INTRODUCTORY ITEMS Rules of Decorum The Board of Supervisors welcomes the public to its meetings and encourages and appreciates public engagement. The Board of Supervisors expects members of the public to act in a courteous, civil, and respectful manner, and not make personal, impertinent, slanderous, or profane remarks to any member of the Board, staff, or the general public. The Board of Supervisors will not tolerate loud, threatening, personal, or abusive language, or disorderly conduct, which disrupts, disturbs, or otherwise impedes the orderly conduct of Board meetings. Violation of these rules of decorum will result in the meeting being recessed. 2.1 Corrections and/or Changes to the Agenda 2.2 Announcement(s) of Recusal 3. CONSENT AGENDA The Consent Agenda will begin with any Supervisor Comments on the Consent Agenda Items, then proceed with the Adoption of the Consent Agenda. Items can be removed for further discussion at the request of a Supervisor. There was no public comment received for this item. Action: ADOPT THE CONSENT AGENDA Motion: Supervisor Durfee Second: Supervisor Teeter Approved unanimously with the exception of Items 3.1.a and 3.8.a which were both pulled for further discussion. BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 3.1. Clerk-Recorder's Office 3.1.a Budget Amendment and Capital Asset Purchase - Mobile Elections Trailer On August 4, 2026, the California Department of Finance notified counties that the State budget includes funding to support local election administration for the November 3, 2026, General Election. The Clerk-Recorder's Office will receive $171,000, including $145,853 for the purchase of equipment, technology, or space to expedite election administration and $25,147 for voter outreach and education. The Department plans to use the $145,853 to purchase a mobile elections towable trailer that will provide election services and outreach throughout the County while improving accessibility. The remaining $25,147 will be used to support voter outreach and education activities to increase public awareness of election information. The Department recommends the Board of Supervisors approve a budget amendment for $171,000 and the capital asset purchase of $145,853 for a mobile elections trailer. (CLERK-RECORDER'S OFFICE) Action Requested - 1) APPROVE THE BUDGET AMENDMENT; AND 2) AUTHORIZE CAPITAL ASSET PURCHASE (4/5 VOTE REQUIRED). County Administration 3.2.a Approval of Board of Supervisors Meeting Minutes Submitted for approval are the August 11, 2026, Board of Supervisors Meeting Minutes. (COUNTY ADMINISTRATION) Action Requested - APPROVE THE AUGUST 11, 2026 BOARD OF SUPERVISORS MEETING MINUTES. 3.3. Department of Agriculture 3.3.a Amendment to the California Department of Food and Agriculture (CDFA) Glassy Winged Sharp Shooter (GWSS) Agreement On October 14, 2025 the Board of Supervisors approved a cooperative agreement with the CDFA for $78,064, with a term of July 1, 2025, through September 30, 2026. The purpose of the agreement is to fund the County’s ongoing GWSS prevention and control program, BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 where the County conducts surveys, trapping, inspections, and control activities, with CDFA reimbursing the County for eligible expenditures. The proposed amendment extends the term of the agreement from September 30, 2026, to September 30, 2027, and increases the maximum payable by $55,810, not-to-exceed $133,874. The Agricultural Commissioner’s Office recommends the Board approve the amendment. The extension and increase of funds are necessary to perform survey, inspection, and control of the GWSS while also preserving the ability to amend the agreement when funding becomes available for the emergency work in response to the Burchell Nursery/Costco GWSS detection. (DEPARTMENT OF AGRICULTURE) Action Requested - APPROVE AGREEMENT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN. 3.4. Department of Behavioral Health 3.4.a Resolutions Changing Authorized Signatory for Advocates for Human Potential (AHP) Grants The Department of Behavioral Health has four State grant agreements that are administered through AHP: 1) Behavioral Health Bridge Housing Grant; 2) Incompetent to Stand Trial Diversion and Community Based Restoration Infrastructure (IST); 3) Behavioral Health Infrastructure Grant Round 1 Bond; and 4) Behavioral Health Infrastructure Grant Round 4 Bond. Each grant has an existing resolution authorizing the previous Director of Behavioral Health to sign grant documents. AHP requires a secondary resolution for each grant, authorizing the new Behavioral Health Director, Dr. Anthony Hobson, to sign grant documents. The Department recommends the Board of Supervisors adopt the four resolutions and authorize the Chair to sign. (DEPARTMENT OF BEHAVIORAL HEALTH) Action Requested - ADOPT RESOLUTIONS (4) AND AUTHORIZE THE CHAIR TO SIGN. 3.5. Department of General Services 3.5.a Budget Amendment for Asphalt Parking Lot at Fire Station 33, Magalia On July 28, 2026, the Board of Supervisors approved a contract with 2C Land and Timber Management Corp. for the removal and replacement of the existing asphalt parking lot at Fire Station 33 in Magalia. During the summer of 2025, the parking lot at Butte County Fire Station 33 sustained significant damage following an incident involving the apparatus bay door. After the bay door was compromised, fire apparatus were required to use an alternate access route through the front parking lot to enter the apparatus bay. Continued use of the route by heavy emergency vehicles resulted in substantial deterioration of the existing asphalt surface, necessitating full replacement. The project will be fully funded through insurance proceeds received from the original apparatus bay door incident. The Department of General Services recommends the Board of Supervisors approve a budget amendment of $253,300 to fund the completion of construction. (DEPARTMENT OF GENERAL SERVICES) Action Requested - APPROVE BUDGET AMENDMENT (4/5 VOTE REQUIRED). BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 3.5.b Contract with Raftelis Financial Consultants, Inc. (Raftelis) for Review of Service Delivery Practices of the Department of General Services The Department of General Services provides a wide range of services in support of countywide operations, including Contracts/Purchasing, Facilities Services (Janitorial, Grounds, Maintenance, Construction), Safety, Real Property Management, Surplus, and Mail/Courier Services. The appointment of a new department head, implementation of the Workday ERP system, and selection of a new project management software system have created a unique opportunity for an in-depth review of internal processes and controls to maximize the use of available tools, reduce or eliminate manual and duplicative processes, and provide more efficient and higher quality services. The Departments of General Services and County Administration recently issued an RFP seeking qualified consulting firms to conduct a comprehensive review of the service delivery structure, organization, and operational practices of the Department of General Services. Representatives from the Sheriff's Office, County Administration, and the Auditor- Controller's Office participated in the review process and Raftelis achieved the highest score among the 9 responses to the RFP. Raftelis will conduct in-person meetings with staff and interviews with County departments that rely on services provided by General Services as they document existing processes and identify areas of improvement. The review and documentation process is expected to occur over a 6-month period. The proposed contract period of one year would allow for change management and implementation assistance that are not included in the initial engagement but are included as optional add-ins. The Department of General Services recommends the Board of Supervisors approve a contract with Raftelis from September 1, 2026 to August 31, 2027, in an amount not-to- exceed $97,500 for the comprehensive review of service delivery and operational practices in the Department of General Services. (DEPARTMENT OF GENERAL SERVICES) Action Requested - APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. 3.6. Department of Human Resources 3.6.a Resolution to Amend the Salary Ordinance The Department of Human Resources recommends the Board of Supervisors adopt a resolution amending the Salary Ordinance for the following departments: Behavioral Health: Add 1 flexibly staffed Behavioral Health Education Specialist position and delete 1 Behavioral Health Education Supervisor position. This change will better suit the needs of the department. Positions are funded by Substance Use Block Grant funds. The estimated salary and benefits savings is $41,647. Total allocations to remain the same. General Services: Add 1 flexibly staffed Administrative Analyst position and delete 1 Facilities Services Coordinator position to better meet the needs of the department. The difference in position cost will be covered by salary savings. Total allocations to remain the same. BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 Amend Section 28O of Ordinance No. 4273 of the County of Butte entitled “Classifications With Flat Rate Assignments” by adding a new extra help, flat rate classification titled "Public Health Microbiologist Trainee" set at an hourly rate of $19.30. (DEPARTMENT OF HUMAN RESOURCES) Action Requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. 3.6.b Resolution Extending Temporary Law Enforcement Referral Bonus Program through August 31, 2027 On November 18, 2025, the Board of Supervisors approved an updated temporary Law Enforcement Referral Bonus Program to assist with staff recruitment and subsequent retention issues that have existed the last several years. The Program utilizes department salary savings to pay the $1,500 bonus for successful referrals. The Sheriff's Office and Probation Department recommend extending the term of this Referral Bonus Program retroactive from June 30, 2026, through August 31, 2027. This program continues to be part of the success of attracting new staff into law enforcement positions and to date, the Referral Bonus Program has successfully paid 41 Referral Bonuses over the past two years. (DEPARTMENT OF HUMAN RESOURCES) Action Requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. 3.7. Department of Public Health 3.7.a Health Care Program for Children in Foster Care Certification The Department of Public Health operates the Health Care Program for Children in Foster Care. This program provides a Public Health Nurse to coordinate the healthcare needs of children in foster care, such as their developmental, dental, and mental health needs. The Public Health Nurse ensures that identified health needs are monitored and supports the continuity of health care services for children while in foster care placements. The Department of Health Care Services (DHCS) guidelines and regulations require an annual Certification Statement agreeing to comply with all applicable provisions of the Health and Safety Code, Welfare and Institutions Code, and the Integrated Systems of Care Plan and Fiscal Guidelines Manual. The Department recommends the Board of Supervisors approve and sign the annual certification statement and authorize the Department to submit to DHCS. (DEPARTMENT OF PUBLIC HEALTH) Action Requested - 1) APPROVE THE CERTIFICATION STATEMENT, 2) AUTHORIZE THE CHAIR TO SIGN, AND 3) AUTHORIZE THE DEPARTMENT DIRECTOR TO SUBMIT TO DHCS. 3.8. Department of Water & Resource Conservation 3.8.a Resolution Proclaiming September 2, 2026 as Protect Your Groundwater Day Groundwater is a critical component of Butte County’s water resources, supporting residential, agricultural, commercial, environmental, and other community needs. Protecting groundwater quality and maintaining sustainable groundwater resources are essential to the long-term reliability and resilience of the County’s water supply. Protect Your Groundwater Day provides an opportunity to increase public awareness of the BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 importance of groundwater and the shared responsibility of residents, agricultural producers, businesses, water agencies, local governments, and other stakeholders in protecting this essential resource. The observance also complements ongoing local and regional efforts to monitor, manage, and sustainably use groundwater resources. The Department of Water and Resource Conservation recommends that the Board of Supervisors adopt a resolution proclaiming September 2, 2026, as Protect Your Groundwater Day in Butte County. The proclamation encourages residents, businesses, agricultural producers, water users, and community organizations to learn about groundwater resources, practice responsible water use, and support efforts to protect groundwater quality and sustainability for current and future generations. (DEPARTMENT OF WATER & RESOURCE CONSERVATION) Action Requested - ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. Motioned: Supervisor Durfee Second: Supervisor Teeter Motion passed with a 4-1 vote (Ayes: Supervisors Durfee, Kimmelshue, Teeter, and Chair Connelly; Nays: Supervisor Ritter). 3.8.b Ratify Letter of Support for the Thermalito Water and Sewer District Restoration of Concow Reservoir Storage Capacity Funding Request The Thermalito Water and Sewer District provides water for approximately 12,200 residents within the Thermalito community. As a result of the Camp Fire in 2018, the capacity of the Concow Reservoir has been significantly reduced by increased sediment and debris accumulation from subsequent winter storms and precipitation. The loss of capacity in the Concow Reservoir threatens the long-term drinking water reliability for this area. The District is requesting that the State prioritize funding for restoration of Concow Reservoir storage capacity. Due to the submittal timeline, staff provided the letter of support to Thermalito Water and Sewer District to include in their request to the State. The Department of Water and Resource Conservation recommend the Board of Supervisors ratify the letter of support. (DEPARTMENT OF WATER & RESOURCE CONSERVATION) Action Requested - RATIFY LETTER OF SUPPORT. BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 3.9. District Attorney's Office 3.9.a Real Estate Fraud Annual Report for FY 2025-26 Pursuant to Government Code section 27388, and Board of Supervisors Resolution, a fee is paid at the time of recording certain real estate documents for the purpose of providing funds for the District Attorney to deter, investigate, and prosecute real estate fraud through the Real Estate Fraud Investigation and Prosecution Program. In accordance with annual reporting requirements, the District Attorney's Office submits its annual report to the Board of Supervisors regarding the effectiveness of the Real Estate Fraud Investigation and Prosecution Program. (DISTRICT ATTORNEY'S OFFICE) Action Requested - ACCEPT FOR INFORMATION. 3.9.b Agreement and Certification with United States Department of Justice (DOJ) for Federal Equitable Sharing Program The District Attorney's Office participates in the Federal Equitable Sharing Program, which is part of the DOJ Asset Forfeiture Program. This nationwide initiative helps law enforcement remove tools of crime from criminal organizations, deprive wrongdoers of the proceeds of the crimes, recover property that may be used to compensate victims, and deter criminal activity. An annual Equitable Sharing Agreement and Certification must be electronically filed with the DOJ by the County on behalf of the District Attorney's Office. The agreement and certification for FY 2025-26 have been prepared and summarize program expenditures and revenues. In FY 2025-26, the District Attorney's Office received $4,188 and $0 was expended. The District Attorney's Office recommends the Board of Supervisors approve the Equitable Sharing Agreement and Certification for FY 2025-26 and authorize electronic submission. (DISTRICT ATTORNEY'S OFFICE) Action Requested - 1) APPROVE THE EQUITABLE SHARING AGREEMENT AND CERTIFICATION AND AUTHORIZE THE CHAIR TO SIGN; AND 2) AUTHORIZE ELECTRONIC SUBMISSION. 3.10. Sheriff-Coroner's Office 3.10.a Agreement and Certification with the United States Department of Justice (DOJ) for Federal Equitable Sharing Program The Sheriff’s Office and the Butte Interagency Narcotics Task Force (BINTF) participate in the Federal Equitable Sharing Program, which is part of the DOJ Asset Forfeiture Program. This nationwide initiative helps law enforcement remove tools of crime from criminal organizations, deprive wrongdoers of the proceeds of their crimes, recover property that may be used to compensate victims, and deter criminal activity. An annual Equitable Sharing Agreement and Certification must be electronically filed with the DOJ by the County on behalf of the Sheriff's Office and BINTF. The agreement and certification for FY 2025-26 have been prepared and summarize program expenditures and revenues. In FY 2025-26, BINTF and the Sheriff's Office received $2,386 and expended $0. (SHERIFF-CORONER'S OFFICE) Action Requested - 1) APPROVE THE EQUITABLE SHARING AGREEMENT AND CERTIFICATION AND AUTHORIZE THE CHAIR TO SIGN; AND 2) AUTHORIZE ELECTRONIC SUBMISSION. 3.10.b Capital Asset Purchase and Budget Amendment for Regulatory Information Management System (RIMS) Mobile License The Sheriff's Office has utilized RIMS for computer-aided dispatch, reports, and records management since 2017 and has an approved standardization for continued use of the system. The Sheriff's Office is expanding the use of RIMS to include a mobile component, which will allow deputies to utilize in-car computers. In order to support the expansion, the Sheriff's Office must pay for licensing, installation, and one-year annual support fees for RIMS Mobile. The Sheriff's Office recommends the Board of Supervisors approve the capital asset purchase and support fees for a total cost of $96,560 and approve a budget amendment to increase appropriation and transfer funds from the Sheriff's Office Rural County sub-fund for the purchase of RIMS Mobile. (SHERIFF-CORONER'S OFFICE) Action Requested - 1) APPROVE CAPITAL ASSET PURCHASE; AND 2) APPROVE BUDGET AMENDMENT (4/5 VOTE REQUIRED). 4. REGULAR AGENDA 4.1 Board Member/Committee Reports and Board Member Comment Chair Connelly - Attended Sutter Butte Flood Control meeting; Sierra Sacramento Valley EMS meeting; Butte County Fair Dinner; visited Hewitt Park in Oroville; LAFCo Office in Chico; and went to Washington D.C. to meet with NACo and FERC. Supervisor Durfee - Attended the Local Government Committee meeting; Ribbon Cutting of Chick-fil-a in Chico; Ribbon Cutting for Wildflower Pediatrics; met a building contractor regarding a project; and had a video call with Cenergy Power. Supervisor Ritter - Attended Local Government Committee meeting; First 5 Executive meeting; Women of NACo meeting; Ribbon Cutting for the new Inspire High School; National Association for the Advancement of Colored People meeting; Passages Advisory Board meeting; Behavioral Health Advisory Board meeting; California Retired Employees Association; First 5 meeting; Disability Action Committee at the Diversability Advocacy Network meeting; Sunset Social at Chico State Campus; and Groundbreaking for the new Butte County Behavioral Health facility in Gridley; met with a Representative from Youth For Change; and Restorative Justice Steering Committee. Supervisor Kimmelshue - Attended Groundbreaking for the new Butte County Behavioral Health facility in Gridley; went to Washington D.C. to meet with NACo and FERC. BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 Supervisor Teeter - Had conversations with Representatives from the League; CSAC; and RCRC; attended RCRC meeting; the Sierra Nevada Conservancy Subregion Agenda Review meeting; and received an update from the Manager of the Paradise Recreation and Park District. He further requested that the Board support expanding the requirements for telecommunications applicants to provide three alternative site locations for all zoning districts, rather than only residential zones. 4.2 Public Comment Comments to the Board on issues and items not listed on the agenda. The BHAB consists of a minimum of 10 members, with 50% of the membership being consumers or family members of consumers who are receiving or have received mental health services; one member of the Board of Supervisors; one law enforcement representative; one youth representative; one Veteran or Veteran advocate and at least one community member with knowledge of the mental health care system. The BHAB recommends the Board of Supervisors appoint Zia Miller as a Member under the age of 25 to serve a one-year term ending August 24, 2027, and Kirsten Storne to serve as Community Member to serve a three-year term ending August 24, 2029. Motioned: Supervisor Ritter Second: Supervisor Kimmelshue Motion passed unanimously. 4.4 Appointment to the Forest Advisory Committee (FAC) The Board of Supervisors established the FAC to facilitate public involvement and ensure County coordination with federal, State, and non-governmental partners as it pertains to utilization and management of public lands. The FAC consists of 5 public members and 5 alternates representing the following areas of interest: 1) Agriculture/Timber Management; 2) Recreation – Motorized; 3) Recreation – Non-Motorized; 4) Environmental & Watershed Management; 5) Economic/Tourism. One application has been received from Seth Mitchell, requesting appointment as the Agriculture/Timber Management Alternate. If appointed, Mr. Mitchell would serve a term ending December 31, 2029. Motioned: Supervisor Durfee Second: Supervisor Kimmelshue Motion failed with a 2-3 vote (Ayes: Supervisors Durfee and Kimmelshue; Nays: Supervisors Ritter, Teeter and Chair Connelly). 4.5 Update from Pioneer Community Energy (Pioneer) on Customer Engagement Plans in Butte County On October 8, 2024, the Board of Supervisors directed staff to move forward with Pioneer, a JPA serving El Dorado and Placer Counties as well as several cities. Pioneer is a BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 Community Choice Aggregator (CCA) allowing local governments to procure electricity generation on behalf of residents and businesses at wholesale market rates while still utilizing the existing transmission and distribution infrastructure of utilities like PG&E. Pioneer prioritizes ratepayer savings and local control, working to provide competitive electricity rates to residents and businesses. On December 19, 2024, the Pioneer Governing Board approved expansion efforts, and the Cities of Chico and Oroville, as well as the Town of Paradise, voted to join the JPA. On February 11, 2025, the Board adopted a resolution to become a member of Pioneer and adopted an ordinance to join the Pioneer CCA. Pioneer plans to launch their services in Butte County in late 2027 and will provide an update on their customer outreach and enrollment plans. (COUNTY ADMINISTRATION) Action Requested - ACCEPT FOR INFORMATION. Katie Simmons, Deputy Chief Administrative Officer, and Lisa Rhoads, Community Outreach Manager for Pioneer Community Energy, presented this item to the Board. BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 4.7 Contract Amendments (21) for Indigent Defense Services The County is required by State and federal law to provide an attorney for persons charged with a crime or in other special circumstances, if they cannot afford an attorney. Butte County contracts for this service with a consortium of local attorneys who provide indigent defense services. The consortium has been an effective component of the criminal justice system, and has the support of the Superior Court Bench, District Attorney, Chief Probation Officer, and Sheriff. The County's existing consortium contracts will expire June 30, 2027. There are currently 17 full-time, three half-time, and one part-time attorney in the consortium, providing indigent defense services for the criminal courts, mental health court, veterans' court, probate conservatorship proceedings, DUI court, family court contempt cases, domestic violence court, drug court, parole revocations, sexual violent predator proceedings, pretrial and post-trial extraordinary writs. The consortium selects an attorney to serve as the Executive Director, who is responsible for the administration of the consortium and for securing investigator services for the consortium. Staff and the consortium have negotiated a four-year amendment. The rates for the Executive Director and investigator services remain unchanged. County Administration recommends the Board of Supervisors approve 21 indigent defense contract amendments. The amendments extend the term of each contract for four years, through June 30, 2031, and increase the maximum payable amount per attorney by 6% for fiscal years 2027-28, 2028-29, 2029-30 and 3% for fiscal year 2030-31. The annual rate per attorney is as follows: full-time attorneys, $190,885 the first year, increasing to $220,913 the final year; half-time attorneys, $90,040 the first year, increasing to $104,204 the final year; part-time attorneys, $47,721 the first year, increasing to $55,229 the final year. With this vote, CalPERS requires a resolution terminating the unit from CalPERS Health for the upcoming calendar year. This resolution must be adopted by the Board of Supervisors no later than September 11, 2026, in order to take effect January 1, 2027. Adopting this resolution within CalPERS required timelines will allow this group of employees to have access to Teamsters Health Insurance effective January 1, 2027. PUBLIC HEARINGS AND TIMED ITEMS 5.1 10:00 am - Public Hearing - Appeal of Verizon Wireless & Everest Infrastructure Partners Telecommunication Facility Conditional Use Permit (UP25-0003) Appeal of the Planning Commission's approval of Conditional Use Permit (UP25-0003) for Verizon Wireless & Everest Infrastructure Partners, for the proposed construction and operation of a new unmanned wireless communications tower. The project includes a 100-foot-tall monopole, with an additional 5-foot lightning rod, for a total of 105 feet, nine panel antennas mounted on the tower, along with supporting communication equipment, including a microwave antenna, GPS antenna, and related electronic equipment. The project will also include a fenced 50-foot equipment area containing two ground-mounted equipment cabinets, utility equipment and a fiber connection. Additionally, there is a proposed 30-kilowatt emergency backup generator with a 203-gallon diesel fuel tank and a new driveway providing access from Flag Creek Road. The project site is located on the north side of Flag Creek Road, approximately 1,950 feet east of Coal Canyon Road, approximately 5.8 miles north of Oroville (APN 041-140-023). An Initial Study and Mitigated Negative Declaration were prepared pursuant to the California Environmental Quality Act and were previously circulated for public review. BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 The Planning Commission considered this item at public hearings held on February 26, 2026 and April 23, 2026. After consideration of all the facts presented at the public hearing, including the Initial Study and Negative Declaration, staff reports, and all written and verbal public testimony, along with the applicant reducing the height of the tower to 100 feet, the Planning Commission approved the project on April 23, 2026, with a 4-0-1 vote. The project is located 1,400 feet north of Forbestown Road, in the unincorporated community of Hurleton, east of Oroville (Assessor Parcel Number: 072-190-038). The tower and associated equipment would be located within a 2,500-square-foot (50' x 50') enclosed lease area and secured by an 8-foot-tall chain-link fence with green privacy slats. Project construction includes the underground installation of electrical service from an BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 existing utility pole located approximately 290 feet east of the site, which requires trenching along that alignment. Access to the facility would be provided by a 12-foot-wide gravel driveway within a 15-foot-wide access easement from Weger Road. The facility would include a backup diesel generator and is designed to accommodate future co-location by additional wireless carriers. A Mitigated Negative Declaration (MND) has been prepared pursuant to the California Environmental Quality Act. The Initial Study and MND for this project were previously circulated for public review. The staff report and all associated documents from the Planning Commission meeting are included for the Board's consideration of this appeal. The Planning Commission considered this item at a public hearing held on April 23, 2026. After consideration of all the facts presented at the public hearing, including the Initial Study and Mitigated Negative Declaration, staff reports, and all written and verbal public testimony, the Planning Commission approved the project with a 5-0 vote. The Planning Commission's approval was subsequently appealed on May 4, 2026. Some CSAs and PRDs are funded by service charges to property owners BUTTE COUNTY BOARD OF SUPERVISORS MINUTES – AUGUST 25, 2026 within the district. These service charges are set annually by the Board based on needs as anticipated in the adopted CSA and PRD budgets. The process for establishing charges is laid out in Government Code section 25215.5 for CSAs, and Streets and Highway Code section 1178 for PRDs. The Departments of General Services, Public Health, and Public Works manage the areas funded with service charges and prepare an annual budget for anticipated expenses in that given year. Based on these budgets, the recommended parcel charges are calculated. These charges cannot exceed the maximum voter-approved amount previously established pursuant to Proposition 218 election (the Right to Vote on Taxes Act). Four CSAs are recommended to receive parcel service charge increases for FY 2026-27; CSAs 82, 128, 141, and 172. In addition, two new PRDs were established for FY 2026-27: Moon Tower Estates Subdivision, Zone 6, and Orchardcrest Estates Subdivision, Zone 7. County Administration recommends the Board adopt the proposed parcel service charges as laid out in Exhibit A of the Resolution. Effective January 1, 2027, as required by Senate Bill 255, the Clerk-Recorder's Office will be implementing a new program to send Property Transfer Notifications for all Deeds, Deeds of Trust, Quitclaim Deeds, and Mortgages. This notice serves as a courtesy and alert to property owners that the ownership transfer has taken place.
