions date back to the 1970s; however, implementation proved
challenging due to funding constraints and community concerns regarding the cost of
proposed improvements. Flooding continues to result in public safety and emergency
response issues, damage to homes and property, overwhelmed storm drain infrastructure,
roadway erosion, business disruptions, and declining property values.
The development of the Palermo Master Drainage Plan involved an extensive program of
data collection, field investigation, and technical modeling to assess hydrologic and
hydraulic conditions within the Palermo community. These analyses were complemented
by community outreach and coordination with other regional planning efforts. The Master
Drainage Plan identifies seven alternative projects that could be implemented to reduce
potential flooding during certain storm events. The Department of Water and Resource
Conservation will present an overview of the Palermo Master Drainage

5.1 10:00 am - Public Hearing - County-Initiated Zoning Code Amendment (PROJ-26-0035) to
Butte County Code Chapter 24, Article IV, Division 1, Section 24-176 "Mobile Food
Courts"
This is a County-initiated zoning code amendment of the Butte County Zoning Ordinance
seeking to adopt the proposed section (Butte County Code Chapter 24, Article IV, Division
1, Section 24.176 – Mobile Food Courts). This amendment shall establish mobile food
courts as a land use allowable in Mixed-Use, Commercial, and Industrial Zones subject to
an administrative permit.
The zoning code amendment is exempt from environmental review pursuant to CEQA
Guidelines Section 15268(a) under a ministerial project exemption.
The amendment summarized above is on file and available for public viewing at the Butte
County Department of Development Services, 7 County Center Drive, Oroville, CA 95965.
On May 28, 2026, the Planning Commission passed Resolution PC26-09 with a vote of 3-
1 finding the proposed Zoning Code Amendment exempt under section 15268(a) of the
California Environmental Quality Act and recommending adoption with the following
changes:
1. Delete “Residential Use” and use “Residential Zone” and
2. Reduce the 300-foot setback to a 200-foot setback from a Residential Zone.
Staff recommended changes:
1. Allow for overnight storage and replace with daily commissary reporting instead.

5.2 10:15 am - Public Hearing - County-Initiated Zoning Code Amendment (ZCA25-0005) to
Butte County Code Chapter 24, Article IV, Division 1, Section 24-172.1 "Short-Term
Rental Ordinance"
This is a County-initiated zoning code amendment of Butte County Code, Chapter 24,
Article IV, Division 1, Section 24-172.1 "Short-Term Rental Ordinance". The proposed
zoning code amendment intends to remove requirements that would restrict the use of
some parcels from the use of a residential dwelling as a short-term rental. The current
ordinance has been in effect for over 6 years, and it has been determined that review and
update/amendment is appropriate based on the changes over the last 6 years. The

updates proposed will provide more flexibility and updated terms.
The amendments include the following sections of the ordinance: Definitions, Applicability,
Minor Use Permit Process, Administrative Permit Renewal Process, Short-Term Rental
Restrictions, Reporting Requirements, and Standards (including occupancy limits).
On May 28, 2026, the Planning Commission passed Resolution PC26-10 on a vote of 5-0
finding the proposed Zoning Code Amendment exempt under section 15061(b)(3) of the
California Environmental Quality Act and recommending adoption of Zoning Code

3.1 Resolution Adopting the County of Butte Groundwater Sustainability Agency
Recommended Budget for FY2026-27
On October 13, 2015, the Butte County Board of Supervisors became the County of Butte
Groundwater Sustainability Agency (COBGSA) for the portions of the County that overlie
the Butte Subbasin that were not part of another Groundwater Sustainability Agency. Daily
COBGSA business is conducted by the Department of Water and Resource Conservation
Director and staff.
On November 5, 2019, the COBGSA signed a Cooperation Agreement with the 10 other
Groundwater Sustainability Agencies within the Butte Subbasin for the purpose of
organizing the various GSAs and cooperating in the development of a single Groundwater
Sustainability Plan (GSP). On April 23, 2024, the COBGSA signed the Cooperation
Agreement Amendment #2 agreeing to an equal split cost-share between the 11 GSAs
within the Butte Subbasin for implementing the Butte Subbasin GSP and associated
SGMA compliance activities, with the COBGSA serving as the Fund Administrator. On
June 5, 2025, the Butte Advisory Board, comprised of representatives from each of the 11
GSAs, reviewed the Fund Administrator’s Report and approved the Butte Subbasin
Recommended Budget for both the 2025-26 and 2026-27 Fiscal Years. Based on the

projected revenue and expenses needs for the 2026-27 Fiscal Year, each GSA will
contribute $12,790.91 for the 2026-27 Fiscal Year for a total revenue of $140,700.
During Fiscal Year 2026-27 it is anticipated that funds will be used for professional
consulting and engineering services for the preparation of the Annual Report, finalization
of the GSP Periodic Evaluation, data management system, grant procurement, monitoring,
and well permitting fees. The estimated unassigned fund balance available to fund FY
2026-27 is $37,824.
The Recommended Budget in the amount of $140,700 has been prepared for FY2026-

3.1 Resolution Adopting the Thompson Flat Cemetery District Recommended Budget for FY
2026-27
On August 10, 1999, the Board of Supervisors became the Board of Trustees for the
Thompson Flat Cemetery District. The Director of General Services manages daily
cemetery business. Maintenance and operations are provided by the Gridley-Biggs
Cemetery District under an operational agreement with the County. The recommended
expenditure budget for Fiscal Year 2026-27 is $4,400. This covers routine expenses of
approximately $2,500 per year and additional funds for unanticipated maintenance. The
District anticipates $5,118 in property tax revenue. Staff recommend the Board adopt a
resolution approving the recommended budget for Fiscal Year 2026-27 and authorize the
Chair to sign. This budget hearing provides the community an opportunity to comment on
the recommended budget. The recommended budget is prepared by the Department of
General Services and is available at https://www.buttecounty.ca.gov/461/General-

Meeting Information:
Meetings are generally held the second and fourth Tuesday of each month. Meetings
start at 9:00 a.m. and are held in the Board of Supervisors Chambers, County
Administration Building, 25 County Center Drive, Suite 205, Oroville. At the end of
each year the Board adopts a meeting schedule for the upcoming year. Meeting dates
can be changed as a result of holidays or other events so please check the meeting
calendar to be certain. Copies of the adopted meeting calendar for the year are
available in the County Administrative Office or on the County website at
buttecounty.ca.gov under Board of Supervisors Meetings.
Agenda Information:
The agenda for every meeting of the Board is posted in front of the County
Administration Building at least 72 hours before each meeting, and is available by mail
subscription, e-mail subscription, or on the County Website. A copy of the agenda
and supporting materials, is available for review at the County Administrative Office
or on the Butte County website at buttecounty.ca.gov. Copies of supporting materials
can be produced for a fee. Any communication or public comment submitted to the
Board of Supervisors after agenda distribution, will be attached to item on the County
website following the meeting.
Agenda Format and Meeting Order:
The agenda is organized and generally considered in the following order:
1. Consent Agenda
Items on the Consent Agenda are considered routine in nature and are typically
approved by a single motion and vote of the Board. Members of the public who wish
to comment on a Consent Agenda item may complete a speaker card (available near
the entrance to the Board Chambers) and submit it to the Clerk of the Board, seated
to the right of the Board. Participants attending remotely may use the “Raise Hand”
feature when the Chair opens public comment for the Consent Agenda. Any item
removed from the Consent Agenda for discussion will be considered later during the
Regular Agenda.
2. Public Comment
This portion of the meeting provides an opportunity for members of the public to
address the Board on matters that are not listed on the agenda. State law prohibits
the Board from taking action on items not appearing on the agenda; however, the
Board may respond to comments, answer questions, or provide direction to staff.
Public comment is limited to three (3) minutes per speaker.
3. Regular Agenda
The Regular Agenda includes presentations, reports, and other items requiring
discussion and/or Board action. Items removed from the Consent Agenda are also
considered during this portion of the meeting.
4. Public Hearings and Timed Items
Public Hearings and other timed items are scheduled as required by law or by the
nature of the matter being considered. While these items may begin after their
posted time, they will not begin before the scheduled time.
5. Closed Session
Under certain circumstances authorized by law, the Board may meet in Closed Session
to discuss specific matters. The agenda identifies the items to be considered during
Closed Session, which are not open to public participation.

more than $250 in campaign contributions from the applicant or contractor, an agent
of the applicant or contractor, or any financially interested participant who actively
supports or opposes the County’s decision on the agenda item since January 1, 2023.
Members of the Board of Supervisors who have received, and applicants, contractors
or their agents who have made, campaign contributions totaling more than $250 to a
Board member since January 1, 2023, are required to disclose that fact for the official
